Southlake Blvd. EXECUTIVE SUMMARY: Norneel, LLC is requesting approval of a Zoning Change and Site Plan from "S- P-1" Detailed Site Plan District with "0-1" Office District Uses to "S-P-1" Detailed Site Plan District with "0-1" Office District Uses for the purpose of revising the building elevations on two buildings and adding additional parking on approximately 1.96 acres located at 751 E. Southlake Boulevard. SPIN Neighborhood # 9 DETAILS: Norneel, LLC is requesting approval of a Zoning Change and Site Plan from "S- P-1" Detailed Site Plan District with "0-1" Office District Uses to "S-P-1" Detailed Site Plan District with "0-1" Office District Uses for the purpose of revising the building elevations on the existing two buildings on the property from a brick fagade to a combination of the existing brick, stucco and stone veneer fagade and adding a total of 17 parking spaces to the 55 approved parking spaces for the site. At the Planning & Zoning Commission meeting held on February 5, 2015, the applicant proposed to revise their elevations from brick to completely stucco. The Planning & Zoning Commission in their motion requested that the applicant look into revising their elevations to incorporate more of the existing brick on the buildings and to include some of the architectural materials/elements of the adjacent development to the east (Zelda Offices). Since then, the applicant has incorporated the existing brick, added stone and stucco to their elevations. The previously proposed elevations and the currently proposed elevations can be found under Attachment `C' of this report. At the City Council meeting held on March 17, 2015 the City Council approved the applicants request with the condition that the applicant would revise their site plan to show the approximate location of the anticipated Zena Rucker Road right-of-way dedication and that the additional impervious coverage calculation for that right-of-way dedication not be included as a part of this site plan being presented. The applicant has provided an updated site plan to reflect that future dedication and has been provided to the City Council. The current zoning on the property was approved by City Council on May 5, 1998 (Planning Case ZA98-006) for "S-P-1" Detailed Site Plan District with "0- 1" Office District Uses from the previous "AG" Agricultural District zoning. The site was developed with two office buildings, a one (1) story office building on the north side of the lot near E. Knight No. 899 Addition LAND USE CATEGORY: Retail Commercial CURRENT ZONING: "S-P-1" Detailed Site Plan District with "0-1" Office District Uses REQUESTED ZONING: "S-P-1" Detailed Site Plan District with "0-1" Office District Uses HISTORY: - On May 5, 1998 the City Council approved a Zoning Change and Site Plan from "AG" Agricultural District to "S-P-1" Detailed Site Plan District with "0-1" Office District Uses under Planning Case ZA98-006. On November 20, 1998 a Plat Showing was filed with Tarrant County under Planning Case ZA98-007 reflecting the improvements and approvals of the site plan for the property. CITIZEN INPUT: A SPIN meeting was held on January 13, 2015 for the applicant's proposal. A copy of the report for this meeting can be found under Attachment `C' of this staff report. SOUTHLAKE 2030: Case No. ZA14-149 Consolidated Future Land Use Plan The Southlake 2030 Future Land Use Plan designates this property as Retail Commercial in the north where the current development exists and Office Commercial to the south near the future Zena Rucker Road. The Retail Commercial land use designation is defined within Southlake 2030 as the following: "The Retail Commercial category is a lower- to medium -intensity commercial category providing for neighborhood -type retail shopping facilities and general commercial support activities. It is intended to provide limited local retail and/or office uses which serve neighborhoods in close proximity. It is intended that all uses in this category will be compatible with adjacent single family uses, thereby maintaining the character and integrity of existing neighborhoods. This category is intended to encourage comprehensively planned developments. In areas where the Retail Commercial designation is adjacent to residentially zoned properties or areas with a residential designation on Attachment A Page 1 the Land Use Plan, lower intensity activities such as office or office - related uses should be planned adjacent to the residential uses. Other suitable activities are those permitted in the Public Parks/Open Space, Public/Semi-Public, and Office Commercial categories previously discussed. " The Office Commercial land use designation is defined within Southlake 2030 as the following: "The Office Commercial category is a commercial category designed and intended for the exclusive use of office and limited office -related activities. It is established for and will be allocated to those districts best suited for supporting commercial activity of an office character. It has been established to encourage and permit general professional and business offices of high quality and appearance, in attractive landscaped surroundings with the types of uses and design exterior appearance so controlled as to be generally compatible with existing and future adjacent and surrounding residential development. Properties with this designation may serve as a transition between established residential neighborhoods, major roadways, and retail development. Other suitable activities are those permitted in the Public Parks/Open Space and Public/Semi-Public categories previously discussed." Carroll/1709 Small Area Plan The subject property is located within the Carroll/1709 Small Area Plan study area that was adopted on September 20, 2011, however; there are no recommendations from that plan that affect this proposal. At the time when the southern end of the property develops consideration will need to be taken for recommendations within the Carroll/1709 Small Area Plan which are as follows: Consider the creation of a new 60' RO W 2-lane divided collector (C2D) with medians and left- turn/stacking lanes at intersections in the Mobility Plan to apply to Zena Rucker Road. • "Urban" cross section which includes curb, gutters, medians, street trees and sidewalks. • Speed limit not to exceed 30 m.p.h. • Design as a local slow movement roadway. Case No. Attachment A ZA14-149 Page 2 Mobility Master Plan On the City's Thoroughfare Plan within the Mobility Master Plan E. Southlake Boulevard is shown to be a 130-foot to 140-foot, 6-lane divided arterial (A61D) and is built as such today. TRANSPORTATION ■y 0 ASSESSMENT: Area Road Network and Conditions The existing development currently has access through a drive on E. Southlake Boulevard and does not contain a median opening for access to the west. * Based on the 2013 City of Sonthlake Traffic Count Report TREE PRESERVATION: There is approximately 21 % tree coverage on this site. The applicant has indicated that they will preserve 66% of that existing tree cover on site. The "S-P-1" zoning district does not require the applicant to preserve any minimum amount of trees but rather makes their tree preservation plan subject to City Council's approval. PLANNING & ZONING COMMISSION: February 5, 2015; Approved (4-1) subject to Site Plan Review Summary No. 2, dated January 30, 2015 and Staff Report dated January 30, 2015 and noting the applicant's willingness prior to going to Council to come back with additional proposed renderings that will incorporate brick and/or stone accents into the buildings and blending in with the buildings that were approved earlier this evening east of the property. The current SP 1 indicates the building facade as existing style, and all brick masonry with accent stone q uoining. Identify the top and toe of the creek bank and any floodplain boundary. 3. Discharge of post development runoff must have no adverse impact on downstream properties and meet the provisions of Ordinance No. 605. A right of way permit shall be obtained from the Public Works Operations Department (817) 748-8082 to connect to the City's sewer, water or storm sewer system. A Developer Agreement may be required for this development and may need to be approved by the City Council prior to any construction of public infrastructure. Construction plans for these improvements must be acceptable to Public Works prior to placing the Developer's Agreement on the City Council agenda for consideration. Any hazardous waste being discharged must be pretreated per Ordinance No. 836. Since the building is equipped with an automatic fire protection system, proper sprinkler system coverage must be provided throughout the building to meet the requirements of NFPA Case No. Attachment D ZA14-149 Page 2 13. If more than 20 sprinkler heads are added or relocated, submit plans to Reed Fire Protection, 14135 Midway Road Suite G260, Addison, Texas 75001, for review and approval. An exterior audible/visual fire alarm device must be installed above the Fire Department Connection to indicate when a fire alarm condition is present in the building, or located as near as possible to the FDC, on the building, if the FDC is installed remotely. 3. Fire apparatus access needs to be an all-weather surface, asphalt or concrete, 24 feet wide and able to support the imposed loads of fire apparatus. (A minimum of 80,000 pounds GVW) 4. Portable fire extinguishers are to be a minimum 5 pound, ABC Multipurpose, in sufficient quantities to meet the 75-foot travel distance rule. 5. HVAC units over 2000 cubic feet per minute shall have a duct smoke detector mounted on the return side of the unit, that when activated, shall send an alarm condition to the building fire alarm panel and shut the unit down. If the units are located above ceiling tile, remote reset switches must be installed below the duct detector location. 6. All sprinkled buildings are required to be equipped with a fire alarm in compliance with NFPA 72, the 2012 International Fire Code, and the City of Southlake amendments that pertain to the appropriate occupancy classification. 7. Install emergency egress lighting with battery back-up when the area served is required to have at least two exits. 8. Provide illuminated exit lighting with battery back-up above all required exit doors and pathways as required to easily locate exits. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said tract or tracts of land described herein.
