Chairman Hudson asked about the revenue of the existing bin.
Mr. Miller stated that the bin remains clean and kept up. It allowed the students to give
back to the community and learn recycling. The school made just a little over $400.00.
Commissioner Kubiak asked about crime and security.
Mr. Miller stated that there have been no issues.
Commissioner Parrish asked about light screening on the south side on Continental Blvd.
Mr. Miller stated that it would affect the pick-up.
Chairman Hudson opened and closed the public hearing.

Tony Brushay, 6104 Fannin Drive, Arlington and Trish Van Buskirk, 107 Belmont Circle,
Southlake came forward.
Chairman Hudson asked about the timeframe of the phasing for the project, specifically
Phase 2.
Ms. Van Buskirk stated that she did not have a timeframe yet. It would be based on
financing.
Chairman Hudson explained to the applicant that the covered parking in Phase 2 is not
involved unless Phase 2 is built.

Mr. Brushay stated that the covered parking would not be accessible until the driveway
is cut.
Chairman Hudson also expressed concerned about the large Elm tree.
Mr. Brushay stated that the roots of the Elm tree go far into the parking area and would
disrupt the footprint of the building if the parking is shifted. It would be difficult to
maintain the grade as well.
Chairman Hudson asked about the pick-up and drop off.
Ms. Van Buskirk stated that the parents park and walk in with their students and check-
in.
Commissioner Parrish asked about the reason for the covered parking.
Ms. Van Buskirk stated that the covered parking is for the employees for days that it is
raining and hot weather.
Mr. Brushay explained that the covered parking is located on the rear portion of the
property.
Commissioner Kubiak asked about the materials for the covered parking.
Mr. Brushay gave a list of materials and stated that they will be stone based and will
match the building.
Commissioner Kubiak asked about the variance request regarding the stacking depth.
Ms. Van Buskirk stated that Kumon Learning Center is only open 2 days a week,
Monday and Wednesday from 3pm to 7pm.
Mr. Brushay explained the grade and drive of the property that determined the request
for the variance.
Chairman Hudson opened and closed the public hearing.
Commissioner Kubiak is concerned about some of the variances being requested in
regards to long term use.
Commissioner Forman stated that due to the layout of the building specifically the
eastern side, this may be their only option.
Commissioner Parrish asked about replanting trees on the property.
Mr. Brushay referred to the proposed landscape plan that shows the planting of trees
including caliper.

Chairman Hudson asked about the setback variance.
Mr. Brushay stated that the building would lose 400 square feet.
Chairman Hudson and Commissioner Kubiak discussed the parking ratio, building
footprint and stacking depth.
Mr. Brushay explained that the current topography is the reason for the layout of the
parking spaces, building layout and the stacking depth variance request.
Chairman Hudson asked about the dumpster location.
Mr. Brushay showed the location.
Commissioner Kubiak asked about parking place numbers.
Mr. Brushay stated that they were a few spaces over than what is required. However, if
needed that number can be reduced and still meet the required ratio.
Commissioner Forman asked for clarification of the zoning and the allowable uses for
future purposes.
Motion to approve ZA14-076, subject to Site Plan Review Summary No. 5, dated
March 31, 2015, also subject to the staff report dated April 2, 2014 with the
following conditions or modifications included in the motion; with respect to the
S -P-1 requirement that the learning center be an allowed use, the learning center
use will specifically exclude a future daycare use, with respect to the second
request under S -P-1 that the building setback on the southern boundary side yard
will be approximately 8', noting for this motion the applicant's willingness prior to
going to Council to moving the building footprint two to three feet to the north to
increase the setback between the two lots, the Driveway Ordinance variance is
granted with the stipulation that the applicant will recalculate the stacking depth
after removing the northwest parking space which faces Southlake Blvd. and
removing the northernmost parking space right in front of the building, granting
the variance requests to the Driveway Ordinance and Tree Preservation
Ordinance, the motion is conditioned on the covered parking that is requested in
the S -P-1 zoning will not be built until Phase II is developed and the covered
parking as set forth will be the same materials as the building and roofing
materials and specifically noting that the support elements will be stone going up
and not metal.

Mr. Bliss explained the reasons for the one story layout.

Curtis Young, Sage Group, 1130 N Carroll Avenue came forward. Mr. Young gave a
separate presentation.
Commissioner Kubiak asked about the bay doors and building layout, specifically for
future use.
Mr. Young stated that the building has articulations and will not be a box building with a
flat roof and designed for storage use only.

Chairman Hudson opened the public hearing.
Patricia Jones, 930 Deer Hollow Blvd., Southlake came forward. Ms. Jones is worried
about the view from her backyard, flooding and drainage, noise pollution from the
trucks, lighting and overall property value.
Chairman Hudson closed the public hearing.
Mr. Young addressed all issued brought up by Ms. Jones and stated that he would be
happy to meet with her.
Commissioner Kubiak asked about the hours of use.
Mr. Young stated that the use is by private individuals, so the time periods will be
varied.
Commissioner Kubiak asked Mr. Young to possibly in good faith to put a time period in
place.
Ben Mogule 8908 Kirk Lane, Steve Belaria, 800 W Airport Frwy. Both came forward to
address additional issues, specifically the drainage. All lighting will be between the
buildings and not facing the residential.
Commissioner Parrish reviewed the uses under 1-1 Zoning.
Motion to approve ZA15-013, subject to Site Plan Review Summary No. 2, dated
April 2, 2015 and the staff report dated April 2, 2015, specifically granting the
variance with respect to building articulation as requested noting for the record
that the applicant has agreed to meet with Ms. Jones and any other neighbors
that abut this particular project to discuss items such as evergreen landscaping
on the property line, lighting and any drainage issues and note that it will take
place prior to going to City Council on April 21St.
