EXECUTIVE
SUMMARY: The Carroll ISD is requesting approval of a Specific Use Permit for a clothing
donation bin to be placed at Durham Intermediate School located at 801 Shady
Oaks Drive, on approximately 30 acres. SPIN #7
DETAILS: The Carroll ISD is seeking approval for a clothing donation bin to be placed on the
school property. The clothing donation bin will be located on the east parking lot at
the rear of the school. The donation bin for clothing items is proposed as a
fundraiser for a school recycling projects and as a community service project.
Specifications of the clothing donation bin are provided under Attachment "C" of
the staff report.
Due to the limited scope of this request, information on the site location, bin
specifications, and photographs for the project are included in this Staff Report and
the Presentation.

Specifications for the Donation Bin
Carroll ISD Donation Bin at Durham Intermediate
1. Start date -end date: Spring 2014-ongoing
2. Purpose of the bin: One goal of the shoes and clothing bin at Durham is to raise funds for the Durham
Intermediate Recycling Club. Funds received will be used to buy recycle bins for Durham classrooms and
any other supplies the club might need. Another goal is to encourage community outreach to our
students and to teach the importance of recycling. The donation bin will help serve as a reminder for our
students that life must be emphasized in the context of personal expectations, a positive environment,
and a strong sense of community outreach.
3. Maintenance plan: Routes are run every week by professional and courteous truck drivers. The goal is
to visit each one of our bins every three days. The drivers will check on and take pictures of each bin to
document any damage or vandalism. They will also be equipped to remove any graffiti that might be left
on the bin.
4. Proposed bin dimensions
a. Capacity in cubic feet: Each bin is made of heavy -gauge steel and weighs 560 pounds. There are
two size bins; 164 cf and 89 cf. The larger bin holds 800-900 pounds of clothing and the smaller
bin holds 350-500 pounds of clothing.
b. Labeled distance from the property line: The Bin will be inside our property and to the back of
the Durham Campus, approximately 450 If from the south property line.
c. Labeled dimensions of the bin: The larger bin is 72" W x 45" D x 76" H (164 cf) and the smaller
bin is 45"W x 45" D x 76" H (89 cf).

Please note: Section 45.4, General Requirements: A specific use permit shall automatically expire
if a building permit is not issued and construction begun within six (6) months of the granting of the
specific use permit or if the use shall cease for a period of six (6) months.

45.13 SPECIFIC REGULATIONS FOR DONATION BINS
a. A donation bin shall be permitted only as an accessory use to the principal use
established on the lot or tract of land.
b. The applicant must disclose the intended recipient of collected items and the
percentage of funds collected or goods collected which will be paid or given to a
charitable organization.
c. The applicant must submit written permission of property owner consenting to the
erection and maintenance of the donation bin.
d. The specific use permit shall provide that the permit holder shall:
1) keep the area around the bin free of litter;
2) remove graffiti from the bin within 48 hours of discovery; and
3) maintain the bin painted or otherwise unrusted and undented and in good repair.
e. A minimum lot size of 43,560 square feet is required to locate a bin.
f. No more than one bin may be maintained on a lot.
g. A bin shall not be located closer than 1,000 feet to another bin.
h. A bin must be at least 300 feet from the property line of a school.
i. The location of a bin shall not reduce the minimum parking requirements or
effectiveness of landscaped areas within the site.
j. A bin shall not exceed a capacity of 512 cubic feet.
k. A bin must be cleared of contents at least once every two (2) weeks.
I. Bins must be safely designed in a manner that prevents the tipping over and prevents
children from entering inside the bin.

m. Each bin shall bear the name and phone number of the owner and all charitable
organizations which benefit from the collected materials.
n. All collected items must be fully contained within the bin.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR
A CLOTHING DONATION BIN ON PROPERTY WITHIN THE CITY
OF SOUTHLAKE, TEXAS, LOCATED AT 801 SHADY OAKS
DRIVE, BEING DESCRIBED AS LOT 1, BLOCK 1, CARROLL ISD
#1 ADDITION AS DEPICTED ON THE APPROVED SITE EXHIBIT
ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT
"A" AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for a clothing donation bin on Carroll ISD property has
been requested by a person or corporation having a proprietary interest in the property zoned as
"CS" Community Service District; and,
WHEREAS, in accordance with the requirements of Section 45.1 (45) and 45.17 of the
City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City
Council have given the requisite notices by publication and otherwise, and have afforded the
persons interested and situated in the affected area and in the vicinity thereof; and,
WHEREAS, the City Council does hereby find and determine that the granting of such
Specific Use Permit is in the best interest of the public health, safety, morals and general
welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for a clothing donation bin on property located at
801 Shady Oaks Drive, being described as Lot 1, Block 1, Carroll ISD #1 Addition as depicted
on the approved Site Exhibit attached hereto and incorporated herein as Exhibit "A" and
providing an effective date, subject to the provisions contained in the comprehensive zoning
ordinance and the restrictions set forth herein.

SECTION 2.
This resolution shall become effective on the date of approval by the City Council.
