Item 4I13 IT SOU LA 1<,,E Department of Planning & Development Services STAFF REPORT June 11, 2014 CASE NOS: ZA13-050, ZA13-051 and ZA13-052 PROJECT: Final Plat for Carillon Phases 5A, 513 and 5C EXECUTIVE SUMMARY: Hines-GTIS Carillon LLC is requesting a Variance to Subdivision Ordinance No. 483, as amended, regarding plat expiration, requesting to extend the validity of cases ZA13- 050, ZA13-051, ZA13-052, Final Plats for Carillon Phases C, B and A, respectively. REQUEST: A Final Plat which has not been recorded in the County Plat Records within one (1) year of the date of approval shall expire. The Final Plats for Carillon Phases 5A, 5B and 5C were approved by the Planning and Zoning Commission on May 23, 2013. The Plats have not been filed and therefore have passed the expiration deadline. All three subdivisions are currently under construction. The applicant is requesting to extend the validity of the Plats for an additional six (6) months to have time to complete the streets and infrastructure. If the requested variance is approved by City Council on June 17, 2014, an expiration date of November 23, 2014 shall be adopted. Chivers Survey, Abstract No. 299 LAND USE CATEGORY: Mixed Use CURRENT ZONING: ECZ — Employment Center Zoning District HISTORY: -The City Council approved a zoning change request and concept plan to "NR- PUD" on May 20, 1997. -The City Council approved a zoning change and concept plan on December 18, 2001, requiring a 300' setback on Carroll Avenue, subject to City Council discretion. The purpose of the zoning change and concept plan was to incorporate newly acquired tracts of land into the existing "NR-PUD", revise parcel boundaries and permitted uses within the district. - The City Council approved "ECZ" Employment Center Zoning District and a development plan on November 18, 2009. -A preliminary plat (ZA09-010) showing four hundred twenty-three total lots was approved May 5, 2009. -A revised preliminary plat for the Chateaux District was approved October 2, 2012. - A Final Plat for Phase 5C (ZA13-050) was approved by the Planning and Zoning Commission on May 23, 2013. - A Final Plat for Phase 5B (ZA13-051) was approved by the Planning and Zoning Commission on May 23, 2013. - A Final Plat for Phase 5A (ZA13-052) was approved by the Planning and Zoning Commission on May 23, 2013. STAFF COMMENTS: The Final Plats were not filed within one year of their approval date and they have expired. Because the plats have expired, a variance to the plat expiration is being requested.
