authorized representative, of the County of Tarrant, State of Texas (Grantor) for and in
consideration of ONE DOLLAR and other good and valuable consideration, paid by the
CITY OF SOUTHLAKE, a municipal corporation of Tarrant County, Texas (Grantee),
receipt of which is hereby acknowledged, does hereby grant, bargain, sell and convey
to said Grantee, its successors and assigns, a permanent right -of -way easement and
the right to construct, reconstruct and perpetually maintain a public street and /or
drainage facilities and utilities, together with all necessary appurtenances thereto, and
with the right and privilege at any and all times, to enter the right -of -way easement on
Exhibit "A ", or any part thereof, as is necessary for the proper use of any other right
granted herein and for the purpose of constructing, reconstructing, replacing and
maintaining said public street and /or drainage facilities and utilities, and for making
connections therewith, in, upon, under and across the following described parcel of
land in Tarrant County, Texas (the "Property ") being described as follows :
Exhibit "A ", attached hereto and made a part hereof
TO HAVE AND TO HOLD said permanent right -of -way easement unto the Grantee, for
the purposes herein set forth, and Grantor hereby binds itself, its successors and
assigns, to warrant and forever defend the said conveyed property and rights granted
herein unto Grantee, its successors and assigns against every person whosoever
lawfully claiming or to claim the same or any part thereof, by, through or under
GRANTOR, but not otherwise, subject to all valid and subsisting easements,
restrictions, reservations, covenants, conditions and other instruments relating to said
Property, as the same may be shown by instruments filed of public record in Tarrant
County, Texas.

"VARIABLE WIDTH RIGHT -OF -WAY"
Being 0.169 of an acre of land situated in the Richard Eads Survey, Abstract No. 481, City of
Southlake, Tarrant County, Texas, being a portion of a tract of land described in deed to SLTS
Land, L.P., a Texas limited partnership, as filed in Instrument #D205049245, Deed Records of
Tarrant County, Texas (D.R.T.C.T.); said 0.169 of an acre of land being more particularly
described by metes and bounds as follows:
COMMENCING at a 5/8 inch iron rod with cap stamped "Bury +Partners" found in the east
line of said SLTS Land tract at the most westerly south comer of said tract, also being the most
westerly southwest corner of Lot 1, Block 12, Southlake Town Square, Phase W, an addition to
the City of Southlake, Tarrant County, Texas, as filed in Cabinet A, Slide 10949, Plat Records
of Tarrant County, Texas, from which a 5/8 inch iron rod with cap stamped "Bury+Partners ",
found at an interior corner of said SLTS Land tract, also being the northwest corner of said Lot
1, bears N 00 °44'54" W, 463.52 feet;
THENCE S 72 °32'05" W, over and across said SLTS Land tract, a distance of 62.65 feet to a
5/8 inch iron rod with cap stamped "TNP", set in the south line of said SLTS Land tract, also
being the north Right -of -Way (R -O -W) line of Federal Way (62.5 feet in width), for the
POINT OF BEGINNING of the hereinafter described tract of land;
THENCE S 89 °13'49" W, along said south line of SLTS Land tract and said north R-O -W line
of Federal Way, a distance of 498.15 feet to the most southerly southwest corner of said SLTS
Land Tract;
THENCE N 45 °51'36" W, continuing along said line, a distance of 28.33 feet to the most
westerly southwest comer of said SLTS Land tract, also being the intersection of the east
R-O -W line of North Carroll Avenue (Variable Width) with the north R -O -W line of said
Federal Way;
THENCE N 00 °57' 12" W, along the west line of said SLTS Land tract and said east R -O -W
line, a distance of 4.25 feet to a "X" cut set in edge of concrete walk;
THENCE leaving said line over and across said SLTS Land tract, the following courses and
distances:
S 45 °51'36" E, a distance of 13.81 feet to a 5/8 inch iron rod set with cap stamped
