1992-008City of Southlake, Texas RESOLUTION NO.92-08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR PETROLEUM OPERATIONS ON A TRACT OF LAND WITHIN THE CITY OF SOUTHLAKE, TEXAS, BEING DESCRIBED AS 16.48 ACRES, OUT OF THE HARRISON DECKER SURVEY, ABSTRACT NO. 438, TRACT 1B1A; C.B. MCDONALD SURVEY ABSTRACT NO. 1013, TRACTS 4B AND 4C; AND P.R. SPLANE SURVEY, ABSTRACT NO. 1453, TRACT 1B, AND MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for the location of Petroleum Operations has been requested by a person or corporation having a proprietary interest in the property described in Exhibit A" attached hereto; and, WHEREAS, in accordance with the requirements of Section 45.1 (26) of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded a full and fair hearing to all property owners generally and to the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such specific use permit is in the best interest of the public health, safety, morals, and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: SECTION 1 A Specific Use Permit is hereby granted for Petroleum Operations on the property described in Exhibit "A" attached hereto, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: City of Southlake, Texas Resolution No. 92-08 page two 1) elimination of reference to tank size and capacity for future "tanks". 2) site coverage not to exceed 1%. 3) the bufferyard requirement along "like uses" be waived. 4) requirements #1, #3, and #4, of the staff summary review letter #2, dated 2/28/92 be followed. Show typical pavement width for Continental. On the portion of Continental east of existing S. Kimball, label as "R.O.W. dedicated, no road improvements". 3. On property to the east, Lots 3-11 are zoned "MH" Manufactured Housing, and the L.U.D. = Industrial. Lots 1 and 2 are zoned I-1" light industrial. 4. Label the Green Meadows Addition (V. 388-96, P. 45) on Tracts 3 and 4 northeast of this site. Both R.O.W. within this addition are 84' in width. 5. Show and label the "Future 84' R.O.W." line on Continental. This should be approximately 42' from the center of the existing R.O.W.
