CITY OF SOUTHLAKE, TEXAS ORDINANCE NO. 480 -680 AN ORDINANCE AMENDING ORDINANCE NO. 480, AS AMENDED, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS; GRANTING A ZONING CHANGE ON A CERTAIN TRACT OR TRACTS OF LAND WITHIN THE CITY OF SOUTHLAKE, TEXAS BEING DESCRIBED AS TRACTS 2E1 AND 2E2 OF THE JOHN N. SURVEY, ABSTRACT NO. 591, CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, BEING APPROXIMATELY 2.4 ACRES AND MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A" FROM "S -P -1" DETAILED SITE PLAN DISTRICT TO "S -P -1" DETAILED SITE PLAN DISTRICT WITH "I -1" LIGHT INDUSTRIAL DISTRICT USES AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B ", SUBJECT TO THE SPECIFIC REQUIREMENTS CONTAINED IN THIS ORDINANCE; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND THE ZONING CHANGES AND AMENDMENTS HEREIN MADE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Texas Local Government Code; and, WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the authority to adopt a comprehensive zoning ordinance and map regulating the location and use of buildings, other structures and land for business, industrial, residential and other purposes, and to amend said ordinance and map for the purpose of promoting the public health, safety, morals and general welfare, all in accordance with a comprehensive plan; and, WHEREAS, the hereinafter described property is currently zoned "S -P -1" Detailed Site Plan District under the City's Comprehensive Zoning Ordinance; and, WHEREAS, a change in the zoning classification of said property was requested by a person or corporation having a proprietary interest in said property; and, WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether these changes should be granted or denied: safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the sites; safety from fire hazards and damages; noise producing elements and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood; location, lighting and types of signs and relation of signs to traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of parking as determined by requirements of this ordinance for off - street parking facilities; location of ingress and egress points for parking and off - street loading spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; effect on the over- crowding of the land; effect on the concentration of population, and effect on transportation, water, sewerage, schools, parks and other public facilities; and, WHEREAS, the City Council of the City of Southlake, Texas, further considered among other things the character of the districts and their peculiar suitability for particular uses and the view to conserve the value of the buildings, and encourage the most appropriate use of the land throughout this City; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a public necessity for the zoning changes, that the public demands them, that the public interest clearly requires the amendments, and that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other dangers, promotes the health and the general welfare, provides adequate light and air, prevents the over - crowding of land, avoids undue concentration of population, and facilitates the adequate provision of transportation, water, sewerage, schools, parks and other public requirements; and, WHEREAS, the City Council of the City of Southlake, Texas, has determined that there is a necessity and need for the changes in zoning and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the tract or tracts of land requested for a change since the tract or tracts of land were originally classified and therefore feels that the respective changes in zoning classification for the tract or tracts of land are needed, are called for, and are in the best interest of the public at large, the citizens of the city of Southlake, Texas, and helps promote the general health, safety and welfare of the community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake, Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is hereby amended so that the permitted uses in the hereinafter described areas be altered, changed and amended as shown and described below: Being described as, Tracts 2E1 and 2E2 of the John N. Gibson Survey, Abstract No. 591, City of Southlake, Tarrant County, Texas, located at 1363 Brumlow Avenue, Southlake, Texas. Current Zoning: "S -P -1" Detailed Site Plan District. Requested Zoning: "S -P -1" Detailed Site Plan District with "I -1" Light Industrial District uses as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit "B," and subject to the following: Noting the applicant's willingness for: 1. Each building to be designed with one (1) garage and that each building will contain no more that 75% of office space: 2. The general office uses, only to include laboratory and medical uses that do not have patients, and agrees to take out banks as uses; 3. Limiting the I -1 uses to light assembly warehouse uses only; 4. For the dumpsters to be masonry to match building materials; 5. To give up 4 parking spaces fronting Brumlow Avenue and add two (2) landscape islands 6. To add additional landscaping along Brumlow Avenue and to include a berm; 7. The south fence to be brick masonry with a base under the fence; City Council to grant: 1. The variance for a 4:12 roof pitch for all buildings; 2 The variances to the lotting requirement, driveway stacking depth, and driveway spacing; Including the Staff Report dated January 26, 2015 and the Site Plan Review Summary No. 6, dated January 26, 2015. SECTION 2. That the City Manager is hereby directed to correct the Official Zoning map of the City of Southlake, Texas, to reflect the herein changes in zoning. SECTION 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said Zoning Ordinance and all other applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections, subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not amended hereby, but remain intact and are hereby ratified, verified, and affirmed. SECTION 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and the general welfare of the community. They have been designed, with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to provide adequate light and air; to prevent over - crowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewerage, drainage and surface water, parks and other commercial needs and development of the community. They have been made after a full and complete hearing with reasonable consideration among other things of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 5. That this ordinance shall be cumulative of all other ordinances of the City of Southlake, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said tract or tracts of land described herein. SECTION 7. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 9. The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least fifteen (15) days before the second reading of this ordinance, and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of its provisions, then the City Secretary shall additionally publish this ordinance in the official City newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13 of the Charter of the City of Southlake. SECTION 10. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained. EXHIBIT "B" Narrative W ilso n INCOME PROPERTIES February 3, 2015 City Council City of Southlake 1400 Main Street Southlake, TX 76092 Re: Site Plan and Plat Submittals 1363 Brumlow Ave. Southlake Please accept the enclosed applications for the above reference property. PURPOSE OF THE APPLICATION: Wilson Texas Four LLC, a Texas LLC, is the owner of the property located at 1363 Brumlow Avenue (Property) and is seeking a revision to the existing development approvals for the property. Wilson Texas Four is requesting approval for a Site Plan and a Preliminary Plat for the proposed Bailey Business Park and the development of seven lots for construction of office / flex buildings on approximately 2.4 gross acres. The buildings will be constructed on separate legal lots to allow individuals and businesses to purchase their own facilities providing a pride of ownership opportunity. EXISTING IMPROVEMENTS: The property is currently unimproved except for an existing water well that is currently not active. EXISTING APPROVALS: Wilson Texas Four LLC recently purchased the Property from The Diles Family Trust. In 2002, The Diles Family Trust received approvals from the City of Southlake (Existing Approvals) to construct a 20,346 SF along with a future separate building of 5,500 SF. The total currently approved building area on the Property is 25,864 SF. As planned and approved, the large building was zoned for office use with a specific approved use for a gymnastics studio and the smaller building was approved for office use. PROPOSED REVISED APPROVALS: PLAT: Wilson Texas Four proposes to develop the property with a total of seven (7) buildings consisting of a total of approximately 25,823 SF of total building area located on seven (7) separate lots. ZONING AMENDMENT: Amend the zoning for the lots to provide for occupancies based on the I -1 zoning code with a maximum of 75% of each building being available for office use. SITE PLAN MODIFICATIONS FROM THE 1/6/2015 CITY COUNCIL MEETING: Trash Enclosure Encroachment into Buffer Yard The trash enclosures have been removed from the Buffer Yards. Relocation of Parking Stalls to Increase Size of Internal Landscape Islands As a result of the maximum 75% office requirement, the required parking for the project has decreased. This has allowed us to increase the size of the landscape islands in front of Buildings 1,2,3 & 6 by deleting four parking stalls. We have also maintained the additional landscaping areas on Brumlow. The total landscape area is now 29,197 SF or 29.36% of the property. The impervious coverage is now only 70.64% Revised Tree Conservation Plan The Tree Conservation Plan has been revised to save the existing tree behind building 7 that was to be removed. The revised plan shows a total of 45 caliper inches of trees to be removed. See Paragraph 12 of Development Regulations below for further details concerning Tree Mitigation. Southlake City Council 2/3/2015 3 DEVELOPMENT REGULATIONS: 1. There are a total of 84 parking stalls available on the property, which equals 1 space per 307 SF of building area. This is complies with the 1 -1 zoning requirement of 1 space per 300 SF of office and 1 space per 1,000 SF of industrial space. 2. Since the parking requirements have been calculated for the overall Property, a reciprocal parking and access agreement will be recorded with the Plat along with a shared dumpster agreement. 3. To facilitate the "park" environment of the development, setbacks and buffer yards will not be required along internal boundaries of the lots. The setbacks and buffer yards shall be determined based on the exterior boundaries based on the overall property, specifically, 40' on the western frontage on Brumlow (front yard), 15' on the north and south (side yards) and 10' on the east (rear yard). 4. The Property shall comply with Section 43.13 of the Development Code (OVERLAY ZONES) with respect to the western boundary of the Property since there is residential property currently existing across Brumlow Avenue to the west. Building setbacks are to be approved as shown on the Site Plan. 5. The specific size and number of a building(s) or lot(s) may increase or decrease provided that the total square footage to be developed on the Property does not exceed 25,823 sf. For example, if a user for, say, building 7 requires an additional 500 SF, that building may be expanded by 500 SF and building 6 may be decreased by 500 SF and the lot line between the lots may be adjusted accordingly. Or, if a user would like to combine buildings 2 and 3 into one building, the buildings may be merged and the lots combined. Any such changes shall be approved by they City of Southlake Staff and the resulting buildings shall comply with all ordinances existing at the time of this approval 6. The development is designed with the assistance of the property owner to the south (Mr. Joe Wright) to provide a common driveway access to both Bailey Business Park and Mr. Wright's property (for his future development). Concurrent with the recordation of the Plat a reciprocal access and maintenance agreement shall be recorded for this access 7. Per the Zoning Ordinance, Section 26.5F, the minimum area within a contiguous district boundary shall be a minimum of approximately 2.4 gross acres prior to any street dedications or easements. Southlake City Council 2/3/2015 4 8. The horizontal articulation for the south side of building 7 shall be increased from 3'4" as currently shown on the plans to 3'9 ", 9. Each Building shall have maximum office occupancy of 75% of the building area. 10. Each Building shall have at least one truck door and may have additional truck doors. 11. Paragraph 2 of Section 26.2 - Permitted Uses allowing Sexually - oriented Businesses shall be DELETED from the approved uses for Bailey Business Park. 12.The development of the property will require the removal of 45 caliper inches of existing trees on the Property. The note on the bottom of Sheet L -2 of the plans submitted should be revised from "(1) — 4" Mitigation Tree, 41" to Reforestation Fund" and shall be replaced with "Mitigation for the removal of these trees will be achieved by the addition of five (5) 4" caliper canopy trees planted on the property (total of 20 "). The remaining 25" of mitigation will be achieved by either increasing the caliper sizing of trees to be planted on the property and / or payment to the City of Southlake Reforestation Fund."
