Background
Information: The purpose of this item is to approve Change Order No. 3 with
Wilson Contractor Services, LLC in the amount of $29,427 for the
Water and Sanitary Sewer Relocations for FM 1938. The contract
for this project was awarded by City Council on August 20, 2013 in
the amount of $1,845,378.
Change Order No. 1 was added to the project for the purpose of
constructing approximately 2,000 linear feet of 8 inch waterline
along W. Bob Jones Road. This waterline installation was
accelerated in order to provide an area resident the opportunity to
begin construction on a new home. Previous to this project, City
water service did not exist in this area and as a result necessary
fire protection was not provided. To expedite the construction of
the waterline, Change Order No. 1 was executed through the City
Manager's signatory authority and Wilson Contractor Services, LLC
began construction of the waterline.
Change Orders No. 2 and No. 3 were requested by the City of
Keller. Change Order No. 2 was for the addition of a reinforced
concrete pipe under Fawkes Lane as part of the street repair after
the waterline was installed. Change Order No. 3 was for a revision
to avoid the proposed storm drain design for FM 1938. Keller also
requested the 6 inch waterline to be upgraded to an 8 inch on
Fawkes Lane and include water services to all properties as
needed. Two additional connections were also added between
Wildwood Way and Brookforest Drive. To satisfy City of Keller
Item 413
specifications; a polypig (internal pipe scrubber) was added to
clean the waterlines before testing.

The City of Keller will reimburse the City of Southlake a total of
$30,627 for Change Orders No. 2 and No. 3 as specified in the
Interlocal Agreement (ILA) between the two cities. The ILA was
executed on July 17, 2013 and the construction contract was
awarded by City Council on August 20, 2013.
Financial
Considerations: This project is being funded from the Capital Improvement Program
Utility Fund which was approved between 2007 and 2009 Capital
Improvements Program budgets.
The W. Bob Jones Road waterline extension is being funded by a
separate adopted fund budget.
Change Orders No. 2 and No. 3 will be fully funded by the City of
Keller.

Project links to the city's strategy map relative to the focus areas of
Infrastructure and Performance Management & Service Delivery by
collaborating with select partners to implement service solutions

This Agreement is made by and between the City of Southlake, Texas ("Southlake") and the
City of Keller ("Keller"), acting herein by and through their duly authorized city managers, for the
purpose of documenting the terms and conditions of an agreement whereby Southlake will
administer the engineering design contract and the construction contract for the water line and sewer
line relocations associated with the construction of FM 1938 to be known as the FM 1938 Water
Line and Sanitary Sewer Relocation Project ("Project") and the cities will apportion the local cost
share for the design and construction of the Project as indicated in Exhibit A.
WHEREAS, Chapter 791, Texas Government Code authorizes Interlocal Contracts between
governmental entities to perform services either could undertake individually; and
WHEREAS, Southlake and Keller desire to design and construct the FM 1938 Water Line and
Sewer Line Relocation Project; and
NOW, THEREFORE,
WITNESSETH
Southlake shall provide administration for an engineering services agreement for design of
the Project.
2. The cost for the engineering design of the Project is a lump sum basis in the amount of
$208,500 for Basic Services and for Utility Coordination on an hourly basis plus expenses
amount not to exceed $120,000 with a total not to exceed cost ceiling of $328,500. The
share of the cost for the engineering design required from each city will be divided as
indicated in Exhibit A.
3. The City of Keller shall reimburse their share of the engineering design fee in a lump sum
payment to the City of Southlake prior to the start of construction.
4. Southlake shall provide contract administration for the construction of the Project.
5. The estimated construction cost for the Project is $3,219,238. Actual construction costs
shall be paid in full by each responsible City for their share of the construction being
completed within their respective city limits.
6. The City of Keller agrees to make payments to Southlake within a reasonable length of time
estimated at 30 days after receipt of construction invoices.
7. In the event there are additional design costs or expenses involved in the engineering design
contract, the parties agree to share such costs proportionally in the same manner as used for
the initial design cost sharing identified in Exhibit A.

8. Each City shall pay any additional construction costs on their respective portion of the
project and shall pay their respective percentage share per Exhibit A of any construction
cost not specifically attributed to one City's improvements.
