AN ORDINANCE AMENDING SECTION 18-80 OF THE SOUTHLAKE CITY
CODE BY REVISING THE PROVISION ESTABLISHING THE SPEED LIMIT
FOR THE SCHOOL CROSSING AT THE CLARIDEN SCHOOL; PROVIDING
THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY
FOR VIOI,ATIONS HEREOF; PROVIDING A SAVINGS CLAUSE;
PROVIDING FOR PUBLICATIONS IN THE OFFICIAl, NEWSPAPER; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas is a home rule city acting under its
charter adopted by the electorate pursuant to Article Xl, Section 5 of the Texas
(ionstitution and Chapter 9 of the Local Government Code; and
WHEREAS, pursuant to Section 545.356 of the Texas Transportation Code, the
City of Southlake, Texas has the authority to establish prima facie maximum reasonable
and prudent speeds within its corporate botmdaries for vehicles on streets and highways;

WHEREAS, the City Council of the City of Southlake recognizes that it is
necessary to regulate traftic near schools to promote the safety of children going to or
Ii:om school; and
WHEREAS, the City Council of the City of Southlake deems it necessary to
provide a reduced speed limit for a period o1' time that is of sufficient length to protect
children going to and from school; and
WHEREAS, the Director of Public Safety and Director of Public Works have
couducted an engineering and traffic investigation to determine reasonable and safe
prima Pacie speed limit for all scbool zoues; and
WHEREAS, the results of the engineering and traffic investigation indicate the
need to alter lhe prima lhcie speed limits listed in Section 545.352 of the Texas
Transportation Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SOUTHEAKE, TEXAS.

SECTION 1.
That Section 18-80 of the Southlake City Code is hereby amended by revising the
t'ollowing nnderlined provisions to the existing table in Section 18-80:
Street Speed Limit
From the 3800 block of 20
N. White Chapel Blvd.
through the 3900 block
of N. White Chapel Blvd.
SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances of the City of
Southlake, Texas, except where the provisions o£this ordinm~ce are in direct conflict with
the provisions of such ordinances, in which event tire conflicting provisions of such
ordiuances m'e hereby repealed.
SECTION 3.
It is hereby declared to be tire intention of the City Council that the phrases,
clauses, sentences, paragraphs and sections of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutiouality shall not affect any of the remaining phrases, clauses, sentences,
puragraphs and sectious o~'this ordinance, since the same would have been enacted by the
City Council without tire incorporation in this ordinance of any snch unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 4.
Any person, firm or corporation, who violates, disobeys, omits, neglects or
relhses to comply with or who resists the euforcement of any of the provisions of this
ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each
offense. Each day that a violation is permitted to exist shall constitute a separate offense.
SECTION 5.
All rights and remedies of the City of Southlake are expressly saved as to any and
all violations of the provisions of Ordinance No. 642, as amended, or any other
ordinances affecting prima facie speed limits on roadways within the city limits that have
accrued at the time of the effective date of this ordinance; and as to such accrued
violations and all pendiug litigation, both civil and criminal, whether pending in court or
not, under such ordinances, same shall not be affected by this ordinance but may be
prosecuted until final disposition by the courts.
SECTION 6.
The City Secretary of the City of Southlake is hereby directed to publish the
proposed ordinance or its caption and penalty together with a notice setting out the time
and place for a public hearing thereon at least ten (10) days before the second reading of
this ordinance, and il' this ordiuance provides for the imposition of any penalty, fine or
forfeiture for any violation of any of its provisions, then the City Secretary shall
additionally publish this ordinance or its caption and penalty in the official City
newspaper one time within ten (10) days after passage of this ordinance, as required by
Section 3.13 of the Charter of the City of Southlake.
SECTION 7.
This ordinance shall be in full force and effect from and after its passage and
publication as required by law, and it is so ordained.
