Item 6FCITY OF SOUTHLAKE Department of Planning & Development Services STAFF REPORT November 24, 2014 CASE NO: ZA14-137 PROJECT: Fans United — Grand Opening Tailgate Event EXECUTIVE SUMMARY: Fans United is requesting approval of a specific use permit to allow outdoor sales or services at 1431 E. Southlake Boulevard, Suite 501, located at the Shops of Southlake, Southlake, Texas. SPIN Neighborhood # 8. REQUEST DETAILS: Fans United is requesting approval of a specific use permit to allow outdoor sales or services. The purpose of this request is to gain approval to hold a one -day five - hour outdoor grand opening tailgate event. • Saturday, Optional dates of January 3rd 1 ptn 171n 241n or 31 st • 12 PM — 5 PM The objective of the event is to raise awareness of the Fans United store as well as bring awareness to the local restaurants, retailers and partners in the Southlake community. The initiative is to activate Southlake based retailers/restaurants and community to participate in a tailgate themed grand opening event. The event is proposed to be located in front of the Fans United store. Six (6) 10x10 tents are proposed with tables. On November 6, 2014, the Planning and Zoning Commission recommended approval subject to the staff report; noting the SUP that has been requested will be for December 13, 2014; also noting the addition and approval of the Dallas Cowboys hall of fame truck; limiting all activity in connection with this SUP to the date of the event, December 13, 2014, to include both set up and tear down. The initial application for this request indicated the event location in front of the lease space which is located on Lot 5, Block 1, Shops of Southlake. Just prior to the Planning & Zoning Commission meeting, the applicant presented a new location. The Commission acted on what was presented, however, the new location changed the legal notification boundary so a new public hearing notice was sent to all property owners within 200 feet of the new boundary which is described as Lot 3, Block 1, Shops of Southlake. Due to the re -notice, this application requires an additional public hearing and consideration by the Planning & Zoning Commission. On November 20, 2014, prior to the P&Z meeting the applicant requested flexibility with the event date, opting for one (1) Saturday during the month of January (3, Case No. ZA14-137 10, 17, 24 or 31) instead of December 13, 2014. On November 20, 2014, the Planning & Zoning Commission recommended approval noting the applicant can have one day for this event out of the following; January 3rd 101" 171n 241n or 31 st, 2015. October 2, 2012; City Council approved a specific use permit for a development wide "Fall Sales Event" for a three-year period, limited to the tenants of the Shops of Southlake only. STAFF COMMENTS: Due to the limited scope of this request no plan review summary was generated. The proposed event boundary appears to include two (2) handicapped parking spaces. The applicant has been advised they will be required to work with the property management in providing temporary handicapped spaces for the two (2) that have been temporarily removed by this event. 45.12 SPECIFIC REGULATIONS FOR OUTDOOR SALES OR SERVICES a. Approval of a specific use permit for outdoor sales or services shall be based upon an analysis of the location, the site layout and design features, the assurance that the adjoining streets can handle higher volumes of traffic during peak hours of traffic loading without a requirement to divert traffic onto traditional residential streets and the compatibility of the proposed use with adjacent land uses. b. A fixed time period for the outdoor sale or service activity to commence shall be established in the specific use permit. The permit for the sale or service activity shall be established and unless otherwise stated in the permit, shall be valid one year from the date of approval by the City Council. c. Regulations for any structure used to conduct the outdoor sale or services activity including but not limited to, size, color, location of equipment, lighting and signage shall be established in the specific use permit. The location of outdoor sale or service activity shall not reduce the parking requirements or effectiveness of landscaped or buffer areas and the areas for the display of merchandise shall not adversely impact the ability of pedestrians or vehicles to move about the lot. e. The site must provide adequate ingress and egress. f. Provisions for waste collection, recycling and/or disposal may be established in the specific use permit. g. Each sidewalk or pedestrian way on the approved site plan shall be a minimum of forty-four inches (44") in width. Additional width may be required and pedestrian ways shall be subject to the Americans with Disability Act Accessibility Guidelines for Building and Facilities.
