2014-04-24 7 CITY OF 6 SOUTHLAKE 1 TEXAS ZONING BOARD OF ADJUSTMENT MEETING: April 24, 2014 LOCATION: 1400 Main Street, Southlake, Texas City Council Chambers of Town Hall Regular Session: Members Present: Vice Chair John Huffman, Board Members Ron Evans, Kourosh Panahy, Eric Ransom, Scott Dyche, Brad Cunningham, Paul Lepicier and Mike Smietana. Members Absent: Chair Paul Veneskey Staff Present: Dennis Killough, Deputy Director of Planning & Development Services; Richard Schell, Principal Planner, and Erica Wilson, Board Secretary Agenda Item No. 1 — Call to Order: Vice Chair John Huffman called the meeting to order at 6:30 p.m. Agenda Item No. 2 — Approval of the Minutes: Vice Chair John Huffman opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on April 10, 2014. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on April 10, 2014. Motion: Panahy Second: Lepecier Ayes: Ransom, Smietana, Evans, Dyche, Panahy, Cunningham, Lepecier, and Huffman Nays: None Abstain: None Vote: 8 -0 -0 Motion: Carried Agenda Item No. 3 — Administrative Comments: Richard Schell, Principal Planner, announced the next regularly scheduled ZBA meeting will be held on May 15, 2014. Planner Schell requested that the Board members note the meeting date on their calendars. Agenda Item No. 4 — ZBA -658, Special Exception Use per Ord. No. 480, Section 44.12(2) for the construction of accessory buildings or structures of a size or aggregate size greater than that permitted by the accessory building requirements of the zoning district on property described as Lot 7, Block 1, Stanhope Addition, an addition to the City of Southlake, Tarrant County, Texas and located at 1260 Stanhope Ct., Southlake, Texas. Current Zoning: SF -1A — Single Family Residential District. Planner Schell presented details of the case to the Board, requesting approval of a Special Exception Use per Ordinance No. 480, Section 44.12(2) for construction of accessory buildings Zoning Board of Adjustment Meeting Minutes - April 24, 2014 Page 1 of 4 or structures of a size or aggregate size greater than permitted to allow construction of an approximately 1,296 square foot garage /pool house. Zoning Ordinance No. 480, Section 11.5.j.1.i allows a maximum lot coverage of 3% or 4,000 square feet for the sum total of all accessory structures and buildings on the lot. Three percent of the lot area in this case is approximately 1,307 square feet. When added to the lot coverage of the existing 333 square foot storage shed, the addition of the covered garage /pool house brings the sum total of all accessory buildings and structures to approximately 1,629 square feet, or approximately 3.7% of the lot area. Once Planner Schell answered the Board's questions, the staff presentation was complete. Vice Chair Huffman opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Alicia Wagner, 1260 Stanhope Court, Southlake, TX, the applicant and owner of the property, once sworn in, presented testimony and was available to answer questions of the Board. Once the applicant completed his presentation, Vice Chair Huffman asked if there were those in the audience who wished to speak in favor of the request. There being no one, Vice Chair Huffman asked if there were those in the audience who wished to speak in opposition of the request. There being no one, Vice Chair Huffman closed the public hearing and opened the item for discussion. A motion was made to approve case ZBA -658. Motion: Panahy Second: Lepecier Ayes: Evans, Dyche, Panahy, Cunningham and Huffman. Nays: None Abstain: None Vote: 5 -0 -0 Motion: Carried Agenda Item No. 5 —: ZBA -659, Variance to Ord. No. 480, Section 34.1(f) requiring pools (other than ornamental pools or ponds designed for decorative purposes and having a depth less than twenty -four (24) inches) to not be located forward of the principal building on the lot on property described as Tract 1 B1 B, Thomas J. Thompson Survey, Abstract No. 1502, City of Southlake, Tarrant County, Texas and located at 2300 W. Continental Blvd., Southlake, Texas. Current Zoning: AG — Agricultural District. Planner Schell presented details of the case to the Board, requesting approval of a Variance to Ord. No. 480, Section 34.1(0 requiring pools to not be located forward of the principal building on the lot to allow construction of a pool forward of the principal building as depicted on the plot plan. Planner Schell was then available to answer question of the Board. Once Planner Schell answered the Board's questions, the staff presentation was complete. Stephanie B. Lomme, 2300 West Continental Boulevard, Southlake, TX, the applicant and owner of the property, once swom in, presented testimony and was available to answer questions of the Board. Once the applicants completed their presentation, Vice Chair Huffman asked if there were those in the audience who wished to speak in favor of the request. There being no one, Vice Chair Huffman asked if there were those in the audience who wished to speak in opposition of the request. Anthony Seris, 2100 West Continental Blvd., Southlake, TX, a neighboring homeowner, once swom in, expressed his opposition for the project. Having heard the comments and presentation for those in opposition, the applicant gave a rebuttal. After the applicant's rebuttal, Vice Chair Huffman closed the public hearing and opened the item for discussion. A motion was made to deny case ZBA -659. Motion: Dyche Second: Lepecier Ayes: Evan, Dyche, and Cunningham.
