2015-04-30CITY OF SOUTHLAKE TEXAS ZONING BOARD OF ADJUSTMENT MEETING: April 30, 2015 LOCATION: 1400 Main Street, Southlake, Texas City Council Chambers of Town Hall Regular Session: Members Present: Vice Chair Bradford Cunningham, Board members Mike Smietana, Scott yc e, Enc Ransom, and Kourosh Panahy. Members Absent: None. Staff Present: Dennis Killough, Deputy Director of Planning & Development Services; Richard Schell, Principal Planner and Erica Wilson, Board Secretary Agenda Item No. 1 — Call to Order: Vice Chair Bradford Cunningham called the meeting to order at 6:31 p.m. Agenda Item No. 2 — Approval of the Minutes: Vice Chair Bradford Cunningham opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on March 26, 2015. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on March 26. Motion: Panahy Second: Smietana Ayes: Ransom, Smietana, Dyche, Panahy, and Cunningham Nays: None Abstain: None Vote: 5-0-0 Motion: Carried Agenda Item No. 3 — Administrative Comments: Richard Schell, Principal Planner, announced that the next meeting will be held on May 14, 2015. Agenda Item No. 4 — ZBA-672, Variance to Ordinance No. 480, Section 11.5(b), requiring a front yard setback of 40' and a Special Exception Use per Ord. No. 480, Section 44.12(2) for an accessory structure of a size or aggregate size greater than the size permitted on property described as Lot 1, Block 2, Brewer Addition, an addition to the City of Southlake, Tarrant County, Texas and located at 2903 Florence Rd., Southlake, Texas. Current Zoning: "SF -1 B" — Single Family Residential District. This item has been administratively tabled to the May 14, 2015 Zoning Board of Adjustment meeting in order to send notification letters to surrounding property owners with a corrected meeting date. Current Zoning: "R -PUD" — Residential Planned Unit Development District Planner Schell then presented details of the request approval of a Variance to Ordinance No. 480, Section 34.2(a), requiring accessory buildings on a permanent foundation to be located no closer than 10' to a property line in the rear yard to allow a covered outdoor living space to be located approximately 9' from the side property line. Vice Chair Cunningham opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Vice Chair Cunningham asked if there were those in the audience who wished to speak in support of the request. There being no one, Vice Chair Cunningham asked if there were those in the audience who wished to speak in opposition of the request. There being no one, Vice Chair Cunningham closed the public hearing and opened the item for discussion. After discussion from the board, Vice Chair Cunningham stated that he was prepared to entertain a motion on the requests as separate motions. A motion was made to approve case ZBA-685. Nays: None Abstain: None Vote: 5-0 Zoning Board of Adjustment Meeting Minutes — April 30, 2015 Page 2 of 4 Motion: Carried Agenda Item No. 6-, ZBA-686, Variance to Ordinance No. 480, Section 33.19, requiring a 5' wide sidewalk to be provided along all public streets for all developments requiring a City Council approved Site Plan, on property described as Lots 6 and 7, Block A, North Davis Business Park, an addition to the City of Southlake, Tarrant County, Texas and located at 1900 and 1950 Greenwood Dr., City of Southlake, Texas. Current Zoning: 1-11" — Light Industrial District. Planner Schell presented details of the request for approval of a Variance to Ordinance No. 480, Section 33.19, requiring a 5' wide sidewalk to be provided along all public streets for all developments requiring a City Council approved Site Plan, for Elite Commercial Suites, which is an approved self -storage facility consisting of three (3) single -story buildings with a total square footage of approximately 32,016 square feet in size. A Site Plan for Elite Commercial Suites was approved by the Planning and Zoning Commission on April 9, 2015 and approved by City Council on April 21, 2015. The applicant is requesting to not provide a sidewalk along the street since there are no existing sidewalks in the North Davis Business Park. Vice Chair Cunningham opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire.
