CITY OF SOUTHLAKE Department of Planning & Development Services STAFF REPORT November 24, 2014 CASE NO: TRER14-0151 PROJECT: Tree Removal Permit Modifying the Tree Conservation Plan for Lot 23, O.W. Knight No. 899 Addition, Located at 251 Lilac Lane EXECUTIVE SUMMARY: On behalf of the Mel & Candi Brekus, Sage Group, is requesting a tree removal permit modifying the approved Tree Conservation Plan for Lot 23, O.W. Knight No. 899 Addition, Located at 251 Lilac Lane. Current Zoning: SF-2 Single Family Residential District. SPIN Neighborhood #9. DETAILS: On behalf of the Mel & Candi Brekus, Sage Group, is requesting a tree removal permit modifying the approved Tree Conservation Plan for Lot 23, O.W. Knight No. 899 Addition, Located at 251 Lilac Lane. The Tree Conservation Plan approved with the Zoning and Concept Plan for Case ZA13-040 shows the existing tree coverage of 29.2%, 98.98% of the tree coverage to be preserved. The minimum required preservation is 60% of the existing tree coverage. Upon design of the home along with proposed improvements adjacent to a pond in the northwest portion of the property, the anticipated tree removal has increased. Upon updating of the tree coverage, the new survey shows the existing tree cover to be 36.29%. The proposed preservation is approximately 84.44%. Although this is compliant with the minimum tree preservation of 60% of existing tree cover, it differs from the approved plan by a reduction of approximately 15%. Under the Tree Preservation Ordinance 585-D, where a tree removal permit has been requested Section 6.6 states as follows: DEFERRAL TO CITY COUNCIL: If the application for a tree permit seeks to alter a tree which is part of a Tree Conservation Plan approved by the City Council, the Administrative Official may defer the approval of the tree permit to the City Council after a recommendation from the Planning and Zoning Commission for any reason. Once again, although this complies with the minimum preservation requirements of the Tree Preservation Ordinance, given there is a significant change from the approved Tree Conservation Plan, the administrative official has differed approval of the permit to City Council. If approved, the revised Tree Conservation Plan will take precedence and the removal permits will be issued in accordance with the approval. LEGAL DESCRIPTION: Lot 23, OW. Knight Survey No. 899 Addition LAND USE CATEGORY: Low Density Residential CURRENT ZONING: "SF-2" Single Family Residential District HISTORY: A Zoning Change and Concept Plan was approved by City Council on June 4, 2013 for Case ZA13-040. A plat Showing was approved July 25, 2013 and filed on September 24, 2013. CONSOLIDATED FUTURE LAND USE PLAN / SOUTH SECTOR PLAN: The underlying land use designation for this property is "Low Density Residential." The proposed change is consistent with the requirements of the "Low Density Residential" designation. PATHWAYS MASTER PLAN& SIDEWALK PLAN: The Master Pathways Plan shows a 6' sidewalk planned along the north side of Lilac Ln. and a proposed on -street bikeway on Lilac Ln. The property is exempt from providing a sidewalk along Lilac Ln. since it meets the exemption criteria for lots being platted as a single lot of record. Lots platted as a single lot of record must only provide sidewalks if sidewalks exist on both sides of the lot or if the lot is within 1,500 feet of a public or private school on the same side of the street. PLANNNIG AND ZONING COMMISSION ACTION: November 20, 2014; Approved (7-0) subject to the staff report dated November 14, 2014. CITY COUNCIL ACTION: STAFF COMMENTS: On the Tree Conservation Plan that was approved as a part of the zoning for the property, only two (2) trees, or 1.02% of the existing tree canopy was proposed to be removed. Upon submittal for a Tree Removal Permit by the applicant's builder an additional eight (8) protected trees were proposed to be removed. Although the removal of the eight (8) additional protected trees does not violate the Existing Tree Cover Preservation Requirements within Ord. 585-D, City Staff felt the proposed removal of the additional trees constituted a major change to the approved Tree Conservation Plan and under Section 6.6 Deferral To City Council, of the Tree Preservation Ord. 585-D, chose to defer the proposed alteration of the additional trees and revisions to the approved Tree Conservation to City Council. Case No. Attachment A TRER14-0151 Page 1 Section 6.6 of Ordinance 585-D reads as; DEFERRAL TO CITY COUNCIL: If the application for a tree permit seeks to alter a tree which is part of a Tree Conservation Plan approved by the City Council, the Administrative Official may defer the approval of the tree permit to the City Council after a recommendation from the Planning and Zoning Commission for any reason. In addition, if a request for a Tree Permit does not meet any standards for approval under 6.5.a, the Administrative Official may defer the approval of such a tree permit to City Council after a recommendation from the Planning and Zoning Commission. * The current approved Tree Conservation Plan shows that the existing amount of tree cover across the property is 29.20% and based on the Existing Tree Cover Preservation Requirements within Ord. 585-D, a minimum of 60% of the existing tree cover is required to be preserved. The plan shows that 1.02% of the 29.20% of existing tree cover across the property is proposed for possible removal and the remaining existing tree cover is 98.98% of the total 29.20% * The revised Tree Conservation Plan shows that 15.56% of the 36.29% of existing tree cover is proposed for possible removal and the remaining existing tree cover is 84.44%. The amount of existing tree cover proposed to be preserved does not fall below the 60% minimum tree cover required to be preserved. * The total amount of existing tree cover on the revised Tree Conservation Plan has changed from the amount shown on the approved plan because after surveying the property for the proposed house construction the applicant gained better information on the existing tree cover on the property. 1. Section 7.2 Standards for Approval, in Ordinance 585-B states the following. STANDARDS FOR APPROVAL: a. Except as provided by subsection 7.2.b., a Tree Conservation Analysis or Tree Conservation Plan shall be approved if it will preserve existing tree cover in accordance with the percentage requirements established by Table 2.0. If the property has previously received a tree permit related to development, the percentage of existing tree cover at the time the first such permit was issued shall be used to calculate the minimum existing tree cover that must be preserved under this section. Table 2.0 — Existing Tree Cover Preservation Requirements Percentage of existing tree cover on the entire site Minimum percentage of the existing tree cover to be preserved* 0% — 20% 70% 20.1 — 40% 60% 40.1 % - 60% 50% 60.1 % - 80% 40% 80.1 % - 100% 30% *The minimum percentage of existing tree cover to be preserved shall exclude any area in public rights -of -way as approved by City Council. Please be aware that all existing trees shown to be preserved on the City Council approved Tree Conservation Plan must be preserved and protected during all phases and construction of the development. Alteration or removal of any of the existing trees shown to be preserved on the Case No. Attachment A TRER14-0151 Page 1 approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance and the zoning as approved by the Southlake City Council. Last year, a rezoning of the property to SF-2 was approved, and the lot was platted. At that time, no design work had yet been undertaken on the layout of the intended new home, so we were unable to accurately indicate which trees would be saved and protected in and around the home site, and which trees would not. So, rather than indiscriminately guessing which trees would need to be removed to accommodate the new home, the "free Conservation Plan prepared at that time only indicated the trees which possibly would have to be removed with the demolition of the existing home, because of their close proximity. The Tree Canopy Coverage chart prepared at that time was as follows: Tree Canopy Coverage (June 21, 2013 Zoning Submittal) Total site area 210,707 s.f. However, as the home has now been designed and submitted for permits with the city, we can accurately determine which trees will be removed for construction. Those have been indicated on the new Tree Conservation Plan submitted with this application.
