15-025RESOLUTION NO. 15-025 A, RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR FUSION ACADEMY, A PRIVATE SCHOOL, ON PROPERTY LOCATED AT 301 STATE STREET, SUITE 200, SOUTHLAKE, TARRANT COUNTY, TEXAS AND BEING LEGALLY DESCRIBED AS LOT 2111, BLOCK 3112R, SOUTHLAKE TOWN SQUARE ADDITION, AS DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a private school has been requested by a person or corporation having a proprietary interest in the properties zoned as "DT" Downtown District; and, WHEREAS, in accordance with the requirements of Section 45.1 (3) of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a private school on property located at 301 State Street, Suite 200 and being described as Lot 2R1, Block 3R2R, Southlake Town Square Addition, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet A, Slides 4892, 6888 and 6889, Plat Records, Tarrant County, Texas, as described in Exhibit "A", and as depicted on the approved Site Plan attached hereto and Resolution No. 15-025 incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: 1) May 19, 2015; Approved (6-1) subject to Staff Report dated May 12, 2015 and accepting the recommendations of the Planning and Zoning Commission (tying the specific use permit expiration to the lease) and adding the following stipulations: parking for this specific use permit will be located on the second and third levels of the west garage; with respect to pedestrian safety, there will be a striped crosswalk between the eastern entrance to the building and towards the west garage; noting that the parking spots located next the west garage will be further striped and marked as a passenger loading zone for students and guests of the school; and requiring security cameras to be located at the entrance to the building. SECTION 2. This resolution shall become effective on the date of approval by the City Council. PASSED AND APPROVED THIS 19th DAY OF MAY, 2015.
