SPIN Neighborhood #4 DETAILS: Abundant Grace Church is requesting approval of a site plan for a restroom addition of approximately 400 square feet to an existing church and Montessori school. The school will have kindergarten through second grade students. The proposed development consists of one (1) existing building and one (1) existing shed on 1.15 acres with frontage on E. Dove Road and Creekside Drive. The plan also shows the addition of a porch covering on the front of the building, improvements to existing parking areas and designates outdoor play areas. The development details are noted in the applicant's narrative in Attachment `C' of this staff report. Variances The applicant is seeking a variance request to Section 39.6, Screening and Fencing, for the required solid screening adjacent to residential properties. The variance request is to allow a 6 ft. existing wood fence along the north and northeast property line, allow a 6 ft. metal fence with shrubs along a portion of the east property line adjacent to the north parking lot, and to allow a 6 ft. wood and metal fence along portions of the west property line. Setbacks / Yards: No non -single family residential building may encroach in the area above a line having a slope of 4:1 from any single-family residential property. However, a structure may be built up to within 40 feet of the residential property line, provided that the structure is no greater than one story or 20 feet in height. (See Exhibit 43-E for clarification.) The new addition must be a minimum of 40 feet from the west property line. The plan proposes approximately 33 feet. Phone: 817.756.7490 Abundant Grace Church Request for a Variance in Zoning Ordinance 480 Section 39 Abundant Grace Church, Incorporated requests of the City of Southlake variance in the Fencing Zoning Ordinance 480 Section 39 which requires a solid fence meeting the material standards of Section 39.2 erected along the side property lines abutting a residential lot to a height of eight (8) feet. Abundant Grace Church owns property located at 1970 E. Dove, Southlake, Texas 76092 in which the Northeast fence line is approximately 145 feet in length and half of which is abutting a residential lot. Abundant Grace Church's request is that we be allowed a variance in the zoning to construct the rear northeastern portion of fence (6 feet X 82 feet) in wood and allow for the remainder of (6 X 63 feet) in wrought iron on the street side of our property. The rationale for this request are based on two concepts: • Safety of students (we run a small Christian Montessori School); wrought iron in the front of the northern property would allow for complete viewing of pedestrians on entering the property. If constructed as required (solid wood) pedestrian traffic would be obstructed. • Neighborhood Aesthetics — the front portion (wrought iron fencing) fits in with the surrounding neighborhood as most of the resident have wrought iron fencing on the street side of properties. We pray that the City Planning & Zoning Commission and the Southlake City Council would approve this request. Most importantly there are existing trees within and around the proposed parking on the south side of the building. These trees are not shown on the plan. Please provide a color Tree Conservation which shows the correct location, trunk diameter, and species of the existing trees, particularly the trees in the vicinity of any proposed construction. If the parking area north of the building is not being reconfigured the trees around it and along the creek do not need to be surveyed. Just the trees south of the building will need to be surveyed. Green = Preserved Yellow = Borderline Red = Altered/Removed Please be aware that all existing trees shown to be preserved on the City Council approved Tree Conservation Plan must be preserved and protected during all phases and construction of the development. LANDSCAPE COMMENTS: The proposed building addition is 356 square feet and does not exceed 30% of the existing building square footage. Additional requirements may be necessary with the review of civil construction plans. Submit preliminary water, sewer, drainage and grading plans for this development. Grading plan shall include 2' contours. Contours may be obtained from the City of Southlake. Note 8 on Sheet A010 states: GC to verify existing pavement condition adjacent to new construction and extend paving as needed. Paving limits on this site shall be clearly labeled on the plan sheets. Street intersections shall comply with TDLR/ADA accessibility standards. Sight distances shall comply with AASHTO guidelines on adjacent collectors and arterials. Use the City of Southlake GPS monuments whenever possible. Monument locations can be found in the City of Southlake website: http://www.cityofsouthlake.com/index.aspx?NID=266 EASEMENTS: 1. Provide all necessary easements for water, sanitary sewer and drainage. Easements shall be 15' minimum and located on one lot — not centered on the property line. A 20' easement is required if both storm sewer and sanitary sewer will be located within the easement. 2. Detention ponds shall be dedicated by plat as drainage easements. The following note shall be added to the plat: Compliance with the provisions of the city's Storm Drainage Policy does not relieve a person of the responsibility of complying with all other applicable laws, including, but not limited to, Section 11.086, Texas Water Code. Water and sanitary sewer cannot cross property lines without being in an easement or right of way. All waterlines, sanitary sewer and storm sewer in easements or right of ways must be constructed to City standards. WATER COMMENTS: Fire lines shall be separate from service lines. SANITARY SEWER COMMENTS: 1. Sanitary sewer is located on Creekside Dr. but this development cannot discharge into it due to downstream conditions. This development shall continue to operate with a septic system. DRAINAGE COMMENTS: 1. Site plan shows an area to be paved at the front of the building which is currently permeable. Any increases in impermeable area may result in increased runoff downstream. Discharge of Case No. Attachment D ZA14-038 Page 5 post development runoff must have no adverse impact on downstream properties and meet the provisions of Ordinance No. 605. 2. Increases in runoff may require detention. Differences between pre- and post- development runoff shall be captured in a detention pond. Proposed detention ponds shall control the discharge of the 5, 10 and 100- year storm events. Detention may be required with any new proposed building construction. 3. Documentation supporting and certifying that detention is not necessary will be required prior to approval of construction plans if impermeable areas are increased. INFORMATIONAL COMMENTS: * Submit 22"x34" civil construction plans and a completed Construction Plan Checklist directly to the Public Works Administration Department for review. All lighting must comply with the Lighting Ordinance No. 693, as amended. All development must comply with the Drainage Ordinance No. 605 and the Erosion and Sediment Control Ordinance No. 946, as amended. Development must comply with all requirements in Zoning Ordinance No. 480, Section 43,; Overlay Zones. Our daughter has had personal experience with this and we have heard (and heard, and heard,...) the stories...I Concerns re outdoor play area/traffic safety: • Outdoor play area's proximity to high -traffic Dove is a potential safety hazard if a child were to "escape"; • Outdoor play area's proximity to neighbors' back yards negatively impacts the naturalistic quiet and ambience of neighborhood; • Outdoor play area has potential to distract drivers ALREADY DISTRACTED BY: 1. Speeding drivers-30mph posted speed is REGULARLY EXCEEDED; 2. Cyclists —are frequently on Dove, causing traffic backups and dangerous passing situations (I have personally been almost hit head-on, as I slowed to a stop, by someone passing a cyclist and apparently paying NO attention to oncoming traffic!); 3. Pedestrians and NO SIDEWALKS —that portion of Dove is NOT pedestrian -friendly, but it is very busy due to children from local neighborhoods and the draw of Yates Corner Grocery and the snow cone stand. 4. School buses —there are MANY schoolbuses that would be traversing the area during the same hours that the proposed school's parents would be transporting their children. Traffic on Dove is notorious for NOT stopping for schoolbuses (we know a family who's child was hit trying to cross Dove to get on the schoo!bus), so the school district's solution has been to have TWICE AS MANY SCHOOLBUSES: ONE bus for the children on the north side of Dove, and ANOTHER (different) bus for the children on the south side of Dove; 5. Large truck traffic —Dove used to be a "no truck" road but not anymore, due to the many construction projects in the area, as well as the large delivery trucks that have to maneuver in Yates Corner Grocery. 6. Large quantities of TRAFFIC on Dove —because it's an alternative route to Highway 114, the local gas station for lake vehicles, AND the snow cone stand. Please note that ALL of the above (SIXI) driver distractions are also a concern relating to the increase of traffic due to parents delivering and picking up the children at the school. There is a creek between my property and the church property. The church/school property is uphill from me. Seventeen years ago 1 built an 8 foot fence along my property boundary in the creek, even with the 8 foot fence, anyone standing on the church property can see in all of my windows. I will have no privacy seven days a week. 2. The headlights from all of the cars that plan on visiting the church/school will shine directly into the backside of my house. 3. My fence, which I built on my property, (several inches off of the property line) at my expense, was not built to be used as a playground boundary. It is not strong enough to keep 50+ kids contained. If it fails, or someone is injured because of their kids playing on it, am i now responsible? 4. The church does not have a fence along its Western boundary with the Creek, south of the termination of my fence. How will they keep litter and kids out of the creek, and from entering my property? Am I liable if they are injured while trespassing on my property? 5. From my kitchen table, it is it is 90 feet to the center of their Northern playground. To build that playground, as depicted on their plans, they will have to remove a minimum of 18 mature Oak trees. Whatever visual barrier those trees offered me will be lost. Also the loss of those trees will worsen erosion down that slope. 6. 1 have to work at night occasionally, how will l sleep during the day with kids playing 100 feet away? **The following apply to all in the neighborhood" 7. Even after the new owner had been instructed by Paul Ward, the Chief Building Official for the City of Southlake, on the proper procedures for obtaining permits, he was found (on 411512014) to be demolitioning the interior of the property without permits. Was asbestos removed without OSHA approved procedures/permits? 8. The property in question has never been used for anything approaching the scale of operation the school intends. 1 myself and a lot of others in the neighborhood would never have bought my home if a school of this magnitude was there in the first place. 9. Additional traffic on an already heavily travelled Dove Read, which will make it more difficult for traffic attempting to get onto Dove from our neighborhood 10. Access to Dove Road will be impeded for Emergency Vehicles (Police/Fire/Ambulance) 11. School Bus routes traversing Dove Road will be impacted by traffic delays. 12. Carpool lines will be forced onto Creekside, which is not wide enough for normal traffic plus parked cars on both sides. 13. No Parking signs will be needed on the East side of Creekside to ensure proper flow of traffic. 14. Property values will be lowered by heavy traffic and No Parking signs on Creekside. This will affect the surrounding streets as well when depressed sale prices on Creekside become the comps used for local appraisals. 15.
