14-008 RESOLUTION NO. 14 -008 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR TEMPORARY CONSTRUCTION AND /OR SALES FACILITY ON PROPERTY DESCRIBED AS LOT 1, BLOCK 1, SOLANA ADDITION, CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS; AND LOCATED AT 500 WEST DOVE ROAD, SOUTHLAKE, TEXAS, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A ", AND AS DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a temporary construction and /or sales facility has been requested by a person or corporation having a proprietary interest in the property zoned as "NR -PUD" Non - Residential Planned Unit Development District; and, WHEREAS, in accordance with the requirements of Section 45.18 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted to allow a temporary construction facility, on property within the City Of Southlake, Texas, located at 500 West Dove Road, location being described as Lot 1, Block 1, Solana Addition, an addition to the City of Southlake, Tarrant County, Texas, more fully and completely described in Exhibit "A ", and as depicted on the approved plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: Approved (7 -0) subject to the following: • Existing six -foot opaque fence material surrounding the property remain in place; • The SUP expiring on the earlier of 60 days after certificate of occupancy is issued or November 15, 2014; • Approval of requested variances — for the building not to be skirted, landscaping requirement not being met and the paved parking spaces not being provided; • And, pursuant to the Planning & Zoning Commission recommendations: o Approved (6 -0) subject to Concept Plan Review Summary No. 2, dated February 13, 2014 and the Staff Report dated February 14, 2014; granting the requested variances as presented and extending the validity of the SUP to the earlier of November 15, 2014 or sixty (60) days after the Certificate of Occupancy is issued for the occupied portions of the building. SECTION 2. This resolution shall become effective on the date of approval by the City Council. PASSED AND APPROVED THIS 4 DAY OF MARCH, 2014.
