Background
Information:
The purpose of this item is to consider amending Section 26, I-1 Light
Industrial District, thereby also amending Section 27, I-2 Heavy Industrial
District, to remove “Commercial school, including trade school” as a
permitted use by right and allow only through approval of a Specific Use
Permit by adding the use to Section 45 of the Comprehensive Zoning
Ordinance No. 480, as amended.
At first reading of this item, City Council discussed the possibility of better
defining a commercial school, including trade school. Based on that
discussion, staff has provided a definition for consideration in Section 4 of
the Zoning Ordinance (Page 4). Additionally, staff is proposing
supplementary criteria in considering whether to grant a specific use
permit addressing ingress and egress and nighttime illumination of a Site
(Page 4). Finally, staff expanded the permitted uses in Section 21, C-2
Local Retail Commercial District to include uses such as martial arts,
music schools, yoga, etc. to provide more clarity on where these uses are
permitted by right (within the C-2, C-3, C-4 Districts – not permitted in I-1
and I-2)
The proposed amendment would grant the Planning and Zoning
Commission and City Council the ability to review and allow the location
of commercial schools, including trade schools in industrial areas. The
amendment would result in removing “Commercial school, including trade
school” as a permitted use by right from Section 26, I-1 Light Industrial
District, and subsequently Section 27, I-2 Heavy Industrial District, and
add this use to Section 45, Specific Use Permits, of the Comprehensive
Zoning Ordinance No. 480, as amended.

As with any amendment to the zoning ordinance, business owners that
currently meet and adhere to the existing regulation(s) of Section 26 (I-1
Light Industrial District) and Section 27 (I-2 Heavy Industrial District) of
the Zoning Ordinance will be able to maintain that use in accordance with
Section 6 of the Zoning Ordinance (Nonconforming Uses).
Overview of the Current Ordinance
Section 26 of the Zoning Ordinance (I-1 Light Industrial District) currently
allows “Commercial school, including trade school” by right. Section 27 of
the Zoning Ordinance (I-2 Heavy Industrial District) allows “All uses
permitted within the I-1 Light Industrial Zoning Classification” thereby
permitting “Commercial school, including trade school.” The purpose and
intent for the I-1 Light Industrial District as described by the Zoning
Ordinance is envisioned to accommodate industrial, manufacturing,
fabrication, wholesale and storage activities of a low intensity industrial or
manufacturing character. The I-2 Heavy Industrial District is designed to
accommodate heavy industrial uses and those activities which clearly
generate significant negative environmental impacts which might
negatively affect surrounding properties, and is the most intensive use
classification within the City of Southlake. Among the various permitted
industrial uses, Section 26 and Section 27 of the Zoning Ordinance also
permit “Commercial school, including trade school” by right.
Purpose for Revision
A concern has been raised regarding the mix of uses currently permitted
by right within the I-1 Light Industrial District, and the I-2 Heavy Industrial
District. Given that the I-1 and I-2 Zoning Districts are meant to
accommodate industrial activities, and that the I-2 Heavy Industrial
Zoning District is the most intensive use classification within the City of
Southlake, there is concern that the allowance of “Commercial school,
including trade school” in the industrial districts should be more
thoroughly reviewed by the Planning and Zoning Commission and City
Council.

P&Z Commission on May 21, 2015, and a Public Hearing will also be held
by City Council.

AND PROVIDING AN EFFECTIVE DATE.
WHEREAS
, the City of Southlake, Texas is a home rule city acting under its charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Local Government Code; and
WHEREAS,
the city has adopted Ordinance No. 480, as amended, as the
Comprehensive Zoning Ordinance for the city; and
WHEREAS,
the City Council has determined that it is appropriate and in the best
interest of the city to promote the public health, safety, and general welfare of its residents by
amending Ordinance No. 480 as provided herein; and
WHEREAS
, the City Council has given published notice and held public hearings with
respect to the amendment of the zoning ordinance as required by law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1
Section 26 of the Zoning Ordinance No. 480, as amended, is hereby amended by removing the
following from subsection from 26.2.c and consecutively renumbering the subsection:
SECTION 26.2 PERMITTED USES
c. Industrial Uses.
12. Commercial school, including trade school.

SECTION 2
Section 4 of the Zoning Ordinance No. 480, as amended, is hereby amended by adding the
following definition:
SECTION 4.2 DEFINITIONS
COMMERCIAL SCHOOL, INCLUDING TRADE SCHOOL -
Establishments, not including public or parochial schools, private primary
or secondary schools, or colleges, that offer scheduled training or
instruction in a trade, art or occupation. This includes private educational
facilities for profit including training centers, martial arts, dancing, music,
fitness and athletic training.
SECTION 3
Section 21 of the Zoning Ordinance No. 480, as amended, is hereby amended by rewording the
existing definition:
SECTION 21.2 PERMITTED USES (As amended by Ordinance No. 480-U.)
13. Dancing schools, martial arts, music schools, yoga or other similar
uses.
SECTION 4
Section 45 of the Zoning Ordinance No. 480, as amended, is hereby amended by adding the
following subsections:
45.1 GENERAL PROVISIONS

48. Commercial School, including trade school
45.19 IN CONSIDERING WHETHER TO GRANT A SPECIFIC USE PERMIT, THE CITY
COUNCIL SHALL CONSIDER THE FOLLOWING:
1) Safe access for the ingress and egress of students, pedestrian, and vehicular traffic,
including the identification of student drop-off areas.
2) Adequate illumination will be provided at night to protect the safety of those persons
entering and exiting the site.
SECTION 5
This ordinance shall be cumulative of all provisions of ordinances of the City of
Southlake, Texas, except where the provisions of this ordinance are in direct conflict with the

provisions of such ordinances, in which event the conflicting provisions of such ordinances are
hereby repealed.
SECTION 6
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph
or section.
SECTION 7
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions of this ordinance shall be
fined not more than Two-Thousand Dollars ($2,000.00) for each offense. Each day that a
violation is permitted to exist shall constitute a separate offense.
SECTION 8
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances
affecting zoning yard regulations which have accrued at the time of the effective date of this
ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal,
whether pending in court or not, under such ordinances, same shall not be affected by this
ordinance but may be prosecuted until final disposition by the courts.

SECTION 9
The City Secretary of the City of Southlake is hereby authorized to publish this ordinance
in book or pamphlet form for general distribution among the public, and the operative provisions
of this ordinance as so published shall be admissible in evidence in all courts without further
proof than the production thereof.
SECTION 10
The City Secretary of the City of Southlake is hereby directed to post the proposed
ordinance in its entirety on the City website together with a notice setting out the time and place
for a public hearing thereon at least ten (10) days before the second reading of this ordinance,
and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation
of any of its provisions, then the City Secretary shall additionally publish this ordinance in the
official City newspaper one time within ten (10) days after passage of this ordinance, as
required by Section 3.13 of the Charter of the City of Southlake.
SECTION 11
This ordinance shall be in full force and effect from and after its passage and publication
as required by law, and it is so ordained.
