Item 4G Department of Planning & Development Services S T A F F R E P O R T April 14, 2015 CASE NO: ZA14-020 PROJECT: Plat Extension for Shady Oaks Phase IV EXECUTIVE SUMMARY: DeOtte Engineering, Inc. is requesting approval of a Variance to Subdivision Ordinance No. 483, Section 4.01(I), as amended, regarding plat expiration, requesting to extend the validity of case ZA14-020, Final Plat for Shady Oaks IV on property described as Tracts 11C2A and 11C2, and portions of Tracts 11C, 11C7, 11 and 11E, Thomas M. Hood Survey, Abstract No. 706, City of Southlake, Tarrant County, Texas and located at 985, 1005, 1055 and 1125 N. Peytonville Ave., and 1020 and 1120 Shady Oaks Dr. Southlake, Texas. Current Zoning: “SF-20A” – Single Family Residential District. SPIN Neighborhood #6. REQUEST: DeOtte Engineering, Inc. is requesting approval of avariance to the Subdivision Ordinance No. 483, Section 4.01(I) (Plat Expiration), as amended, and is requesting that the validity of Case No. ZA14-020, Final Plat for Shady Oaks IV, be extended for an additional eleven months from the original expiration date of the plat. Section 4.01(I) states that a Final Plat which has not been recorded in the County Plat Records within one year of the date of approval shall expire. The Final Plat was approved by the Planning & Zoning Commission on April 17, 2014. Final plats for subdivisions requiring the installation of streets and utilities are typically not recorded until these improvements have been installed and are ready to be accepted by the City. This ensures that street right-of-ways and easements are correctly shown based on as-built conditions and also ensures that all the new lots of record are properly served by streets and utilities. The final plat for this development has not been recorded due to continuing construction of the development and has thus expired. The applicant is requesting an extension of eleven months from date of the original plat expiration date. If approved, the new expiration date for the Final Plat for Shady Oaks, Phase IV will be March 17, 2016. Hood Survey, Abstract No. 706 LAND USE CATEGORY: Medium Density Residential CURRENT ZONING: “SF-20A” – Single Family Residential District HISTORY: -A change of zoning from “AG” to “SF-20A” was approved by City Council on September 18, 2007 (ZA07-085). -A preliminary Plat for Shady Oaks Addition was also approved by City Council on September 18, 2007 (ZA07-086). -A variance to the requirements of the Tree Preservation Ordinance 585-D for Shady Oaks Phases III and IV was approved by City Council on December 3, 2013 to allow 42% of the existing canopy to be preserved instead of the 60% of the existing canopy required to be preserved by the Ordinance. -A Final Plat for Shady Oaks, Phase IV, was approved by the Planning and Zoning Commission on April 17, 2014.
