Matt Miller with CISD located at 3051 Dove Road in Grapevine and Jon Fike, Principal of Old Union Elementary located at 1050 S Carroll Avenue and Eileen Burnbom with World Wear Projects located at 10777 Shady Trail, Dallas came forward to answer any Planning and Zoning Commission Meeting Minutes -April 17, 2014 Page 2 of 10 questions. Mr. Miller explained the process and how the schools will benefit and specifically that the majority of the donations will come from students and their families. Mr. Fike agreed. Chairman Hudson explained his concern regarding a time limit on the project. Mr. Fike and Mr. Miller agreed. Ms. Burnbom gave examples of other schools with this project and how much money they have been able to make. Commissioner Kubiak asked what about some of the other districts that are doing this. Mr. Miller stated that Plano and Arlington were just some of the larger districts. Chairman Hudson opened and closed the public hearing. SPIN Neighborhood # 9. PUBLIC HEARING Principal Planner, Richard Schell presented Item No. 8, Ordinance NO. 480 -643A, (ZA14 -037). Stephen Coslik with Woodmont located at 2100 West 7 Street, Fort Worth came forward with a new presentation showing the landscape changes needed. Aaron Duncan with Mesa located at 1807 Ross Avenue to discuss the landscaping and tree choices. Dennis Killough asked the applicant about utility easement allowance regarding landscaping and trees. Mr. Coslik provided a letter from ONCOR regarding the utility easement and what is allowed to be planted there. Commissioner McCaskill expressed concern that the new plan is still short of trees that are required by ordinance. Commissioner Kubiak agreed. Mr. Coslik stated that they are willing to comply with the ordinance. Chairman Hudson opened and closed the public hearing. Commissioner Forman agreed that the ordinance needs to be met in regards to the amount of trees that are required to be planted. Mr. Coslik asked the Commission to consider them bringing forth a new plan to City Council that would comply with the ordinance. PUBLIC HEARING Richard Schell, Principal Planner presented Item No. 10, Ordinance No. 480 -664, (ZA14- 031). Jeff Presnal with Cypress Brook Company located at 1776 Woodstead Ct. in Spring, TX came forward to present the development including the landscaping, site plan and elevations. Lorrie Alford with Avanti Senior Living located at 26113 Oakridge Drive in The Woodlands, TX came forward to introduce Avanit Senior Living and the services provided. Chairman Hudson asked about decibel noise reduction. Mr. Presnal explained the glazing standards on windows adding the tolerance for decibel levels. Commissioner Kubiak asked about the flexibility of operations so that they do not correspond with the school traffic across the street. Ms. Alford stated that flexibility would be implemented to avoid large traffic all at once on Planning and Zoning Commission Meeting Minutes -April 17, 2014 Page 5 of 10 Kimball Avenue. Commissioner Kubiak continued to express concern about the trees and landscaping. Another item that he addressed was cross access easement possibility. Mr. Presnal stated that they would work with staff to improve the landscaping and bring in more mature trees to assist in that. In regards to cross access easement is a concern due to the lack of control of the traffic that would come through the site that may not belong there. This is a concern due to the safety and concern of the residence. Commissioner Forman asked about the food service and laundry service. Ms. Alford stated that there would be food delivery, once a week and laundry would be done in house. Chairman Hudson opened the public hearing. Paul Spencer, Our Lane came forward. Mr. Spencer expressed how much he like the design of the development and stated that one entrance is needed to provide security for the site. Chairman Hudson closed the public hearing. Commissioner Forman suggested that the applicant if recommended for approval needs to provide Council additional site plans that show more landscaping as well as other sites that have been built so that Council has something to compare it to. Motion to approve Ordinance No. 480 -664 (ZA14 -031), subject to Site Plan Review Summary No. 3 and Staff Report dated April 11, 2014 with requested variance to Driveway Ordinance No. 634, Section 5.1 requires a minimum centerline spacing for driveways along arterial streets to be 250'. The applicant is requesting a variance to allow a centerline spacing of approximately 91' to the residential driveway to the north and subject to the applicant willing to present an alternative access plan that will provide for a cross access easement at the front. Mr. Yamout currently resides at 2200 Long Shadow Drive in Colleyville. Paul Spencer, Our Lane came forward to assist Mr. Yamout to explain the current water line and what is being required to be installed on Our Lane. Commissioner Forman added that the applicant needs to replace the existing line if damaged during the installation of the new line. The applicant agreed. Dennis Killough added that the current 2" water line will be remain for the current residents on Our Lane along with the new installation of an 8" water line at the applicant's expense. The current residents will have the choice of remaining on the current line or paying the appropriate fees to be hooked into the new line. Commissioner Forman continued that the fill and the pavement replacement will need to be up to City standards. Again the applicant agrees to these requests. Chairman Hudson read aloud the comment cards. Motion to approve Ordinance 480 -665, (ZA14 -033) subject to the Concept Plan Review Summary No. 3, dated April 11, 2014, further subject to the staff report dated April 11, 2014, and granting the variance requested subject to the applicant's willingness to install the 8" water line meeting City standards from Randol Mill Ave. to the northwest corner of the property, further subject to the applicant's willingness to dedicate a 30' roadway and utility easement, further subject to the applicant's willingness to repair and maintain Our Lane, first to repair the roadway to City standards after installation of the 8" water line such that emergency vehicles can access it and also noting the applicant's acknowledgement that the City will not be maintaining Our Lane, and further noting that if the 2" water line is on the east side of the road as opposed to the west side of the road, the applicant's willingness to not disrupt that line and to prevent damage to that line and to repair it if damage does occur. Dove Rd., Southlake, Texas. Current zoning: "CS" Community Service District. SPIN Neighborhood # 4. PUBLIC HEARING Patty Moos, Planner I presented Item No. 12, ZA14 -038. Pastor George Craft of Abundant Grace Church located at 1970 E Dove Road came forward to explain the reason for the site plan change and the variance request. Chairman Hudson asked about current and /or previous location. Mr. Craft stated that they were previously located at White Chapel Blvd. and Countryside. Commission Kubiak asked about future growth. Mr. Craft stated that growth would be limited to state requirements based on square footage and staff. The school currently has 30 students, but they are looking to increase to 80 based on space. Commissioner Forman asked for clarification on the fence line. Mr. Craft showed the fence line on the site plan display and gave clarification of the type of fence that will be erected along with location and line. This area is a portion of the requested variance. Commissioner Kubiak asked about the children's playground and its location along with additional parking. Mr. Craft showed on the site plan where the playground may be located. The location is determined by a few factors regarding the septic system and sewer. Mr. Craft continued to show where the additional parking will be located. Commission McCaskill asked about operations and traffic patterns. Mr. Craft gave the operation hours and based on those hours will determine the traffic peak times. Based on the driveway and parking lot, Mr. Craft showed the flow of traffic patterns. City Attorney, Bryn Meredith gave a brief legal explanation of the request being made by Abundant Grace Church and the Commission's position and authority on this case. Chairman Hudson opened the public hearing and read aloud the comment cards and notifications given at the meeting. The concerns stated were traffic and back up lines on Creekside Drive, additional noise, safety to the existing residence along with the safety of the children that will be attending, the road is too narrow, and there are no sidewalks. Chairman Hudson closed the public hearing. Dmitri Gary with D Construction Services and Mr. Craft came forward to address all the issues. Chairman Hudson expressed his concerns regarding the setbacks but can see the reason for the fence variance. Motion to approve ZA14 -038, subject Site Plan Review Summary No. 1 dated April 11, 2014 and Staff Report dated April 17, 2014 with requested variances to Section 39.6, Screening and Fencing, for the required solid screening adjacent to residential properties. The variance request is to allow a six (6) foot existing wood fence along the north and northeast property line, allow a 6 ft. metal fence and shrubs at the north parking lot, and to allow a 6 ft. wood fence along the west property line and Setbacks / Yards: No non - single family residential building may encroach in the area above a line having a slope of 4:1 from any single - family residential property. However, a structure may be built up to within 40 feet of the residential property line, provided that the structure is no greater than one story or 20 feet in height.
