The applicant is requesting 1st reading approval of a Zoning Change and Development Plan for Shady Lane to develop seventeen residential lots and three open space lots on approximately
20.5 acres. The Development Plan has been revised since the case was first tabled at 1st reading on March 3, 2015 to remove one residential lot.

Revised Development Plan (17 lots)
This is the proposed Development and Pedestrian access plan. As mentioned there are 17 lots proposed and three open space lots. As configured the net density is .912 DU/acre and the
gross os.83 DU/acre. Open space consist of 5.37 acres (23%). An open space management plan is located in the staff report. Open space lots are to be maintained by the HOA. The applicant
is proposing a 4 ‘ sidewalk along Shady Oaks from the flood plain to the northwest corner of the lot. Four foot sidewalks are also shown along the internal streets in the development.
Changes to the plan since the March 3rd plan include:
Reduction in the lot count to 17 which reduced the density and increased the open space. (next slide provides details)
The 4’
sidewalk is shown extending to the northwest property line.
The trail leading to the corp property is now located outside the southern lots. The trial is now 5’ wide. The southern
lots have been reconfigured slightly to accommodate an off site trial and there are now 7 lots instead of 8’ so the lot widths have been widened.

Revised Tree Preservation Plan
This is the tree preservation plan. 72.3% of the site has existing tree canopy. Under a R-PUD the applicant present a proposed plan. The applicant has indicated that 66% of the tree
canopy will be preserved. If this were developed under a straight zoning the Tree Preservation ordinance would require 40% of the canopy to be maintained.

February 5. 2015; A motion to approve the item, subject to Development Plan Review Summary No. 3, dated January 30, 2015 and the staff report dated January 30, 2015, noting for the
record that the applicant has agreed to articulate on all lots, but especially on Lots 8-15, thirty (30) foot and thirty-five (35) foot setbacks prior to going to Council with the application
and will address a percentage of how that will come to fruition, that the applicant will build a sidewalk on the northwest portion of the project on Shady Lane, noting that the applicant
has agreed to clean up the creek on the south side of the project, also noting the applicant’s willingness to present to Council a second rendering of Lots 8-15, which would have a consistent
southern boundary as opposed to the meandering drive as is shown now so that that can be more fully addressed by Council, received a (3-3) vote.
A subsequent motion to deny the item
also received a (3-3) vote.
