Item 6ACITY OF SOUTHLAI<,-E Department of Planning & Development Services STAFF REPORT June 11, 2014 CASE NO: ZA13-005 PROJECT: Duffs Famous Wings EXECUTIVE SUMMARY: Duff's Famous Wings is requesting approval of a Site Plan on property described as Lot 3, Block 1, Cornerstone Plaza, City of Southlake, Tarrant County, Texas and being located at 2787 E. Southlake Boulevard, B-100, Southlake, Texas. Current Zoning: "S-P-2" Generalized Site Plan District. SPIN Neighborhood # 8. REQUEST DETAILS: The purpose of the request is to gain approval of a site plan to allow the construction of an approximately 43' 6" x 12' awning with a 5' pitch over the existing fenced -in patio area. A variance is requested to the Zoning Ordinance No. 480, as amended, Section 43.c.1.e, Corridor Overlay Zone, that requires exposed columns be constructed of or clad in the same masonry material as the principal structure. The applicant proposes to allow the support columns for the awning to be constructed of the same material as the existing metal fencing with an approximately 2' 8" masonry base that will match the existing building in color and material. The awning proposed is a dark burgundy color to match the existing red brick and Duff's sign. A sample swatch will be provided at the meeting. The Planning & Zoning Commission recommended approval of this item at their June 5, 2014 meeting, subject to the presented renderings and staff report; and granting the requested variance. Also, noting the applicant's willingness to also present a green color option for the awning to the Council. ACTION NEEDED: 1. Conduct a public hearing 2. Southlake Blvd., B-100 LEGAL DESCRIPTION: Lot 3, Block 1, Cornerstone Plaza LAND USE CATEGORY: Retail Commercial CURRENT ZONING: "S-P-2" Generalized Site Plan District HISTORY: -An "S-P-2" zoning request and a concept plan were approved by City Council on March 6, 2001. (ZA00-140) -A Preliminary Plat was approved by City Council on February 20, 2001. (ZA00-141) - City Council approved a revised zoning and concept plan on February 12, 2002. (ZA01-121) - City Council approved a site plan on July 15, 2003. (ZA03-026) - City Council approved a plat revision on July 15, 2003. (ZA03-027) - City Council approved a site plan for a similar awning at Apeizza e Vino on February 3, 2013; accepting P&Z's recommendation for forest green awning color (instead of black), pitch of the awning to be four - feet, approving the variance for the masonry column requirement and accepting the existing fence color and materials for the proposed posts supporting the awning. (ZA13-141) CITIZEN INPUT: No SPIN Meeting was held for this request. Public hearings will take place at the Planning and Zoning Commission and City Council meetings. SOUTHLAKE 2030 PLAN: Consolidated Land Use Plan Under the Southlake 2030 Consolidated Land Use Plan the subject property is designated as Retail Commercial. The proposed development is consistent with the underlying land use. TREE PRESERVATION: No trees will be affected by this development. P&Z ACTION: June 5, 2014; Approved (5-0) subject to the staff report dated May 30, 2014; granting the variance request, noting the columns for the awning will be 32" in height and that the width and depth of the columns will be substantially similar to the submitted rendering. Also, approving the red awning but noting the applicant's willingness to also present the green awning for City Council's consideration. STAFF COMMENTS: Due to the limited scope of this request, a staff review was not generated. Presently we have an outside metal fence (enclosing the patio) and we would prefer to use the structural support columns of the same material as the fence (welded to existing fence) to support the proposed awning. Apeizza e Vino in our same shopping center recently installed the same type of structure. We are using the same awning contractor and structural engineer as was used with Apeizza to insure a consistent look in exterior decor for the property.
