Requested: Ordinance No. 1111, 2nd Reading, Approve an ordinance for no
parking on Commerce Street and Tuscan Ridge Circle
Background
Information: Concerns have been expressed that parking along the Commerce
Street adjacent to the 280 Sports Complex just south of FM 1709
(Southlake Blvd.) was potentially dangerous. This concern was
expressed by several Council members as well as the businesses
that are located in this immediate area. Many of the businesses
within the 280 sports complex involve parents and young children.
The fear was that the mix of industrial traffic and children stepping
out into the street from behind parked cars was a potential safety
issue. City staff and representatives of the area businesses agreed
to place no parking signs along the west side of Commerce Street.
These signs were placed for a trial period to determine if the
removal of the parking was sufficient to satisfy the concerns. The
signs have been in place for several months and all of the business
owners have been contacted and agree that they should be
permanent. Therefore, the parking restriction between FM 1709
and Market Loop is brought forward for Council's approval.
With respect to parking on Tuscan Ridge Circle, City staff received
nuisance parking complaints due to the narrow width of Tuscan
Ridge Circle in the Tuscan Ridge subdivision. The existing street is
24 feet wide and on -street parking restricts the access of
emergency vehicle during emergency. No parking signs currently
exist along the outward side of the entire street. The existing signs
will be replaced with new signs that are in compliance with the
Texas Manual on Uniform Traffic Control Devices (TxMUTCD) by
Public Works staff to make them permanent and enforceable, if
Ordinance 1111 is approved by the City Council.
Financial
Considerations: The costs associated with this parking restriction on both streets
will consist of the costs for manufacturing and installing of the signs
along the two roadways.
Strategic Link: The adoption of the Parking restriction ordinance on Commerce
Street and Tuscan Ridge Circle links to the City's strategy map
relative to the strategic focus area of Safety and Security from the
perspective of managing the business by achieving the highest
standards of safety and security.

ORDINANCE NO. 1111
AN ORDINANCE AMENDING SECTION 18-184 "PARKING
RESTRICTIONS ON CERTAIN STREETS" OF THE SOUTHLAKE CODE
OF ORDINANCES; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS HEREOF;
PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN
THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Southlake is a home rule city acting under its charter
adopted by the electorate pursuant to Article XI, Section 5, of the Texas Constitution
and Chapter 9 of the Local Government Code; and
WHEREAS, the City has previously enacted ordinances, now codified in Section
18-184 of the Southlake Code of Ordinances, prohibiting parking on certain streets in
the City; and
WHEREAS, the Director of Public Works deems it advisable to establish a no
parking zone on:
1. the west side of Commerce Street from E. Southlake Blvd to Market Loop
and
2. the outward side of Tuscan Ridge Circle (odd number property
designations), as parking at that location creates unacceptable traffic
hazards; and
WHEREAS, the City Council has determined that it is in the best interest of the
citizens to enact this ordinance to prohibit parking on these portion of roadways.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS:
SECTION 1.
That Chapter 18, "Traffic and Vehicles", Section 18-184, "Parking Restrictions on
certain streets" of the Code of Ordinances is hereby amended to add a new subsections
(e) Commerce Street and (e) Tuscan Ridge Circle to read as follows:
Sec. 18-184 Parking Restrictions on certain streets.
(e) Commerce Street. It shall be unlawful to park, stand or stop any vehicle
along the west side of Commerce Street between E. Southlake Blvd and Market Loop.

The public works department of the city is hereby directed to place signs prohibiting the
stopping, standing or parking of vehicles along the west side of Commerce Street
between E. Southlake Blvd and Market Loop. Such signs shall be official signs, and no
person shall stop, stand or park any vehicle in violation of the restrictions stated on such
signs. The prohibition against parking in such area shall not be effective until the signs
are in place.
(f) Tuscan Ridge Circle. It shall be unlawful to park, stand or stop any vehicle
along the outward side (odd number property designations) of Tuscan Ridge Circle.
The public works department of the city is hereby directed to place signs prohibiting the
stopping, standing or parking of vehicles along the Tuscan Ridge Circle. Such signs
shall be official signs, and no person shall stop, stand or park any vehicle in violation of
the restrictions stated on such signs. The prohibition against parking in such area shall
not be effective until the signs are in place.
SECTION 2.
The Director of Public Works, or his designee, shall post and install appropriate
no parking signage along the designated portion of roadway.
SECTION 3.
This ordinance shall be cumulative of all provisions of ordinances and of the
Code of Ordinances of the City of Southlake, Texas, as amended, except where the
provisions of this ordinance are in direct conflict with the provisions of such ordinances
and such Code, in which event the conflicting provisions of such ordinances and such
Code are hereby repealed.
SECTION 4.
It is hereby declared to be the intention of the City Council that the phrases,
clauses, sentences, paragraphs and sections of this Ordinance are severable, and if
any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining, phrase, clauses,
sentences, paragraphs or sections of this Ordinance since the same would have been
enacted by the City Council without incorporation in this Ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 5.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses
to comply with or who resists the enforcement of any of the provisions of this Ordinance

shall be fined not more than Five Hundred Dollars ($500.00) for each offense. Each
day that a violation is permitted to exist shall constitute a separate offense.
SECTION 6.
All rights and remedies of the City of Southlake, Texas, are expressly saved as to
any and all violations involving parking regulations which have accrued at the time of
the effective date of this Ordinance; and, as to such accrued violations and all pending
litigation, both civil and criminal, whether pending in court or not, under such ordinances
same shall not be affected by this Ordinance but may be prosecuted until final
disposition by the courts.
SECTION 7.
The City Secretary of the City of Southlake is hereby directed to publish in the
official newspaper of the City of Southlake, the caption, penalty clause, and effective
date clause of this ordinance as authorized by the City Charter and Section 52.013 of
the Local Government Code.
SECTION 8.
This ordinance shall be in full force and effect from and after its passage and
publication as required by law, and it is so ordained.

RE: No parking on the exterior lane of Tuscan Ridge Circle
Dear Mayor Terrell and City Council,
Please accept this correspondence as a formal request to the City of Southlake on behalf
of the Board of Directors of the Tuscan Ridge Homeowners' Assn. to designate the exterior lane
of Tuscan Ridge Circle as a no parking zone. Tuscan Ridge Circle is very narrow and if parking
is allowed on both sides of the public street, a safety hazard exists as a moving vehicle has a very
difficult time traversing the road. If there was ever a fire, the fire engine would not be able to
maneuver through the parked cars at all. The developer previously installed "no parking" signs to
prevent this problem but we learned last year that the police cannot enforce the signs because there
is not an accompanying ordinance in place.
The board of directors of the Tuscan Ridge Homeowners' Assn voted unanimously to
support making "no parking" on the exterior lane of Tuscan Ridge Circle, a city- regulated offense
at its September 8, 2014 meeting'.

Disposition of Minutes— May 15, 2014— Minuteswill be approved at the November 10 meeting

Treasurer's Report —Wayne Fisk reviewed April, May, Jane and July Financial statements. Barbara
made a motion to accept the report and Fbger provided a second. The motion carried
unanimously.
Committee and Management Faports
Landscaping — Barbara reported some shrubs need replacing and all Fbse bushes need to
be replaced because they are diseased, Brickman will be sending out a newsletter shortly.
$200.00 gift card has been spent on Christmas decorations. The timing for the irrigation
system in the front will be checked to make sure we're in compliance with City watering
restrictions.
Architectural Control — Al reported no activity.
Community Calendar - the Board suggested a number of items to be induded. This will be
a working document for the Board to keep abreast of important dates and for the
community to know what's going on.

Locking Mailboxes- will deal with thisissue if or when conditionscall for it.
Fining Etructure — Action Without A Meeting — Michael read the unanimous email
approval by the Board for Covenant Enforcement and Fining Policy into the minutes. The
document is filed, distributed to all owners and is now in force. Jm made a motion to
affirm the Board's approval of the document and Barbara provided asecond. The motion
passed unanimously.
Parking— Exterior side of Tuscan Fudge Orde — AI made a motion to pursue with the Oty
of Shut hlake to make parking on the No Parking side of Tuscan Ridge O rde a city regulated
offense. Barbara provided a second and the motion passed unanimously.
New Business
Collection Policy - A Collection Policy was presented and reviewed by the Board. This
policy is a standard one with many HOA's. Wayne made a motion to approve the
Collection Policy as presented, seconded by Barb Nmps, unanimously approved. The
Collection Policy will be posted on our web -site and distributed to the community.
Elreet light/sign and mailbox base painting - Bases of mailboxes and street lights:
landscaper string trimmers have removed the paint making them unsightly. Michael will
find a contractor to get them painted. Board agreed that the cost should be minimal and
ask Michael to proceed.
Elop 9gn - Michael will also contact the city to ask for a stop sign on the north side of
Tuscan Fudge Orcle to replace the faded one in place.
Roar Yard Service — As a result of a number of issues, FYI Brickman will be terminating
back yard mowi ng/ services as of 12/ 31 / 14.
Brickman Service Schedule — A draft scope of work for 2015 was induded in the Board
packet.
Executive Session - The Board reviewed the Delinquency Summary Rbport and Architectural
Control Violation Rbport. Michael to verify that two accounts in collection are being moved
forward with the appropriate next steps.
