Item 7A Zoning Change and Concept Plan 1860 Sunshine Lane ZA15-014 1 Owner: Adam Jaberi Applicant: Charles Starnes Request: Approval of a Zoning Change and Concept Plan from “SF-1A” Single Family Residential District to ‘SF-20A” Single Family Residential District for 1860 Sunshine Lane. Location: 1860 Sunshine Ln., described as Tract 3A1F5, Francis Throop Survey, Abstract No. 1511 ZA15-014 The applicant is requesting approval of a zoning change and concept plan from SF 1A to SF-20A to remove an existing home that was constructed on the property in 1971 and build a new home. In order to receive a bulding permit a plat must be approved. A plat cannot be approved under the current SF1A zoning because a platted lot must conform with the underling zoning and the existing lot does not meet the lot size requirements which is 43,560 sq ft for a SF-1A property. The existing tract of land is 28,808 sq ft. A request for a variance to lot size was denied by the ZBA on November 13, 2014, so now the applicant is requesting a zoning change to SF-20 A which requires a minimum lot areas of 20,000 sq ft. 2 The subject property is outlined by the gray line. A zoning change from “AG” to “A-3” One Family Zoning (zoning ordinance 16) was approved in 1971 with an exhibit showing three tracts abutting Shumaker Ct as they exist today (minimum 10,000 sq. ft. lots). The property was given the “A-3” single family zoning designation with the adoption of zoning ordinance 261-A in 1981. At this time the minimum lot size for the A-3 zoned property was changed to 43,560 sq. ft. The property was given the “SF-1” single family zoning with the adoption of zoning ordinance 334 in 1986. The minimum lot size for the SF-1 was 43,560 sq. ft. The property was given the “SF-1A” single family zoning with the adoption of zoning ordinance 480 in 1989. A variance is being requested for the tree preservation ordinance. The existing canopy cover is 36% on site. The ordinance requires 60% of the that tree cover be preserved. The applicant is proposing to save 56% of the tree canopy.
