Item 6C13 CITY OF SOUTHLAKE Department of Planning & Development Services STAFF REPORT February 25, 2015 CASE NO: ZA15-008 PROJECT: Specific Use Permit for Country in the Square Mass Gathering Event EXECUTIVE SUMMARY: The City of Southlake Community Services Department is requesting approval of a specific use permit to allow for a mass gathering event named Country in the Square in celebration of the Academy of Country Music Awards being held in Arlington, Texas. The mass gathering event is proposed to be held in Southlake Town Square at 1400 Main Street, 1400 Fountain Place and 1400 E. Southlake Boulevard, Southlake, Texas. SPIN Neighborhood # 8. DETAILS: The City of Southlake Community Services Department is requesting approval of a specific use permit to allow for a mass gathering event named Country in the Square in celebration of the Academy of Country Music Awards being held in Arlington, Texas the same weekend. The following is an overview of the applicant's request: • Event scheduled on Saturday, April 18, 2015 (3:00 PM to 11:00 PM) • One-time event • Live Country Music on a stage setup in front of Town Hall • Four (4) anticipated country music bands • Sale of alcohol & food concessions • Set-up to be done the day before, street closures will begin at midnight • On -site security and paramedics • Local radio station 95.9 The Ranch • Anticipated attendance of 5,000 people • Directional and Information Signage The applicant indicated at the Planning & Zoning Commission meeting on February 19, 2015 that internal signage will be provided in Town Square and promotional signs will be placed throughout the City utilizing the permanent City event signs at key intersections. The Planning & Zoning Commission also recommended placing the "Parking Signs" used during Home for the Holidays throughout Town Square but was not made part of their approval motion. Southlake Blvd. LEGAL DESCRIPTION: Blocks 6, 7 and 8, Phase I, Southlake Town Square LAND USE CATEGORY: Town Center CURRENT ZONING: "D7 Downtown District HISTORY: This is a first, one time event being held so there is no historical information on this event in Southlake Town Square. However, other mass gatherings are held in Town Square. PLANNING & ZONING COMMISSION: February 19, 2015; Approved (4-0) a mass gathering event for April 18, 2015 subject to staff report dated February 13, 2015. STAFF COMMENTS: The Planning & Zoning Commission and City Council shall consider the following in determining whether to grant a Specific Use Permit for a mass gathering event according to the Comprehensive Zoning Ordinance No. 480, Section 45.14c, as amended: 1. Whether there is convenient and safe access for the ingress and egress of pedestrians and vehicular traffic; 2. Whether sufficient traffic control personnel is proposed to insure safety to all members of the traveling public, including pedestrians, along all public roadways in the proximity of the mass gathering and/or along which the public is likely to travel to reach the mass gathering areas shall be provided; 3. Whether the mass gathering area is well drained and so arranged to provide sufficient space for persons assembled, vehicles, sanitary facilities, and appurtenant equipment; 4. Whether sufficient illumination will be provided at night to protect the safety of the persons assembled; 5. Whether adequate parking areas, including disabled persons' parking spaces, shall be provided for persons arriving by vehicular means. If the promoter proposes to utilize temporary off -site parking, then the promoter the mass gathering event the off -site temporary parking area will not be utilized for purposes other than the mass gathering event; and 6. Whether adequate provisions have been made for food supply, medical assistance, garbage disposal, water supply, parking, sanitation and toilet facilities, vermin control, and safety. The applicant is required to obtain all necessary permits regarding qualifying tents and signage. Due to the limited scope of the event no staff review summary has been provided for this proposal. In celebration of the Academy of Country Music Awards coming to Arlington that same weekend, we are hoping to provide our community with good music, fun and entertainment. Please find the attached information for our SUP for the event. Event Information This event will host 4 local and regional country music bands from 3:00 p.m. —11:00 p.m. on Saturday, April 18th. Set up will begin in the afternoon on Friday, April 17. We will utilize Family Park, Rustin Pavilion, State Street and Grande Street (South of Town Hall). Admission is free to this event but food and beverage will be at a cost. Alcohol will also be for sale at this event. Components of the Event Entertainment—T he stage will be positioned in the street front of Town Hall facing the park. Four country music bands will play throughout the event. Alcohol- Due to alcohol sales, the park will be completely fenced off for security reasons. The bar will be located in Rustin Pavilion and beer/wine booths will be located on Grande and State Street. Alcohol will be sold by a contracted vendor responsible for permitting and licenses. Concessions- Local restaurants will solicit specialties on Grande and State Street. Anticipated Attendance- 5,000 people are expected at this event and we do not foresee any parking issues due to past events. SOUTHLAKE BOULEVARD BEING LEGALLY DESCRIBED AS BLOCKS 6, 7 AND 8, AND ADJACENT RIGHT-OF- WAY, SOUTHLAKE TOWN SQUARE, PHASE I, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a mass gathering event for Country in the Square has been requested by a person or corporation having a proprietary interest in the properties zoned as "D7 Downtown District; and, WHEREAS, in accordance with the requirements of Sections 45.1 (36) & 45.14 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a mass gathering event for Country in the Square on property located at 1400 Main Street, 1400 Fountain Place and 1400 E. Southlake Boulevard being legally described as Blocks 6, 7 and 8, and adjacent right-of-way, Southlake Town Square, Phase I, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet `A', Slide 4892, Plat Record, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. This resolution shall become effective on the date of approval by the City Council.
