2014-11-13 CITY OF SOUTH LAKE TEXAS ZONING BOARD OF ADJUSTMENT MEETING: November 13, 2014 LOCATION: 1400 Main Street, Southlake, Texas City Council Chambers of Town Hall Regular Session: Members Present: Chair John Huffman, Vice- Chair Brad Cunningham, Board members Mike Smietana, Eric Ransom, Ron Evans, and Kourosh Panahy. Members Absent: Board member Scott Dyche. Staff Present: Richard Schell, Principal Planner and Erica Wilson, Board Secretary Agenda Item No. 1 — Call to Order: Chair John Huffman called the meeting to order at 6:30 p.m. Agenda Item No. 2 — Approval of the Minutes: Chair John Huffman opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on October 16, 2014. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on October 16, 2014. Motion: Panahy Second: Cunningham Ayes: Evans, Cunningham, Smietana, Panahy, Ransom and Huffman Nays: None Abstain: None Vote: 6 -0 -0 Motion: Carried Agenda Item No. 3 — Administrative Comments: Richard Schell, Principal Planner, announced that the next ZBA meeting will be held on December 11, 2014. No. 480, Section 44.12(1) for a servants or family quarters on property described as Lot 14, Block 1, Dove Acres, an addition to the City of Southlake, Tarrant County, Texas and located at 1627 Mockingbird Ln., Southlake, Texas. Planner Schell presented details of the case, requesting approval of a Special Exception Use per Ord.No. 480, Section 44.12(1) for a servants or family quarters on property described as Lot 14, Block 1, Dove Acres, an addition to the City of Southlake, Tarrant County,Texas andlocated at 1627 Mockingbird Ln., Southlake, Texas. Chair Huffman asked if there were those in the audience who wished to speak in support of the request. There being no one, Chair Huffman asked if there were those in the audience who wished to speak in opposition of the request. There being no one, Chair Huffman closed the public hearing and opened the item for discussion. After discussion from the board, Chair Huffman stated that he was prepared to entertain a motion on the item. A motion was made to approve case ZBA -668. Motion: Panahy Second: Smietana Ayes: Evans, Cunningham, Smietana, Panahy, and Huffman Nays: None Abstain: None Vote: 5 -0 Motion: Carried Agenda Item No. 5- ZBA -669, Variance to Ordinance No. 480, Section 11.5(f), requiring a minimum lot area of 43,560 square feet and Variance to Ordinance No. 480, Section 11.5(i), requiring a maximum residential density of one dwelling unit per acre on property described as Tract 3A1 F5, Francis Throop Survey, Abstract No. 1511, City of Southlake, Tarrant County, Texas and located at 1860 Sunshine Ln., Southlake, Texas, The current zoning is SF -1A - Single Family Residential District. Planner Schell presented details of the case, requesting approval of a Variance to Ordinance No. 480, Section11.5(f), requiring a minimum lot area of 43,560 square feet and Variance to Ordinance No. 480, Section 11.5(i), requiring a maximum residential density of one dwelling unit per acre to allow a lot size of approximately 0.68 acres and an overall residential density of 1.368 dwelling units per acre. The overall density calculation is based on the seven existing tracts bounded by Dove Rd. on the east, Shumaker Ln. on the west and Sunshine Ln. on the south. Chair Huffman opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. No. 480, Section 44.12(2) for an accessory structure of a size or aggregate size greater than the size permitted on property described as Lot 34, Block 2, Lonesome Dove Estates, Phase II, an addition to the City of Southlake, Tarrant County, Texas and located at 1403 McCrae Trail., Southlake, Texas. Current Zoning: "R -PUD" — Residential Planned Unit Development District. . Planner Schell presented details of the case, requesting approval of a Special Exception Use per Ord. No. 480, Section 44.12(2) for an accessory structure of a size or aggregate size greater than the size permitted to allow construction of an approximately 768 square foot outdoor kitchen and cabana. The maximum square footage allowed in the zoning district is 600 square feet. The property owner previously requested the same variances to the front and side setbacks as in this request and those variances were approved (5 -0) at the June 27, 2013 Zoning Board of Adjustment meeting. A building permit was not issued within a period of one year from the date of approval, so that approval has expired. At the applicant's request, this case was tabled to the December 11 meeting.
