RESOLUTION NO. 88-17
A RESOLUTION OF THE CITY OF SOUTHLAKE, TEXAS
AWARDING A CONTRACT FOR THE PURCHASE OF FOUR
4) POLICE PATROL CARS AND AUTHORIZING AND
DIRECTING THE CITY MANAGER TO ENTER INTO
SUCH CONTRACT; DECLARING THE NECESSITY TO
IMMEDIATELY APPROPRIATE FUNDS DUE TO
UNFORESEEN DAMAGE TO PUBLIC PROPERTY AND FOR
THE PRESERVATION AND PROTECTION OF THE
PUBLIC HEALTH AND SAFETY OF THE RESIDENTS OF
THE CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, after due notice to bidders, the City of
Southlake, Texas (the "City") received bids from four (4)
bidders for the purchase of three (3) police patrol cars; and
WHEREAS, the City Council hereby finds that the bids
submitted by Graff Chevrolet and Bradford Chevrolet -Oldsmobile,
Inc. are hereby rejected as "responsible" bids for the reasons
that the bids are vague as to the specifications contained
therein, and that Bradford Chevrolet -Oldsmobile, Inc. is
located in Graham, Texas, which is an unreasonable distance
from the City for future maintenance and repair of the patrol
cars; and
WHEREAS, the City Council hereby finds and declares that
the bid of Bruce Lowrie Chevrolet, Inc. of $13,805.49 for each
vehicle is the lowest, most responsible bid for the purchase of
the three (3) police patrol cars; and
WHEREAS, the City Council hereby finds and determines
that the immediate purchase of an additional police patrol car
is required due to the unforeseen damage to public property
created as a result of the recent destruction by fire of a
presently owned police patrol car of the City and in order to
preserve and protect the public health and safety of the
residents of the City; and
WHEREAS, the City Council hereby declares its intent to
appropriate funds for the purchase of an additional police
patrol car meeting the same specifications as the three (3)
vehicles for which bids have been received; and
WHEREAS, Section 252.022(a) of the Texas Local Government
Code (the "Code") authorizes the City to purchase items without
complying with competitive bid requirements when the
procurement is necessary because of unforeseen damage to public
machinery, equipment or other property and to preserve or
protect the public health or safety of the residents of the
City.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE:
Section 1. The above premises are found to be true and
correct and are incorporated into the body of this resolution
as if they were set out in their entirety herein.
Section 2. The City Council hereby accepts the bid
from Bruce Lowrie Chevrolet, Inc. for the purchase of three (3)
police patrol cars, and authorizes and directs the City Manager
to enter into'a contract with Bruce Lowrie Chevrolet, Inc. for
the purchase of the three vehicles, plus an additional vehicle,
for a total of four (4) police patrol cars, at a purchase price
of $13,805.49 for each vehicle, as set forth in the preambles
hereof.
Section 3. This resolution shall become effective
after its passage and adoption by the City Council.
