Item 6J13 CITY OF SOUTHLAKE Department of Planning & Development Services STAFF REPORT January 13, 2015 CASE NO: ZA14-151 PROJECT: Green Fest Southlake EXECUTIVE SUMMARY: On behalf of Bob Jones Nature Center, Audra Lewandowski is requesting approval of a specific use permit to allow a mass gathering on property being described as Blocks 7 and 8, and adjacent rights of way, Southlake Town Square, Phase I, an addition to the City of Southlake, Tarrant County, Texas and located at 1400 Fountain Place and 1400 East Southlake Blvd., Southlake, Texas. Current Zoning: "DT" Downtown District. SPIN Neighborhood # 8. DETAILS: This event has been successfully held annually since 2009. The applicant received specific use permit approval in January 2013 for a 5-year period, however, the change in scope, i.e., extended hours, expansion of the event boundary and new events have triggered the requirement for renewal. The following is an overview of the applicant's request; the items in red are new this year: • The event is planned to be held on Saturday, March 28, 2015 from 10 a.m. to 10 p.m. (the previous end time was 5 p.m.) (set up time 8 a.m.); • There will be up to forty-two (42) tents and/or exhibit booths set up in the Rustin Park area and Fountain Place; • Automobiles- They may have hybrid vehicles on display along Fountain Place for the day; • Bounce houses in place of the Title Sponsor tent areas (tentative); • Exhibitors will have the option to sell products; • Local musical talent; (new event) • Sale of beer and wine; (new event) • Kindergarten through 6t" grade juice pouch collection; • Expansion of event boundary to accommodate possible future increase of vendors/exhibitors and road closures: • Requesting approval of Specific Use Permit for up to five (5) years from current date of approval — to expire following the 2019 event, unless the scope of the event changes. The purpose of this event is to promote and provide information on "green" products and current trends in environmental stewardship. The applicant has included a sign proposal as part of this specific use permit which includes multiple (44) 24-inch by 24-inch signs at various locations throughout the City six (6) days prior to the event date for promotional purposes. Exhibits for the sign proposal are included in attachment `C' of this staff report. There are no changes to signage from previous approval. There have been approximately 1000 in attendance throughout the day for the event. February 17, 2009; City Council approved the application as presented for one year (ZA08-099). December 1, 2009; City Council approved the application as presented for one year subject to Green Fellows, Inc. obtaining 501C3 Non-profit status prior to the event (ZA09-043). November 16, 2010; City Council approved the application as presented for a three-year period (ZA10-061). January 21, 2013; City Council approved the application as presented for a five-year period (ZA13-129). P&Z ACTION: January 8, 2015; Approved (5-0) subject to the staff report dated January 2, 2015 and including flexibility for expansion of the sponsor and food vendor tent area around Rustin Park along with directing the applicant to coordinate with city staff regarding closing the entrances along FM 1709 onto Grand Avenue and State Street during the day of the event; and, granting the 5-year approval period. STAFF COMMENTS: The City Council shall consider the following in determining whether to grant a Specific Use Permit for a mass gathering event according to the Comprehensive Zoning Ordinance No. 480, Section 45.14c, as amended: 1. whether there is convenient and safe access for the ingress and egress of pedestrians and vehicular traffic; 2. whether sufficient traffic control personnel is proposed to insure safety to all members of the traveling public, including pedestrians, along all public roadways in the proximity of the mass gathering and/or along which the public is likely to travel to reach the mass gathering areas shall be provided; 3. whether the mass gathering area is well drained and so arranged to provide sufficient space for persons assembled, vehicles, sanitary Case No. Attachment A ZA14-151 Page 1 facilities, and appurtenant equipment; 4. whether sufficient illumination will be provided at night to protect the safety of the persons assembled; 5. whether adequate parking areas, including disabled persons' parking spaces, shall be provided for persons arriving by vehicular means. If the promoter proposes to utilize temporary off -site parking, then the promoter the mass gathering event the off -site temporary parking area will not be utilized for purposes other than the mass gathering event; and 6. whether adequate provisions have been made for food supply, medical assistance, garbage disposal, water supply, parking, sanitation and toilet facilities, vermin control, and safety. The City Council may establish specific conditions depending upon the nature of the proposed event and traffic, health and safety issues according to Ordinance 480, Section 45.14.a, as amended. The applicant is required to obtain all necessary permits regarding qualifying tents and signage. Signage is not allowed to be placed within the public right of way. Due to the limited scope of the event no staff review summary has been provided for this proposal. This will be out seventh year and we are adding a few new elements. For one we are extending the hours to 10pm. We hope to have some local musical talent on the pavilion throughout the day. Additionally, we are looking into and planning for the sale of beer and wine. As with previous years, exhibitors will be set up in tents throughout the park to talk about their eco-friendly green products and services. Plus we will continue the K thru 6 juice pouch collection —always a hit! A Specific Use Permit is hereby granted for a mass gathering event for Southlake Green Fest Event on property located at 1400 Fountain Place and 1400 E Southlake Boulevard being legally described as Blocks 7 And 8, and adjacent right-of-way, Southlake Town Square, Phase I, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet `A', Slide 4892, Plat Record, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein.
