CITY OF SOUTHLAKE Department of Planning & Development Services STAFF REPORT May 28, 2014 CASE NO: ZA14-048 PROJECT: Specific Use Permit for a Mass Gathering Event — Oktoberfest EXECUTIVE SUMMARY: The Southlake Chamber of Commerce is requesting approval of a Specific Use Permit for a Mass Gathering Event for Oktoberfest on property described as Phases I -IV, Southlake Town Square, City of Southlake, Tarrant County, Texas and being located between E. Southlake Boulevard, E. S.H. 114 and N. Carroll Avenue, Southlake, Texas. Current Zoning: "DT" Downtown District. SPIN Neighborhood # 8. REQUEST: The Southlake Chamber of Commerce is requesting approval of a specific use permit (SUP) for a mass gathering event for Oktoberfest. The previously approved SUP expired following the October 2013 event. The 2014 event space will encompass the same boundary used in previous years. The attendance is expected to remain the same as the 2013 event which reached 75,000 over the course of three days. This will be the 13th year for this Southlake Chamber of Commerce hosted event. There are no changes to the previous year being proposed other than an earlier access to the park area which has been approved through Community Services and Southlake Town Square management. The 2014 Event Schedule is as follows: Friday, October 3 5 P.M. — 11 P.M. Saturday, October 4 10 a.m. — 11 p.m. Sunday, October 5 12 p.m. — 5 p.m. This event has been held annually since 2002. The previous approval by City Council on June 21, 2011 allowed the event to be held for three (3) consecutive years with the Director of Planning & Development Services having the ability to review conditions and provide revocability at their discretion. The applicant is requesting that the event be permitted for five (5) years unless such time as there are changes in the scope or conditions of approval. ACTION NEEDED: 1. Conduct Public Hearing 2. The event is typically held the first Friday, Saturday, and Sunday of October. August 20, 2002 — City Council approved (7-0) SUP's for Special Events (Southlake Town Square NRPUD) and the Sale of Alcoholic Beverages for Oktoberfest for a period of one (1) year (ZA02-069 & ZA02-072). August 5, 2003 — City Council approved (5-0) SUP's for Special Events (Southlake Town Square NRPUD) and the Sale of Alcoholic Beverages for Oktoberfest for a period of one (1) year (ZA03-046 & ZA03-047). August 3, 2004 — City Council approved (5-0) SUP's for Mass Gathering Event (Southlake Town Square DT) and the Sale of Alcoholic Beverages for Oktoberfest for a period of three (3) years (ZA04-052 & ZA04-053). August 21, 2007 — City Council approved (7-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of three (3) years (ZA07-096). The SUP requirement for Sale of Alcoholic Beverages had been eliminated. March 2, 2010 — City Council approved (7-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of three (3) years (ZA10-005). June 21, 2011 — City Council approved (6-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of three (3) years (ZA11-024). Renewal was necessary due to expansion of the event boundary for the Sport Zone, on the west side of Main Street. Other events held annually in Southlake Town Square include: • Stars & Stripes — held annually since 1999; approved in perpetuity. Reference case number ZA13-058. STAFF COMMENTS: Due to the limited scope of this request, no new review letter was generated. The modified site exhibit and detail sheet of the event is included as attachment `C' of this report. The following items have been discussed with the applicant: • The promotional sign plan is under review and subject to approval and permits by appropriate staff for the pavilion banner and small directional signs; the property owner for the banners hung across Main Street; and, TxDOT for the electronic message boards proposed on S.H. 114. • The applicant understands that the small directional signs cannot be placed in the public right of way. The applicant is pursuing permission from the City Engineer to place two of their signs in the median along Carroll Avenue at Federal Way and at Main Street. Pursuant to Section 5.2.5 of Sign Ordinance 704, as amended, permission may be granted by the City for public purposes. These signs are intended to direct traffic to parking areas. • Each year, a current confirmation from the property owner will need to be submitted to the city prior to that year's event. • Any necessary sign and/or tent permits will need to be renewed annually at least 30 days prior to that year's event. In 2013, 75,000 people visited throughout the weekend festival. Attendance is completely free -- there are no admissions or parking fees. German beer and German cuisine highlights the festival as well as many German craft goods for sale. For the not so German there is a variety of other foods and hand crafted arts and craft vendors. All of these activities take place in Southlake Town Square. There is also live entertainment on the Gazebo. There is a Kids Zone with inflatables, train rides, rock wall and other age appropriate activities. The annual wiener dog race will take place on Saturday. All activities and entertainment are consistent with the 2013 event. The only changes we are requesting is access to the Park on Thursday, October 2, 2014 at 9am in order to load in and set up the large tent in the middle of the Park. We will not impact general parking or traffic flow. By allowing earlier access to the Park, we will then be able to complete the entire set up before midnight on Thursday, Oct. 2. In 2013, 75,000 people visited throughout the weekend festival. Attendance is completely free -- there are no admissions or parking fees. German beer and German cuisine highlights the festival as well as many German craft goods for sale. For the not so German there is a variety of other foods and hand crafted arts and craft vendors. All of these activities take place in Southlake Town Square. There is also live entertainment on the Gazebo. There is a Kids Zone with inflatables, train rides, rock wall and other age appropriate activities. The annual wiener dog race will take place on Saturday. All activities and entertainment are consistent with the 2013 event. The only changes we are requesting is access to the Park on Thursday, October 2, 2014 at 9am in order to load in and set up the large tent in the middle of the Park. We will not impact general parking or traffic flow. By allowing earlier access to the Park, we will then be able to complete the entire set up before midnight on Thursday, Oct. 2.
