Commissioner Parrish asked why Johnson Elementary was selected. Mr. Miller explained the choice. Chairman Hudson asked about the grant. Dr. Renee Moses, 805 Shorecrest Drive explained the grant and how it works. Commissioner Parrish asked about the technology and science behind the project. Dr. Moses explained the technology Commissioner McCaskill asked about the masonry variance. Mr. Miller explained the masonry variance in regards to the heat and how it affects the telescope. Commissioner Kubiak asked if the grant was covering the project completely. Ms. Moses stated yes. Chairman Hudson opened and closed the public hearing. PUBLIC HEARING Lorrie Fletcher, Planner I presented Item No. 8, ZA13 -005. Brook Bloomstring with Duff's Wings at 1400 New Castle Road came forward. Chairman Hudson asked about the column width and the color of the awning and whether or not the awning would cover the existing patio. Ms. Bloomstring stated that she did not have the exact dimensions but the drawings that the Commission has is drawn to scale. The color would match the brick but the color is changeable and yes the awning will cover the existing patio. Chairman Hudson asked about fans and /or misting equipment. Ms. Bloomstring stated that none would be installed at this time. Motion to approve ZA13 -005 subject to the Staff Report dated May 30, 2014 and granting the requested variance; Zoning Ordinance No. 480, as amended, Section 43.c.1.e, Corridor Overlay Zone and noting the columns for the awning will be 2 feet, 8 inches tall and 32 inches with the depth matching the renderings given. Also noting the applicant's willingness if Council so asks to change the color of the awnings to green. Mason McClatchy with KTR Capital Partners located at 15950 N Dallas Parkway came forward. Mr. McClatchy presented the changes to the plan and explained the requested variances. Commissioner Kubiak stated that the changes that were formally requested have been addressed and continued to ask about the rental cost of the spaces. Another question was regarding the dock doors. Mr. McClatchy stated $5.00 a square foot for rental. Regarding the dock doors, they are drive in dock doors with ramps. Chairman Hudson asked about the vertical articulation. Mr. McClatchy stated that they were not aware they were not compliant until this afternoon and that changes will be made to become compliant. Chairman Hudson opened and closed the public hearing. Motion to approve ZA14 -004 subject to the Site Plan Review Summary No. 5 dated June 5, 2014 and Staff Report dated June 5, 2014, noting the following; 1) The applicant has agreed to close the existing adjacent driveway (off Kimball) to the property to the east, 2) The west and east driveways will each have a right turn only medians, 3) The applicant will comply with the vertical articulation requirements pursuant to our ordinance, 4) Noting there will be a right turn dedication or right turn only lane installed at SH 26, and 5) Granting each of the requested variances as presented for driveway stacking and spacing, and tree preservation. Ms. Rivera stated that she is available to answer any questions that the Commission may have. Chairman Hudson asked about the timeframe to start construction. Ms. Rivera stated they would like to start communication with staff once they have approval. Commissioner Kubiak asked about previous agreements that were made with the neighbors. Dennis Killough stated that all agreements will remain in place. Ms. Rivera agreed. Chairman Hudson opened the public hearing. John Huffman, 1991 E Highland came forward. Mr. Huffman expressed concern about getting access to the greenbelt and the preservation of the trees along the property line. Chairman Hudson closed the public hearing. Tom Dwyer with Silverstone Development Company located at 3710 Rawlines Street came forward with Javier Jaramillo with Pacheco Koch located at 8350 N Central Expressway. Chairman Hudson asked about the open space behind the property. Mr. Dwyer stated that due to the flood plain they didn't plan to add anything in that area, specifically buildings. They may place walking trails though. Chairman Hudson asked about the building heights. Mr. Dwyer stated that the facility will be three -story with the exception of the memory care which will be single story. Chairman Hudson opened the public hearing and read aloud the comment card. Sarah Planning and Zoning Commission Meeting Minutes -June 5, 2014 Page 7 of 12 Khan M.D. with Onsom Medical Center located at 630 E SH 114 is in opposition but did not wish to speak. Chairman Hudson closed the public hearing. Commissioner Parrish asked if the applicant would be willing to closing off the access to Highland Street once Kirkwood Boulevard is built out. Mr. Dwyer stated that it would be a possibility and would be open to it. Commissioner Kubiak suggested a right in, right out entrance /exit could also be a possibility. Mr. Melbourne stated that he is hopeful to be able to use the panels to generate complete power for the entire house. The goal is to reach net zero energy. Mr. Whitehead explained the kw hours for the panels. Commissioner McCaskill asked about the size of the panels. Mr. Whitehead stated that they are 17 square feet in size. Mr. Melbourne stated that the panels cannot be seen from the road and the line of site from the neighbors is very little. Mr. Whitehead explained elevations.
