CITY OF SOUTHLAI<,-E Department of Planning & Development Services STAFF REPORT November 12, 2014 CASE NO: ZA14-120 PROJECT: Zoning Change and Site Plan for White Line Self Storage EXECUTIVE SUMMARY: Sage Group, Inc. on behalf of Don Davis Investments is requesting approval of a Zoning Change and Site Plan from "AG" Agricultural District to "S-P-1" Detailed Site Plan District with limited "I-1" Light Industrial District Uses and "0- 1" Office District uses for the development of a self storage facility on approximately 2.3 acres located at 750 Davis Boulevard and 2360 Michael Drive. SPIN Neighborhood # 11. DETAILS: Sage Group, Inc. on behalf of Don Davis Investments is requesting approval of a Zoning Change and Site Plan for the development of a self storage facility. The proposed development consists of multi -story, two -stories on the east side and three stories on the west, self -storage building approximately 90,275 square feet in size on the northwest corner of Davis Boulevard and Michael Drive. The development will add twenty-two (22) standard parking spaces and also six (6) loading spaces. All vehicular access will be from Michael Drive, which is proposed to be improved with this proposal to a 24-foot concrete drive, which adjoins the southern boundary of the development. The applicant is requesting this be reduced to 16-feet. The driveway labeled as Drive `A' on the site plan has a stacking depth of approximately 23-feet and the driveway labeled as Drive `B' has a stacking depth of approximately 16-feet. At the Planning & Zoning Commission meeting held on October 23, 2014 the commission approved the request with the condition that the applicant look into evaluating the hours of operation and possibly limiting them between 12 to 16 hours a day. The applicant has indicated they will provide more information on this request at City Council. Based on adjacent property owner's responses in opposition to this project, a supermajority vote by City Council will be required for this item at the 2nd Reading. CITIZEN INPUT: A SPIN meeting was held on August 12, 2014 for this proposed development. A copy of this report can be found under Attachment `D' of this staff report. SOUTHLAKE 2030: Case No. ZA14-120 Consolidated Land Use Plan The Southlake 2030 Future Land Use Plan designates this property as Mixed Use. The Mixed Use land use designation is defined within Southlake 2030 as the following: "The range of activities permitted, the diverse natural features and the varying M LU 2150j 2396 2360 MtGHAEL DR 5 2395 2365r proximity to thoroughfares of areas in the Mixed Use category necessitates comprehensively planned and coordinated development. New development must be compatible with and not intrusive to existing development. Further, special attention should be placed on the design and transition between different uses. Typically, the Mixed Use designation is intended for medium- to higher -intensity office buildings, hotels, commercial activities, retail centers, and residential uses. Nuisance -free, wholly enclosed light manufacturing and assembly uses that have no outdoor storage are permitted if designed to be compatible with adjacent uses. Other suitable activities are those permitted in the Public Parks/Open Space, Public/Semi-Public, Low Density Residential, Medium Density Residential, Retail Commercial, and Office Commercial categories previously discussed." Attachment A Page 3 TRANSPORTATION ASSESSMENT: Case No. ZA14-120 In addition to the Future Land Use designation on the property, during the development of the F.M. 1709 and F.M. 1938 Corridor Plan a site specific recommendation was made for the properties adjacent to Michael Drive. The recommendation was as follows: FM2: "Maintain Mixed Use land use designation east of creek. Maintain Medium Density land use designation west of creek, specifically allowing office uses. Preserve the floodplain corridor." The site specific recommendation does not directly affect the proposed development. Mobility Master Plan On the City's Thoroughfare Plan within the Mobility Master Plan labels Davis Boulevard (FM 1938) as a 130-foot to 140-foot, 6-lane divided arterial (A6D). The Active Transportation section of the City's Mobility Master Plan recommends a less than 8-foot sidewalk along Davis Boulevard on the Pathways Plan. The applicant is proposing a 5-foot sidewalk along Davis Boulevard meeting the plans intent. During the development of the City's Urban Design Plan that was adopted in February of 2008, a study was conducted with assistance of the Texas Department of na Transportation (TxDOT) to I_ determine potential locations of median openings along J r+ Davis Boulevard (FM 1938) if medians were to ever be'k' installed for this section of FM 1938. As it relates to this specific site, there are no median openings at Michael Drive. An opening is anticipated approximately 150-feet to the south with access into North Davis Business Park and another opening is anticipated located approximately 300-feet to the north to the future Ridgeview II residential subdivision. Area Road Network and Conditions The proposed development will have access onto Michael Drive by the way of two driveways, labeled on the site plan as Drive `A' and Drive `B'. Michael Drive is currently a private street and has never been accepted or maintained by the City. Michael Drive will remain a private street but the applicant is proposing to improve the portion of Michael Drive that is adjacent to developing property to a 24-foot concrete street built to City standards where it is currently asphalt and gravel. Attachment A Page 4 * Based on the 2013 City of Southlake Traffic Count Report Traffic Mini -Warehouse (151) 1 90,275 1 226 12 1 13 1 14 1 12 * Vehicle Trips Per Day * AM -In, AM -Out, PM -In and PM -Out are peak hour generators on a weekday * Based on the ITE: Trip Generation Manual, 7t" Edition Compared to other uses in the Mixed Use land use designation, self - storage (mini warehouses) generate a relatively low amount of vehicular traffic. The required parking for such facilities is 1 parking space per 5,000 square feet of floor area which is indicative of its low intensity when compared to office which requires 1 parking space per 300 square feet of floor area for example. TREE PRESERVATION: There is only tree on the entire site. This tree provides for approximately 2.4% tree cover on the site. The applicant has indicated that they will preserve this existing tree, therefore providing for 100% tree protection. There will also be additional landscaping installed which include additional trees throughout UTILITIES: Water The site has access to an existing 6-inch water line available along Davis Boulevard for the property to tie into. Sewer The applicant is proposing to install an 8-inch sewer line that runs along Michael Drive so it can connect to a 15-inch sewer line located to the west of the proposed development. PLANNING & ZONING COMMISSION: October 23, 2014; Approved (6-1) subject to Site Plan Review Summary No. 2, dated October 17, 2014 and the staff report dated October 17, 2014, granting the variances as requested, also noting and approving the deviations presented in the "S-P-1" regulations from the 1-1" district, also noting the applicants willingness that prior to Council to "tighten up" the operating hours between 12 to 16 hours a day. Any use permitted in the 0-1 Office district; 2. Cold storage warehouse without size limitation; 3. Mini -warehouses; 4. Warehouses. Development Regulations: This property shall be subject to the normal development regulations contained within the respective Land Use Districts regulating Permitted Uses above, and all other applicable regulations, with the following exceptions: At least one-third of the required off-street loading spaces or truck berths shall have a minimum dimension of 10 feet by 50 feet each and the remaining required spaces or berths shall have a minimum dimension of 10 feet by 25 feet each - exclusive of turnaround and maneuvering space. 2. No building may encroach in the area above a line having a slope of 2.4:1 from any single- family property. 3. Please be aware that all existing trees shown to be preserved on the City Council approved Tree Conservation Plan must be preserved and protected during all phases and construction of the development. Alteration or removal of any of the existing trees shown to be preserved on the approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance and Case No. Attachment E ZA14-120 Page 1 the zoning as approved by the Southlake City Council. Please ensure that the layout of all structures, easements, utilities, structures grading, and any other structure proposed to be constructed do not conflict with existing trees intended to be preserved. LANDSCAPE COMMENTS: 1. The applicant may choose to provide over and above the minimum required landscaping but for the bufferyards that are the correct designation they exceed the minimum required plant material quantities. It may be of benefit to round down or up at .5 when calculating the plant material quantities. 2. The interior landscape area located at the ends of parking rows are considered parking lot landscape area. Please provide the appropriate plant material in these areas that would be required in a parking lot landscape island. Additional requirements may be necessary with the review of civil construction plans. 1. Proposed 24' common private drive outside the property shall be constructed to conform to City street standards. Street intersections shall comply with TDLR/ADA accessibility standards. Sight distances shall comply with AASHTO guidelines on adjacent collectors and arterials. Sidewalk widths shall conform to the Southlake Pathways Plan. Provide all necessary easements for water, sanitary sewer and drainage. Easements shall be 15' minimum and located on one lot — not centered on the property line. A 20' easement is required if both storm sewer and sanitary sewer will be located within the easement. If an easement cannot be obtained for drainage, adequate detention will need to occur on site. Case No. Attachment E ZA14-120 Page 2 2. The proposed 8" water, 8" sanitary sewer and 24" storm sewer line shall be in a dedicated easement prior to construction. Proposed easements shall be dedicated by plat. 3. Civil construction plans shall include plan sheets for pre -construction, post -construction and permanent erosion control measures and stabilization. Water and sanitary sewer cannot cross property lines without being in an easement or right of way. All waterlines, sanitary sewer and storm sewer in easements or right of ways must be constructed to City standards. WATER COMMENTS: 1. Industrial developments require fire hydrant spacing of 300' maximum for non -sprinkled buildings or 600' for sprinkled buildings. Our property is currently zoned RE and SF1-A with a number of occupied homes onsite. The purpose of this letter is to register our official opposition to the above development proposal, a 90,000 sq. ft. mini storage facility and also detail our concerns regarding it. We have lived in the Southlake-Westlake area for almost 30 years. We have watched Southlake develop into one of the most beautiful cities in the country. We are concerned that if City Council approves this development, it will limit Davis Blvd. to industrial uses that, while necessary, are better located elsewhere. We attended the Planning and Zoning Meeting of October 23, 2014 and expressed our concerns about the proposed zoning change and site plan. The Commission did not attempt to address our concerns with the developer and in fact, indicated they did not agree with a number of them eyed development are as follows: Case No. Attachment F ZA14-120 Page 4 • Section 31.6 of Southlake's SP-1 zoning category states, "In addition to the development regulations applicable to this zoning district, the development regulations in Section 43, Part Ill, Residential Adjacency Standards, shall also apply. When any requirements in this section are in conflict with any other requirements for this zoning district, the more stringent requirements shall apply." The proposed development is adjacent to residentially zoned property (ours) and therefore the Residential Adjacency Standards of Section 43 of Southlake's zoning ordinance should be applied to this development. However the requested zoning does not comply with those standards. a. The building as proposed does not meet the requirements of the Residential Adjacency Ordinance because the building's slope is not 4 to 1, creating a less desirable elevation for adjacent properties. b. The proposed site plan anticipates a 3 story building, 40 feet high in violation of the Residential Adjacency Ordinance which only allows for 2.5 stories with a maximum height of 35 feet. • I-1 will be the underlying zoning for this project if approved and Southlake's zoning ordinance requires a minimum of 5 contiguous acres of I-1 zoning when requesting a zoning change to I-1. This development only has 2 acres of I-1 zoning contiguous to it. • The zoning requests uses beyond that of mini storage, including cold storage warehouses without size limitation, min -warehouses and warehouses in general. • The plan only has 22 parking spaces and is proposing 1 space per 5000 sq. ft. Southlake's Parking Ordinance calls for 1 space per 1000 sq. ft. for industrial uses. The parking as proposed is not even close to adequate for this development. • The applicant has provided no details regarding the planned lighting of the facility. We are concerned that there will be significant spill over lighting unto our property because of the need for a higher level of security. • Although the development does not indicate any plans for outside storage, we have a concern that if the development is approved, an application requesting permission to Move outside rage -could -be. • The plan does not indicate a maximum number of storage units. 2 Case No. Attachment F ZA14-120 Page 5 • The zoning does not specify the hours of operation and the developer was non -committal and vague at the P & Z meeting. Generally a mini -storage facility has 24 hour access of some type. • While the proposed operator is not U-Haul, there is a possibility that U-Haul could purchase the building in the future and replace the current color configuration with the U- Haul colors which are very bold and bright, not neutral as proposed in this development. • The industrial uses requested under this zoning could serve to limit opportunities for other types of more desirable development in the Davis Blvd. corridor, especially the properties to the north. • Southlake already has four mini storage facilities within its borders: Yates, Dragon Storage, Souddake Storage, and Public Storage. There are at least four other mini storage facilities within two miles of this proposed development in North Richland Hills. We question the need for one more mini storage facility in Southlake, especially one that is 90,000 square feet in size. • We understand there have been challenges with development along Michael Dr. However the proposed development does not really do anything for the other properties on Michael Dr. as the road will only be completed to the end of their property line and ties into the same 6 inch water line that the other buildings on Michael Dr. have been using. It is our hope that the Council has a more promising vision for this part of Davis Blvd. There is a real possibility of grouping a number of Davis Blvd./Michael Dr. properties together in the future for a master -planned development with office/retail along Davis and some type of residential component in the interior, potentially connecting Michael Dr. with Brock Dr and incorporating the flood plain area into an attractive park/open space. This type of master - planned development would be a wintwin for the properties on Michael Dr., the properties to the North of Michael Dr. and the City of Southlake. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance Case No. Attachment G ZA14-120 Page 5 but may be prosecuted until final disposition by the courts. SECTION 9. The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least fifteen (15) days before the second reading of this ordinance, and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of its provisions, then the City Secretary shall additionally publish this ordinance in the official City newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13 of the Charter of the City of Southlake. SECTION 10. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained.
