Motion to approve Ordinance No. 480 -QQQQ, the amendment to Section 45.1 (Specific Use Permit) to allow in paragraph 47 a specific use for above ground cisterns for landscape irrigation in all zoning districts and open space lots in all districts; the following will be permitted in all zoning districts as an accessory use which can be administratively approved by staff, above ground cisterns that meet all of the following: 1. Less than 500 gallons, 2. Less than 14 -feet in height, 3. Setbacks consistent with the zoning district in which the cistern is proposed, 4. Screened from view from public right -of -way or adjacent residential property with landscaping, principal structures or opaque fencing, 5. The location to be in the rear or the side of the principal structure on site on non - residential districts and setback requirements of underlying zoning districts, 6. Mr. Anderson with Trium Development Partners, 5815 Elderwood Drive in Dallas, TX. Chairman Hudson asked about the pump system. Mr. Anderson stated that the procedure of the system and how it works. Commissioner Kubiak asked about and aerial connection. Mr. Anderson explained the gutter and its limitations. Commissioner Parrish asked about gallons and height. Mr. Anderson stated 12, 500 gallons each and the height with the cone is about 17 -ft. Commissioner McCaskill asked about the topography. Mr. Anderson explained the drainage and how it works and will flow. Chairman Hudson opened and closed the public hearing. Chairman Hudson stated there needs to be limitation, specifically height, setbacks and adjacency, view from a public right -of -way, forward of the main building line, tank size, a SUP process needs to be in place, no logos, subdivision open space stipulation and material. Motion to approve ZA14 -115 to allow two, (2) 12, 500 gallon cisterns and can be up to 17.5 feet tall and that the materials will be as presented in the renderings and a 4 -ft. masonry/brick lens coating at the bottom of each cistern. CJ de Vilder with Doresett, Swift & Johnson came forward. Commissioner Kubiak asked for clarification regarding the use. Mr. de Vilder stated it would be a restaurant use with mixed uses and multiple tenants. Commissioner Kubiak asked about the access to the site. Mr. de Vilder stated that he doesn't believe that access will be an issue. Commissioner Kubiak asked about increased traffic due to the use/ Mr. de Vilder was not able to answer. Commissioner Smith asked if there was a specific tenant in mind. Mr. de Vilder stated not at this time. Chairman Hudson opened the public hearing. Derek Murway at 170 Players Circle spoke in favor of the project. Chairman Hudson closed the public hearing. Commissioner Springer is concerned with the increased square footage and the reduced parking. Commissioner Smith suggested that the applicant table and come back with more specific information and asked staff for more information. Dennis Killough explained what the applicant's options were in regards to tabling and the parking regulations based on the use. Commissioner Springer continued to express concern for the existing drive -thru. Commissioner Smith and Commissioner Kubiak agreed with the concern and added that they are worried about increased traffic. Commissioner Parrish stated that the request is inconsistent with the previous approval and is concerned. Mr. deVilder explained his concept. Chairman Hudson gave the applicant his options. Konstantine Bakintas came forward. Commissioner Kubiak asked about the cross access. Mr. Bakintas explained the access easement, specifically to 1709. Commissioner Kubiak asked about the parking and asked if they were willing to lose some extra parking to give more of a buffer to the residential neighborhood. Mr. Bakintas stated that they could reduce some of the extra parking. Mr. Bakintas continued to explain the landscape variance requests. Commissioner Springer would like to see more buffer to the residential uses. Commissioner Smith asked about what kind of buffer is there with the other neighbors and whether or not a wall will be constructed. Mr. Bakintas explained and showed the wall that will be constructed. Commissioner Parrish asked about the wall along the east side. Mr. Bakintas stated the time line and location of the wall. Commissioner Smith asked about something more substantial and expressed the neighbor's concerns about noise. Chairman Hudson opened the public hearing and read aloud the comment cards: Reni Phillip — Opposed, Lisa Quinn — Opposed, James Mellinger — Opposed. Mike Spinozzi, 915 A Emerald Blvd came forward and expressed his concerns and his opposition. Felix Blanchard, 915 B Emerald Blvd came forward and expressed his concerns and his opposition. Jerome Hill, 1400 Shady Hollow came forward in support of this project and explained that he will be a future tenant as well. Chairman Hudson suggested that the applicant speak with the neighbors and address some of the concerns. Traffic, access and buffers seems to be the largest of the concerns. Commissioner Kubiak asked for clarification from staff regarding office use versus medical office use and the traffic increase. Dennis Killough explained the difference of uses and the parking ratio for each use with Medical office having more traffic. Mr. Hill requested to table. Mr. Maguire, 607 Blair Court came forward and expressed his support. Chairman Hudson closed the public hearing. Brett Wilson, 1008 Brookshire Rd. came forward. Commissioner Kubiak asked about the proposed use and the increased intensity. Mr. Wilson stated that in the past there was a traffic problem, but believes that the use Planning and Zoning Commission Meeting Minutes — October 23, 2014 Page 7 of 13 will not interfere with additional traffic. Chairman Hudson believes the traffic will increase but that it will be in small intervals at times like in a school zone. Commissioner Parrish asked the applicant about what possible tenants would be there. Mr. Wilson named off a few possible uses but nothing specific. Commissioner Parrish questioned the "1 -1" district request and expressed concern about the extreme use of the district. Mr. Wilson explained his reasons for the request. Commissioner Smith asked about traffic on Brumlow and about future expansion and improvements. Mr. Wilson stated that that are dedicating land to the city to help with that. Dennis Killough added information regarding where the expansion will be. Mr. Wilson continued to state that they are also improving the stormwater detention. Commissioner Smith asked about the stacking variance. Mr. Wilson explained his position on the stacking variance. Commissioner Smith expressed concern about the project and believes it is too intense of a use for Brumlow. Commissioner Kubiak expressed concern about the intense use and the parking. Dennis Killough explained the parking ratio based on the use that is being requested. Commissioner McCaskill asked how the loading spaces are calculated. Mr. Wilson and Dennis Killough explained the ratio on loading and handicap spaces. Commissioner Springer asked about additional access on the rear of the property to elevate the traffic along Brumlow. Commissioner Kubiak and Commissioner Springer discussed possible cross access. Commissioner Springer asked the applicant if he was willing to shuffle the buildings around to accommodate a cross access easement. Mr. Wilson stated that he didn't see another way. Commissioner Kubiak expressed concerned about the density. Commissioner Forman asked about the uses surrounding the property. Mr. Wilson named a few of the business surrounding the development. Commissioner Smith asked about the construction and when the road will be widened and expressed concern with the increased traffic. Commissioner McCaskill asked about the articulation on phase 1 on the north side and phase 2 on the north side. Mr. Deotte stated that he would discuss it with Staff before City Council. Chairman Hudson opened the public hearing. Keith Houser, 1219 Whispering Lane came forward to speak in opposition. Chairman Hudson closed the public hearing. Mr.Deotte addressed Mr. Houser's concerns. Commissioner Springer asked about moving the buildings closer to each other and further north. Mr. Deotte stated that he could do that as long there are no Fire issues with separation. Commissioner Smith is concerned about the roundabout and the pavement being so close. Mr. Deotte stated that the articulation request can be met and the right in and right out on Highland Street is also something than can be added. Commissioner Kubiak asked about the long range plan with the median. Dennis Killough stated that there is no long term plan but a median plan was developed for Davis Blvd. Mr. Young continued his presentation. Commissioner Smith asked about office hours and access. Mr. Young didn't have exact hours but will be primarily typical office hours. Commissioner Springer asked about cold storgage Mr. Young stated that it was just a use that was listed. Commissioner Springer asked about security. Mr. Young went over security that will be in place. Chairman Hudson opened the public hearing. Commissioner McCaskill asked about the trees on the northern section of the property and the masonry wall. Mr. Young explained the landscaping with the drainage and the masonry wall to address Commissioner Kubiak and Commissioner McCaskill's concerns. Commissioner Smith expressed concern about hours of operation. Dennis Killough stated that it can be stipulated in the motion. Motion to approve ZA14 -120, subject to Site Plan Review Summary No. 2 dated October 17, 2014 and the Staff Report dated October 17, 2014 granting the variances as requested, also noting and approving the deviations presented in the "S -P -1" regulations from the "1 -1" district, also noting the applicants willingness that prior to Council to "tighten up" the operating hours between 12 to 16 hours a day.
