PROJECT: Plat Extension for Winding Creek, Phase II Final Plat
EXECUTIVE
SUMMARY: DeOtte Engineering, Inc. is requesting approval of a Variance to Subdivision
Ordinance No. 483, Section 4.01(1), as amended, regarding plat expiration, requesting
to extend the validity of case ZA13-132, Final Plat for Winding Creek, Phase 11
on property described as Tracts 4D1, 4D3, 4E, 4E1, 4G1, Obediah W. Knight Survey,
Abstract No. 899, City of Southlake, Tarrant County, Texas and located at 420, 440,
450, 480 and 500 S. Carroll Ave., Southlake, Texas. Current Zoning: R-PUD —
Residential Planned Unit Development District. SPIN Neighborhood # 9.
REQUEST: DeOtte Engineering, Inc. is requesting approval of a variance to the Subdivision
Ordinance No. 483, Section 4.01(1) (Plat Expiration), as amended, and is requesting
that the validity of Case No. ZA13-132, Final Plat for Winding Creek, Phase 11, be
extended for an additional six months from the date of City Council's action on the
extension request.
Section 4.01(1) states that a Final Plat which has not been recorded in the County Plat
Records within one year of the date of approval shall expire. The Final Plat was
approved by the Planning & Zoning Commission on January 9, 2014. Final plats for
subdivisions requiring the installation of streets and utilities are typically not recorded
until these improvements have been installed and are ready to be accepted by the City.
This ensures that street right-of-ways and easements are correctly shown based on
as -built conditions and also ensures that all the new lots of record are properly served
by streets and utilities. The final plat for this development has not been recorded due
to continuing construction of the development and has thus expired.
The applicant is requesting an extension of six months from date of plat extension
approval. If approved, the new expiration date for the Final Plat for Winding Creek,
Phase II would be July 20, 2015.

- A preliminary plat for Winding Creek (ZA11-062) was approved by City
Council on February 7, 2012.
- A final plat for Winding Creek Phase II (ZA13-132) was approved by the
Planning and Zoning Commission on January 9, 2014.
SPIN MEETING: A SPIN meeting for Winding Creek was held on October 17, 2012

RE: Winding Creek Phase II Variance Request
Dear Mr. Baker,
On behalf of the owner of Winding Creek Phase 11, 1 respectfully request
Variance to the Subdivision Ordinance No. 483, Section 4.01 (1) (Plat Expiration),
as amended, and request that the validity of Case No. ZA13-132, Final Plat for
Winding Creek Phase II, be extended for an additional 6 months from the date of
City Council's action on the extension request.
The project is substantially complete with construction and the Final Plat for this
project should be filed very soon pending minor field work and administrative
items.
