Item 7A Agenda Item 7A Mr. Mayor and members of the City Council, I am Mike Spinozzi and reside at 915A Emerald Blvd. in Southlake where I have lived with my family for over 8 years. I am writing with regard to the Southlake Villas development which will occupy the 3 acres directly south of my home. My neighbors and I have been working with the developer and his associates to resolve hours and days of operation for this proposed development. We are very concerned with late hours on weeknights and any activity on the weekends. I have forwarded an e- mail(below) from Mr. Jerome Hill, the developer, which was received by me on 11/20. As you can see he is asking for my support if hours were specified 8 -5 Mon through Friday and 8 -noon on Sat. His e-mail also indicates 2 small exceptions to these operating hours and his expectation that this office park will be "dead on the weekends ". This seemed reasonable but then I discovered that as part of the formal plan submitted on 11/21, the hours language was changed to include an allowance for any tenant to open from 7 -6 Mon thru Friday and from 8 -2 on Saturdays (not exactly "dead on the weekends "). This is the proposal before you now which I formally oppose. I am frustrated and concerned that this developer and his associates continue to push the envelope to get more concessions to benefit their financial situation. As a reminder, the original SPIN presentation by this developer asked for 1 building to be medical offices or 25% of the development. At the first P &Z meeting that number was increased to 3 buildings or 75 %. Currently, it is 2 buildings or 50% of the development which will increase traffic by 55% vs. the current plan that was approved 6 years ago which called for 4 general office buildings. This is according to Ms. Fletcher on the P &Z staff. Moreover, how do we rely on this developer to honor his commitments and be trustworthy with respect to the ordinance. We all know that it is difficult to enforce operating hours in ordinance language which leaves our neighborhood feeling extremely vulnerable as we have to rely on the good faith of this developer and his tenants to be in alignment with the ordinance. This developer is asking you to approve changes that are materially different from the currently approved plan and are also inconsistent with the offices that make up the corridor from Carroll to White Chapel on the North side of Southlake Blvd. These changes will have a negative impact on the quality of life for the 6 single family residences that are adjacent to the western, northern and a portion of the eastern border of this property. Also, property values will surely be negatively affected by the presence of this commercial development and the noise, traffic and loss of privacy that come with it. Further, there may be legal restrictions on how much this developer can significantly alter the plan that was approved by the council several years ago. Building D faces my property along with its doors and windows and is only 70 feet from the property line. No other commercial building faces or is as close to a residence in the corridor I described above. Also, the parking and main driveway for this building are between my property line and the front door - also unprecedented in this corridor where offices face Southlake Blvd. and parking is on Southlake Blvd. Additionally, hours for the corridor are 8 -5 Monday through Friday. I would ask the council to consider the following: Hours /Days of operation for buildings A &B (medical offices): Monday - Friday 8 -5 and Saturday 8 - Noon. Buildings C &D ( general office)which have the closest proximity to single family homes : Monday - Friday 8 -5. This is more consistent with offices currently operating in this corridor and the current plan. It will also allow the developer to have a successful project and peacefully co -exist with our neighborhood. appreciate your willingness to listen, your support and the personal involvement of some members to resolve this in a fair manner. I have a CPA that is very interested in one of the back buildings and I expect for about 3 -4 weeks around tax season he will be working on Saturday, but won't the rest of the year. On occasion I expect to work some Saturday mornings myself. As far as the other two buildings in the front, I fully expect they will be consistent with the rest of the general business corridor you have described. Additionally, I will strike the dialysis, imaging, and specifically eliminate ALL urgent care and emergency care facilities. I will also make the other changes to the site plan and building elevations as requested by counsel. I'd really like to have your support and very much appreciate your consideration.
