Allen Taylor and City Secretary Lori Payne. WORK SESSION: 1. CALL TO ORDER The Work Session was called to order by Mayor Terrell at 5:32 p.m. 2. INVOCATION Jeff Gary gave the invocation. Mayor Terrell led the pledge of allegiance to the United States and Texas Flags. Mayor Terrell recognized Boy Scout Troop 937 Senior Patrol Leader, Joshua McSwain, for his attendance tonight and thanked him for his good work with the scouting organization. 3. CHAMBER OF COMMERCE UPDATE Mayor Terrell introduced Southlake Chamber of Commerce Board Chairman Ian MacLean. Mr. MacLean gave a brief update on Chamber activities. City Attorney Allen Taylor made a brief presentation to inform the public of the status of the appeal and the case for the Southlake Town & Country development. 5. DISCUSS ALL ITEMS ON TONIGHT'S AGENDA. NO ACTION WILL BE TAKEN AND EACH ITEM WILL BE CONSIDERED DURING THE REGULAR SESSION. Mayor Terrell reviewed the consent agenda items. REGULAR SESSION: 1. CALL TO ORDER The Regular Session of the City Council was called to order by Mayor Terrell at 5:53 p.m. 2A. EXECUTIVE SESSION Mayor Terrell announced that City Council would be going into Executive Session pursuant to the Texas Government Code, Section 551.071, consultation with city attorney, Section 551.072, deliberation regarding real property, and Section 551.074, deliberation regarding personnel matters. City Council adjourned for Executive Session at 5:53 p.m. Executive Session began at 6:15 p.m. and concluded at 6:49 p.m. 2B. RECONVENE Mayor Terrell reconvened the meeting at 7:03 p.m. Mayor Terrell asked if any action was necessary from Executive Session. There was no action necessary as a result of Executive Session. 3A. MAYOR'S REPORT Mayor Terrell briefly announced upcoming meetings and events. 3A1. LEGISLATIVE UPDATE REGULAR CITY COUNCIL MEETING MINUTES, APRIL 21, 2015 Page 2 of 13 Mayor Terrell briefly presented information on HB40 and SB1165 regarding proposed changes to oil and gas drilling operations within municipalities. He instructed interested parties to watch the April 7, 2015 City Council meeting on Video on Demand at www.cityofsouthlake.com\drill ing where he and City Attorney Bryn Meredith provided an overview of the new law and what it could mean for Southlake. Director of Community Services Chris Tribble gave a brief overview of the Country in the Square event that was held in Town Square on April 18, 2015. 3B. CITY MANAGER'S REPORT 361. STRATEGIC PRIORITY UPDATE City Manager Shana Yelverton highlighted operational excellence in the strategic priority of Performance Management and Service Delivery. She announced that the Government Finance Officers Association (GFOA) of the United States and Canada recently presented the City of Southlake with the Distinguished Budget Presentation Award for the FY2015 Budget. This is the seventh year in a row that the City has received this award. This reflects the commitment of the governing body and staff to meeting the highest principles of governmental budgeting. A motion was made to approve Ordinance No. 480-692 (ZA14-076), 1St Reading, Zoning Change and Site Plan / Concept Plan for the Kumon Learning Center subject to Site Plan Review Summary No. 6, dated April 14, 2015 noting the following: • Prior to second reading, the applicant will come forth with an alternative tree preservation plan to save the existing 36 -inch American Elm; • In the northwest corner of the property where the proposed retaining wall will be built - the applicant will provide the proposed building materials for the retaining wall; • The applicant will attempt to revise the site plan to eliminate the buffer issue (lot line/setback variance); REGULAR CITY COUNCIL MEETING MINUTES, APRIL 21, 2015 Page 11 of 13 • The applicant will work with the property owner to the south to negotiate an access easement and at such time that access easement agreement is in place, the south driveway entrance towards the Phase II property would no longer be an entrance for the project (Lot 4R); • The applicant will come forth with parking alternatives to reduce or mitigate the existing driveway ordinance variances that are being requested: o For the purposes of this motion, we will approve the driveway variances noting the applicant will try to mitigate those to the extent possible prior to second reading; and, • The applicant will provide alternative elevations for the east side and remove the covered parking structure.
