PROJECT: Plat Extension for Shady Oaks, Phases 213 and 2E Final Plat
EXECUTIVE
SUMMARY: DeOtte Engineering, Inc. is requesting approval of a Variance to Subdivision
Ordinance No. 483, Section 4.01(1), as amended, regarding plat expiration, requesting
to extend the validity of case ZA13-133, Final Plat for Shady Oaks, Phases 2d and 2E,
on property described as Tracts 11 D and 11 D1, Thomas M. Hood Survey, Abstract No.
706, Southlake, Tarrant County, Texas, and located at 800 and 820 Shady Oaks
Dr. Current Zoning: R-PUD — Residential Planned Unit Development District. SPIN
Neighborhood # 6.
REQUEST: DeOtte Engineering, Inc. is requesting approval of a variance to the Subdivision
Ordinance No. 483, Section 4.01(1) (Plat Expiration), as amended, and is requesting
that the validity of Case No. ZA13-133, Final Plat for Shady Oaks, Phases 2d and 2E,
be extended for an additional six months from the date of City Council's action on the
extension request.
Section 4.01(1) states that a Final Plat which has not been recorded in the County Plat
Records within one year of the date of approval shall expire. The Final Plat was
approved by the Planning & Zoning Commission on January 9, 2014. Final plats for
subdivisions requiring the installation of streets and utilities are typically not recorded
until these improvements have been installed and are ready to be accepted by the City.
This ensures that street right-of-ways and easements are correctly shown based on
as -built conditions and also ensures that all the new lots of record are properly served
by streets and utilities. The final plat for this development has not been recorded due
to continuing construction of the development and has thus expired.
The applicant is requesting an extension of six months from date of plat extension
approval. If approved, the new expiration date for the Final Plat for Shady Oaks,
Phases 2D and 2E would be July 20, 2015.

HISTORY: -A change of zoning from "AG" to "SF-20A" was approved by City Council on
September 18, 2007 (ZA07-085).
-A preliminary Plat for Shady Oaks Addition was also approved by City Council
on September 18, 2007 (ZA07-086).
-A final Plat for Shady Oaks, Phase 1 A, was approved by P&Z on December 6,
2007 (ZA07-147).
-A preliminary plat for Shady Oaks Phase 1 B and Phase 2 was approved by
City Council on April 20, 2010 (ZA09-076).
-A final plat for Shady Oaks Phases 2D and 2E was approved by the Planning
and Zoning Commission on January 9, 2014 (ZA13-133).
STAFF COMMENTS: Because of the limited nature of this request, no review comments were
prepared for this item.

Dear Mr. Baker,
On behalf of the owner of Shady Oaks Phase 2D & 2E, I respectfully request
Variance to the Subdivision Ordinance No. 483, Section 4.01 (1) (Plat Expiration),
as amended, and request that the validity of Case No. ZA13-133, Final Plat for
Shady Oaks Phase 2D & 2E, be extended for an additional 6 months from the
date of City Council's action on the extension request.
The project is substantially complete with construction and the Final Plat for this
project should be filed very soon pending minor field work and administrative
items.
