CJ de Vilder with Doresett, Swift & Johnson came forward and explained the use of the building based on the square footage and the parking per use. Chairman Hudson asked about the type of restaurant. Mr. de Vilder did not have an affirmative answer. Commissioner Parrish asked for specifics regarding the back of the space /building. Mr. de Vilder gave specifics as to where the back of the building will be located and that it will be office use with office windows. Chairman Hudson opened and closed the public hearing. Commissioner Springer stated that he is not comfortable with the plan due to traffic and parking concerns. Commissioner Forman agreed. Approved (3 -2) subject to the Staff Report, dated October 31, 2014; and subject to the Site Plan Review Summary No. 4, dated October 31, 2014; and granting the variance request with respect to the stacking depth as presented. Staff explained that this is a one day event and one event only. Commissioner Parrish asked about location. Patty Moos explained that is used to the store called Cherish. Commissioner Parrish asked about tent location. Patty Moos pointed out the tent area on the exhibits. Commissioner McCaskill asked about set up time. Ted Ngyuen with Dallas Pro Shop and representing Fans United. Chairman Hudson asked about the other retailers and how they will be involved. Mr. Ngyuen explained that they wanted to build a partnership with the other retailers in the shopping center and bring in as much traffic for all involved as possible. In regards to set up time, Mr. Ngyuen believes he will need about an hour for set up and tear down. Commissioner McCaskill verified that total time for the event would be 8am to 7pm. Commissioner Parrish asked about position of the space. Mr. Ngyuen stated yes. Commissioner Parrish asked about product. Mr. Ngyuen explained that it will be licensed apparel starting with the Dallas Cowboys, college level and of course Carroll Dragons. Chairman Hudson opened and closed the public hearing. Approved (5 -0) subject to the Site Plan Review Summary No. 2 dated October 31, 2014 also subject to the Staff Report dated October 31, 2014; noting for the record, that the previous four variances that were granted will remain in full force in effect; and also noting as on the plans, the generator enclosure will include a 6 -foot stone wall and additional landscaping to ensure that it is screened from Watermere Drive. PUBLIC HEARING Daniel Cortez, Principal Planner presented Item No. 10, ZA14 -082. Konstantine Bakintas came forward. Commissioner Forman asked about the screening wall. Mr. Bakintas explained the fencing and the perimeter. Chairman Hudson asked about public safety and the light censors. Commissioner McCaskill asked about the buildings that will have medical use. Mr. Bakintas stated those buildings would be close to Southlake Blvd. Chairman Hudson opened the public hearing. Felix Blanchard, 2727 Hiddenlake Drive in Grapevine came forward. Mr. Blanchard expressed concerned about the traffic, but all other issues from the previous meeting have been addressed. Planning and Zoning Commission Meeting Minutes — November 6, 2014 Page 6 of 11 Mike Spinozzy, 915 A Emerald Blvd. in Southlake came forward and explained his concern regarding traffic and use. May Hoang and Long Nguyen, 823 Pearl Drive in Southlake came forward and expressed concern about lights, traffic, noise and use. Chairman Hudson closed the public hearing. Mr. Bakintas addressed the concerns that were expressed. Commissioner Forman asked about the remaining uses and the times of operation. Mr. Bakintas stated that the time needs to be flexible. However, it specify no 24 hour operations. Approved (5 -0) subject to the following: - • Site plan review summary #4, dated October 30, 2014; • Staff report dated October 31, 2014; • Granting the driveway variance request as presented; • Noting that the 20' pole lighting the applicant has presented at the property line will be no brighter than 0.02 foot candles; • The medical use will be limited to the front two buildings fronting Southlake Boulevard; • Amending the landscape plan to indicate all evergreen trees at the perimeter; • There will be no 24 -hour operations at any of the facilities; • There will be motion sensors for site lighting subject to approval by the City Department of Public Safety; • All of the 0-1 medical pharmacy uses requested in the application will be permitted noting the pharmacy will be limited to compounding pharmacy with no drive -thru; • And, noting there will be an 8' masonry fence adjacent to all residential lots as presented. West Survey, Abstract No. 1620, City of Southlake, Tarrant County, Texas and located at 500 W. State Highway 114, Southlake, Texas. Current Zoning: "S -P -2" Generalized Site Plan District. SPIN Neighborhood #3. PUBLIC HEARING Daniel Cortez, Principal Planner presented Item 11, ZA14 -099 and Item 12, ZA14 -100 together. Alex Ayala, Civil Engineer presented the TIA. David Palmer with Cencor Reality came forward and gave a separate presentation. Chairman Hudson asked about the justification for the parking. Mr. Palmer explained the parking ration versus the use and what the ordinance requires. Commissioner Forman asked about Kroger facing north and asked how they came to that decision. Mr. Palmer explained that the topography played a part in the decision. Commissioner Forman asked about the rendering and the destruction of all the trees. What unique features will be added? Mr. Palmer stated that there will be pedestrian walk ways, outdoor seating and patios and very pedestrian friendly. Commissioner Parrish asked about amenities. Mr. Palmer stated that this is a high quality development and will be built according to required ordinances. Commissioner Parrish expressed concern of the intensity of the use and the variances requested regarding the tree ordinance and landscaping. The Commission recommended that the applicant meet with the Landscape Administrator. Commissioner Parrish asked about the historical marker along Dove Rd. Mr. Palmer stated it was on city property. Chairman Hudson opened the public hearing. Mr. Harsy expressed the neighborhoods feelings about the project and the amount of opposition; development density, traffic, big box development, quality of development, no transition, and what will happen to the current Kroger. Pamela Muller, 214 Westwood Drive came forward to speak in opposition. Brian Kurtz, 2309 Idlewild Court came forward to speak in opposition. Susan Johnson, 839 Simmons Court came forward to speak in opposition. Sheri Drinz, 404 Clariden Ranch came forward to speak in opposition. Chairman Hudson closed the public hearing. Mr. Palmer came forward and addressed the concerns and clarified a few items. City Attorney advised the Commission and explained to the audience what exactly the City's position is with this case and what the request is from the applicant. Commissioner Springer expressed concern about the landscaping and Kirkwood Blvd. needs more addressing along with sidewalk provisions. Commissioner McCaskill expressed concern about the items that seem to be incomplete. Chairman Hudson asked the applicant if he wished to table this item or would he like the Commission to make a recommendation. Mr. Palmer requested to table to the November 20, 2014 Planning and Zoning Commission Meeting. Tabled (5 -0) per the applicant's request.
