RESOLUTION NO. 89-44
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS, EXTENDING RESOLUTION NO.
88-65 THE CONTINUED OPERATION OF THE FLYING
BURRITO RESTAURANT FOR A PERIOD NOT TO EXCEED
THREE (3) MONTHS; DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Southlake, Texas, (the
"CITY"), hereby finds and determines that the Flying Burrito
Restaurant, owned and operated by Jayne Benavides, currently
exists and is in operation at 202 East Northwest Parkway in the
City of Southlake, Texas; and
WHEREAS, the City Council further finds that the building in
which the Flying Burrito Restaurant operates does not comply with
certain requirements of the City's ordinance, specifically,
set-back and parking requirements, and failure to have an
approved site plan in compliance with the City's Comprehensive
Zoning Ordinance; and
WHEREAS, it is the intention of the City Council to hereby waive
the above requirements and grant its approval for a period not to
exceed three (3) month extension of Resolution No. 88-65 from the
date of this Resolution, on the same conditions that there shall
be no alterations cf any nature to the existing building, parking
or surrounding area; and,
WHEREAS, it is further understood by the City Council that the
owner and operator of the Flying Burrito Restaurant, Jayne
Benavides, has made a commitment to relocate her restaurant to a
suitable site; now
THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTHLAKE, TEXAS:
Section 1. That all of the above premises are found to be true
and correct and are incorporated into the body of this Resolution
as if copied in their entirety.
Section 2. That the City Council hereby approves the three (3)
month extension of Resolution No. 88-65 from the date hereof,
provided that there shall be no alterations of any nature to the
existing building, parking or surrounding area.
Section 3. That this Resolution shall be in full force and
effect from and after its passage.
