The Grove REQUEST: Dove 114 Infinity, LLC is requesting a variance to the Sign Ordinance No. 704-F regulations for sign height and sign area for two temporary land signs. Specifically, the applicant is requesting an extension on the approval of two existing temporary land signs formerly approved as The Grove, a future mixed use development, located at 500 W. State Highway 114. All previously approved parameters remain the same. The first sign (1A) is located at the southeast corner of Dove Street and State Highway 114 frontage road. The second sign (1 B) is located approximately 1200 feet south of the first sign and faces the S.H. 114 frontage road. The signs were originally approved by City Council on August 21, 2007; and extended in 2010 for two years and again in 2012 for two years. The applicant is requesting a renewal for two additional years. S.H. 114. February 2006 — City Council approved sign variances for Aventerra signs on this site. In 2007, the sign face was changed to The Grove. August 21, 2007 - City Council approved two large temporary signs for The Grove for a period of 1 year (SP07-233A). August 3, 2010 — City Council approved an extension of the previously approved variance for a period of 2 years. That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. Applicant is requesting a time extension for the size and locations of existing temporary signs. It is applicant's opinion that smaller (48 s.f.) signs would be insufficient and ineffective due to the size of the property (54 acres) and its location on Highway 114. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self-imposed. Elevation disparities (Between the land and adjacent roadway), setbacks and surrounding thick vegetation on the subject property dictate that signs of this size are required for adequate visibility and effective communication of the developer's intent. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. It is important for these signs to be large enough to convey the magnitude of this project and ensure that nearby current and prospective residents will be alerted and informed. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. In these two locations, these temporary signs will appear appropriately sized and will serve to inform the community as well as to stimulate beneficial economic activity during the development period.
