Daniel Cortez, Principal Planner presented Item No. 9, ZA14 -099 and Item No. 10,
ZA14 -100 together.
Alex Ayala, Civil Engineer came forward in regards to traffic, driveways and medians.
David Palmer with Cencor Reality came forward; 3102 Maple Avenue. Mr. Palmer gave
a separate presentation.
Commissioner Parrish asked Mr. Palmer to introduce the remaining team in case there
are any questions for them.
Gary Devleer, principal architect; Mr. Collins with Kroger; Christina Conrad with Kroger;
Mike Clark; project civil engineer; Sara Dodd, political consultant; Gary Huddleston with
Kroger; Bill Dahlstrom with Jackson Law Firm; and Myron Dornic with Jackson Law
Firm.
Commissioner Parrish asked about meetings with the surrounding residence.
Mr. Palmer stated that they have not met with the surrounding residence.
Commissioner Parrish asked about the development and what it brings to the
community.
Mr. Palmer explained the concept and the improvements that it will bring to the corner
and the community pointing out that the plan exceeds the city ordinance standards.
Commissioner Parrish asked Mr. Palmer to elaborate on the possible tenants.
Mr. Palmer named Pei Wei and Chipotle as a possible tenants but nothing further
specifically. Mr. Palmer continued to state that there will be large sit down restaurant
footprints with retention ponds and pedestrian areas.
Commissioner Parrish asked Mr. Palmer to elaborate on the pedestrian areas. The
plans given do not seem to be pedestrian friendly.
Mr. Palmer disagreed.
Commissioner Parrish expressed concern about the intensity of use for this site and
how it is laid out for pedestrians and safety concerns.
Mr. Palmer stated that it was on the concept plan as presented which shows sidewalk
connections.
Commissioner Forman pointed out the articulation on the south wall and his preference

to have it in there on the east side of the south wall. Commissioner Forman would like to
take the driveway variances off the table and would like Mr. Palmer to explain the
requests.
Mr. Palmer explained the reason for the variances in regards to the driveway.
Commissioner Forman continued to ask for an explanation on the decel lanes.
Mr. Palmer explained the decel lanes for driveways 5 and 6 off of Kirkwood Blvd.
Commissioner Forman asked about the tree preservation plan specifically the elevation
drops along the south of the property back towards the Kroger.
Mr. Palmer explained the topography and landscaping for the site along with the
grading. Mr. Palmer continued to recite the landscape ordinance.
Commissioner Forman asked about the road on the north side of the development and
the elevation difference on the second drive.
Mr. Palmer explained the difference.
Commissioner Kubiak expressed concern for the intensity of the use and would like Mr.
Palmer to explain the different renderings that came about and what factors brought
them to this final rendering.
Mr. Palmer explained the tenant use, parking ratio based on use and the zoning allowed
uses. The grade is based on the detention requirements which are also a factor in the
type of uses picked, specifically heavy restaurant uses both dine in and quick meals.
Commissioner Kubiak spoke on the 2030 plan. The use proposed is in accordance with
the zoning. However, the site plan is lacking in quality when it comes to community
space, pedestrian uses, and creating a "sense of place ". Commissioner Kubiak asked
Mr. Palmer to elaborate on those aspects.
Mr. Palmer believes he has done due diligence with the surrounding neighborhoods,
staff and commission. Mr. Palmer continued to state that he believes this to be a quality
development and plans to move forward as it stands.
Commissioner Kubiak asked about possible open space and park area within the
development.
Mr. Palmer explained that there is some green space on the eastern side of the site
where the existing trees will be preserved and additional landscape will be planted. The
purpose is to shield the Kirkwood neighborhood from the parking.
Commissioner Kubiak asked about the historical marker on site and possibly put some

Mr. Palmer explained that the marker is on city property but is willing to talk to staff.
Commissioner Kubiak asked about the difference between the existing Kroger and this
development and its attributes and why the intensity of use is needed and /or desired.
Commissioner Smith asked about the intensity of use and if the 2030 Plan and the
Comprehensive Plan were ever considered.
Mr. Palmer stated that the concept plan is still in the creative aspect and not all
pedestrian aspects have been created. However, Mr. Palmer did point out what is
existing on the concept plan.
Commissioner Parrish asked if he believed that this development was considered
pedestrian friendly.
Mr. Palmer stated yes.
Commissioner Parrish asked about possible terracing within the development.
Mr. Palmer referenced Ordinance 585B and the zoning rights for C -3 uses.
Commissioner Smith asked if there was a possibility to create more public space that
would reduce the intensity and save a few more trees.
Mr. Palmer stated that they have far exceeded the city ordinance requirements for open
space and the city requirements for internal plantings.
Commissioner Smith asked if Mr. Palmer is willing to entertain the idea to look at the
2030 Plan and the Comprehensive Plan.
Mr. Palmer stated that he cannot expand the green area /space.
Commissioner Kubiak expressed concern about the TIA, specifically the round - about,
entrance 3 and the signal at Kirkwood Blvd. and Dove Rd.
Mr. Palmer explained the TIA and the numbers that were defined.
Commissioner McCaskill asked for clarification on a statement that was made earlier.
"..proceeding in accordance with your legal or technical rights or legal and technical
ways...".
Mr. Palmer explained that they were proceeding in a manner under their rights and
under the ordinance and the statutes of the State of Texas.
Commissioner Forman asked about the parking lot in front of the Kroger to south of the
first drive. Is there any other configuration that would allow for the parking requirements
and minimize such a large parking footprint?

Mr. Palmer stated that the parking is designed based on code and ratio.
Gary Huddleston, 1331 E Airport Freeway with Kroger came forward.
Commissioner Parrish stated that the square footage was reduced.
Mr. Huddleston agreed. It was reduced based on comments from the surrounding
neighbors.
Commissioner Parrish asked how this development compares to the stores that are
being developed in the Houston area.
Mr. Huddleston stated that this one will be smaller and more focused on the perishable
products with an international food section and prepared meals.
Commissioner Parrish asked if it could be done at 75,000 square feet.
Mr. Huddleston stated no.
Commissioner Smith expressed an idea of having a pedestrian access to allow your
customers to purchase a prepared meal and venture out to that area to enjoy their
lunch.
Commissioner Kubiak asked about the radius in having 2 stores in close proximity.
Mr. Huddleston stated there is not a set radius or circle. It's more about the demand.
Sara Dodd, 6060 N Central Expressway with Dodd Communications came forward. Ms.
Dodd explained that she handles public affairs and municipal lobbying.
Commissioner Parrish asked for clarification on how the signatures were obtained for
the petition.
Ms. Dodd stated that she set up at the existing Kroger for about 3 hours with site plan
display, map location and store information. Ms. Dodd continued to state that she spoke
with several people about the store and the amenities.
Commissioner Parrish explained to Ms. Dodd that a few people that signed the petition
have emailed the city asking to be removed from the petition after further information.
Also, there were a portion of people that were not Southlake residence.

Addressed the petition, referenced the 2030 Plan, would like more than the bare
minimum, questioned the variances, questioned the TIA, traffic concerns, safety
concerns, landscaping concerns, would like more green space, drainage concerns,
referenced Urban Design Plan, pedestrian walkways, bike lanes, referenced other cities
that are heavily congested (Plano, Frisco, Keller, etc...), upset with the lack of
communication with the surrounding neighborhoods, referenced tax base and quality of
life, too many grocery stores, and noise concerns.

Dahlstrom expressed concern for the treatment of his client and continued to remind all
present what his client's legal rights for this property are and what is allowed. Mr.
Dahlstrom continued to state that some of the variances requested are negotiable.
Commissioner Forman stated that the southern half of the property is in need of
improvement and traffic is a concern.

landscaping and tree preservation is in need of improvement.
Commissioner Kubiak echoed some of the comments.
Commissioner Springer does not agree with the landscape plan and believes the
stacking depth is an issue. The internal buffer yards are a concern along with the grade
and parking ratio.
Commissioner Parrish believes that this is not a quality development and that only the
bare minimum is being met.

Ms. Rivera speculated that the property to the west will develop under the low density
land use.

Dennis Killough, Deputy Director explained the driveway line up and street access.
Commissioner Springer asked about the aerobic system. The installation does not make
sense financially.
Ms. Rivera stated that a lift station would also be required which would add to the
