THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF
SOUTHLAKE, TEXAS; GRANTING A ZONING CHANGE ON A
CERTAIN TRACT OR TRACTS OF LAND WITHIN THE CITY OF
SOUTHLAKE, TEXAS BEING DESCRIBED AS LOT 1, BLOCK B, MTP-
IBM ADDITION NO. 1, CITY OF SOUTHLAKE, TARRANT COUNTY,
TEXAS, BEING APPROXIMATELY 20.15 ACRES, AND MORE FULLY
AND COMPLETELY DESCRIBED IN EXHIBIT "A" FROM 'NR-PUD'
NON - RESIDENTIAL PLANNED UNIT DEVELOPMENT DISTRICT WITH
"C-3" GENERAL COMMERCIAL DISTRICT, "CS" COMMUNITY

THIS ORDINANCE; CORRECTING THE OFFICIAL ZONING MAP;
PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE;
DETERMINING THAT THE PUBLIC INTEREST, MORALS AND
GENERAL WELFARE DEMAND THE ZONING CHANGES AND
AMENDMENTS HEREIN MADE; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR
VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE;
PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Texas Local Government Code; and,
WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the
authority to adopt a comprehensive zoning ordinance and map regulating the location and
use of buildings, other structures and land for business, industrial, residential and other
purposes, and to amend said ordinance and map for the purpose of promoting the public
health, safety, morals and general welfare, all in accordance with a comprehensive plan; and,
WHEREAS, the hereinafter described property is currently zoned as 'NR -PUD' Non-
Residential Planned Unit Development District with "C -3" General Commercial District, "CS"
Community Service District and "0-2" Office District uses under the City's Comprehensive
Zoning Ordinance; and,
WHEREAS, a change in the zoning classification of said property was requested by a
person or corporation having a proprietary interest in said property; and,
WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called
by the City Council did consider the following factors in making a determination as to whether
these changes should be granted or denied: safety of the motoring public and the pedestrians
using the facilities in the area immediately surrounding the sites; safety from fire hazards and
damages; noise producing elements and glare of the vehicular and stationary lights and
effect of such lights on established character of the neighborhood; location, lighting and types
of signs and relation of signs to traffic control and adjacent property; street size and
adequacy of width for traffic reasonably expected to be generated by the proposed use
around the site and in the immediate neighborhood; adequacy of parking as determined by
requirements of this ordinance for off - street parking facilities; location of ingress and egress
points for parking and off - street loading spaces, and protection of public health by surfacing
on all parking areas to control dust; effect on the promotion of health ad the general welfare;
effect on light and air; effect on the over - crowding of the land; effect on the concentration of
population, and effect on transportation, water, sewerage, schools, parks and other public
facilities; and,
WHEREAS, the City Council of the City of Southlake, Texas, further considered
among other things the character of the districts and their peculiar suitability for particular
uses and the view to conserve the value of the buildings, and encourage the most
appropriate use of the land throughout this City; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a
public necessity for the zoning changes, that the public demands them, that the public
interest clearly requires the amendments, and that the zoning changes do not unreasonably
invade the rights of those who bought or improved property with reference to the
classification which existed at the time their original investment was made; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that the
changes in zoning lessen the congestion in the streets, helps secure safety from fire, panic,
and other dangers, promotes the health and the general welfare, provides adequate light and
air, prevents the over - crowding of land, avoids undue concentration of population, and
facilitates the adequate provision of transportation, water, sewerage, schools, parks and
other public requirements; and,
WHEREAS, the City Council of the City of Southlake, Texas, has determined that
there is a necessity and need for the changes in zoning and has also found and determined
that there has been a change in the conditions of the property surrounding and in close
proximity to the tract or tracts of land requested for a change since the tract or tracts of land
were originally classified and therefore feels that the respective changes in zoning
classification for the tract or tracts of land are needed, are called for, and are in the best
interest of the public at large, the citizens of the city of Southlake, Texas, and helps promote
the general health, safety and welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of
Southlake, Texas, passed on the 19th day of September, 1989, as originally adopted and
amended, is hereby amended so that the permitted uses in the hereinafter described areas
be altered, changed and amended as shown and described below:
Being described as Lot 1, Block B, MTP -IBM Addition No. 1, City of Southlake,
Tarrant County, Texas, being approximately 20.15 acres, and more fully and
completely described in Exhibit "A" from 'NR -PUD' Non - Residential Planned
Unit Development District with "C -3" General Commercial District, "CS"
Community Service District and "0-2" Office District uses to 'NR -PUD' Non -
Residential Planned Unit Development District with "C -3" General Commercial
District, "CS" Community Service District and "0-2" Office District uses as
depicted on the approved Site Plan attached hereto and incorporated herein as
Exhibit "B ", and subject to the following conditions:
1) Site Plan Review Summary No. 2, dated November 15, 2013;
2) granting the requested variances;
3) Also providing for a right turn deceleration lane and noting the applicant's
willingness to work with staff on the striping of the center turn lane along
T.W. King Road.
SECTION 2.
That the City Manager is hereby directed to correct the Official Zoning map of the City
of Southlake, Texas, to reflect the herein changes in zoning.
SECTION 3.
That in all other respects the use of the tract or tracts of land herein above described
shall be subject to all the applicable regulations contained in said Zoning Ordinance and all
other applicable and pertinent ordinances for the City of Southlake, Texas. All existing
sections, subsections, paragraphs, sentences, words, phrases and definitions of said Zoning
Ordinance are not amended hereby, but remain intact and are hereby ratified, verified, and
affirmed.
SECTION 4.
That the zoning regulations and districts as herein established have been made in
accordance with the comprehensive plan for the purpose of promoting the health, safety,
morals and the general welfare of the community. They have been designed, with respect to
both present conditions and the conditions reasonably anticipated to exist in the foreseeable
future; to lessen congestion in the streets; to provide adequate light and air; to prevent over-
crowding of land; to avoid undue concentration of population; and to facilitate the adequate
provision of transportation, water, sewerage, drainage and surface water, parks and other
commercial needs and development of the community. They have been made after a full and
complete hearing with reasonable consideration among other things of the character of the
district and its peculiar suitability for the particular uses and with a view of conserving the
value of buildings and encouraging the most appropriate use of land throughout the
community.
SECTION 5.
That this ordinance shall be cumulative of all other ordinances of the City of Southlake,
Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except
in those instances where provisions of those ordinances are in direct conflict with the
provisions of this ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable and
that if the validity of the zoning affecting any portion of the tract or tracts of land described
herein shall be declared to be invalid, the same shall not affect the validity of the zoning of
the balance of said tract or tracts of land described herein.
SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions of this ordinance shall be
fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a
violation is permitted to exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances
affecting zoning which have accrued at the time of the effective date of this ordinance; and,
as to such accrued violations and all pending litigation, both civil and criminal, whether
pending in court or not, under such ordinances, same shall not be affected by this ordinance
but may be prosecuted until final disposition by the courts.
SECTION 9.
The City Secretary of the City of Southlake is hereby directed to publish the proposed
ordinance or its caption and penalty together with a notice setting out the time and place for a
public hearing thereon at least fifteen (15) days before the second reading of this ordinance,
and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any
violation of any of its provisions, then the City Secretary shall additionally publish this
ordinance in the official City newspaper one time within ten (10) days after passage of this
ordinance, as required by Section 3.13 of the Charter of the City of Southlake.
SECTION 10.
This ordinance shall be in full force and effect from and after its passage and
publication as required by law, and it is so ordained.

EXHIBIT "B"
DEVELOPMENT STANDARDS
This Non - residential P.U.D., legally described as Block B, Lot 1, MTP -IBM Addition No. 1, is part of
Solana, a mixed -use business campus which provides diverse land uses to its corporate tenants and
their guests. The development standards for this lot shall be as follows:
1. Permitted Uses
It is intended that the Non - Residential Planned Unit Development ( "NR -PUD ") shall permit those
uses as set forth in the following sections of the Comprehensive Zoning Ordinance:
• "CS," Community Service (Section 8);
• "0-2," Office District (Section 19); and
• "C -3," General Commercial District (Section 22)
These districts shall specifically include those uses described as:
• "Permitted Uses."
• "Accessory Uses." In addition, the following accessory uses shall be permitted: outdoor dining
and seating areas and street furniture, urban design fixtures and streetscape components.
• "Specific Use Permits."
• "Special Exception Uses."
• Ancillary residential development of up to ten percent (10 %) of the land in the NR -PUD.
The following uses shall be permitted in the non - residential planned unit development with the
exception of those which are deleted below:

d. Golf courses (except commercially operated miniature golf courses and commercially
operated golf driving ranges) on a site containing a total area of not less than forty (40) acres;

e. Institutions, rehabilitation and training centers offering non - academic programs, when
operated or sponsored by chartered educational, religious, or philanthropic organizations, but
excluding uses such as trade schools, which are operated primarily on a commercial basis.

3. Cleaning, dying and pressing works; laundry and washaterias, providing that the floor area
does not exceed 3,500 square feet for separate or combined uses. (As amended by Ordinance
No. 480 -U.)
4. Coin and stamp shops.
6. Commercial art galleries.
7. Conventional golf courses, including outdoor driving ranges accessory thereto, but excluding
outdoor miniature golf courses.
8. Department stores.
9. Dry goods and notion stores without size limitation.

13. Health and physical fitness centers and gymnasiums.

17. Medical care facilities to include nursing and care homes, hospitals with their related facilities
and supportive retail and personal service uses operated by or under the control of the
hospital primarily for the convenience of patients, staff and visitors.
18. Mortuaries, funeral homes and undertakers.
19. Music or record shops.
20. Nursery buildings for the retail sale of plants and accessory items where the sales operations
are conducted entirely within an enclosed structure. Outdoor storage or sale shall be
permitted with this use to the extent that the outdoor sales area is completely enclosed by a
fence, wall or screening device.
21. Pet shops.
22. Piano stores, musical instruments and supplies.
24. Printing, lithographing or duplicating jobs without size limitation.
25. Retail stores, businesses or shops for custom work or the manufacturing of articles to be sold
at retail on the premises, providing that in such manufacture, the total mechanical power shall
not exceed five horsepower for the operation of any one machine and provided that the
space occupied by the manufacturing use permitted herein shall not exceed fifty (50) percent
of the total floor area of the permitted use and provided further that such manufacturing use
is not noxious or offensive by reason of vibration, noise, odor, dust, smoke or fumes, and all
activity shall be conducted totally within the same building. It is the intent of this provision
that the manufacturing activity be related to the production of small items in a craft -type
environment rather than high intensity construction activities.
** 27. Taverns, clubs, and other comparable establishments under which the on- premises
consumption of alcoholic beverages is permitted subject to issuance of a special use permit as
required in Section 45 of this ordinance. The mere reference to this provision within the
zoning ordinance does not indicate or imply that the sale or consumption of alcoholic
beverages has been or will be permitted under the alcoholic beverage laws of the State of
Texas. It is only intended to define a location for this type of use if its existence should be
permitted by state law. Sexually oriented businesses shall not be permitted.

17. Dog and cat hospitals or small animal hospitals if conducted wholly within a completely
enclosed sound - proofed and air - conditioned building, providing that noise or odors created y
activities within the building shall not be perceptible beyond the property line; that no long
term boarding of animals is permitted except where related to medical treatment; and that no
animals are kept outside the building at any time.

"C -1," Neighborhood Commercial District
Commercial Uses
1. Offices of a business and /or professional nature providing services not including fabrication,
manufacture, or production of goods. (As amended by Ordinance No. 480 -C.)
2. Bakeries, provided that the floor area of the bakery operation shall not exceed 2,000 square
feet.
3. Barber and beauty shops.
4. Cleaners, laundries and /or laundromats, provided that the floor area of the business does not
exceed 2,500 square feet.
5. (Deleted by Ordinance No. 480 -Z.)
6. Grocery stores and /or meat markets provided that the floor area of the business activity shall
not exceed 3,000 square feet.
7. Newsstands and /or bookstores provided that the floor area does not exceed 2,500 square
feet of space.
8. Restaurants, tea rooms and /or "take -out" food establishments, provided that the floor area of
such operation does not exceed 2,000 square feet. Food service establishments operating in
this district are envisioned to be relatively small operations designed at providing
neighborhood support, such as delicatessens and limited menu item establishments that
generate low to moderate traffic from outside the neighborhood area.
9. Tailor, clothing or wearing apparel repair shops to include tailor activities that create custom
made clothing or accessories.
Community Facility Uses - City hall, fire and police stations and other municipal uses.
2. Development Regulations
All existing structures, architectural features, and trash receptacles, labeled as such on the site
plan submitted with this request and lawful at the time of previous zoning approval, shall be
deemed conforming as long as they remain otherwise lawful. The development regulations set
forth in Sections 8, 19, and 22 of the City's Comprehensive Zoning Ordinance No. 480, as
amended, shall be adhered to for any new construction after this approval with the following
noted exceptions:
A. Height
1. No parking structure shall exceed four (4 ) stories nor shall it exceed forty -five (45') feet in
height. A five (5) story parking garage, up to sixty (60) feet high, is permitted at the
location shown in the site plan exhibit under this ordinance that was approved under
Planning Case ZA13 - 131.
2. Architectural Features: Architectural features (not intended for human occupancy) which
are integral to the architectural style of the building (including spires, belfries, towers,
cupolas, domes, feature walls and similar features) may not exceed the six (6) story or
ninety (90') foot height limitation by more than twenty (20') feet.
3. Mechanical Equipment /Penthouses, Ventilation Equipment, Antennas, Cooling Towers,
etc.: These ancillary uses shall not exceed the actual height of the building by more than
twenty (20') feet.
B. Parking Regulations
Off- street parking requirements shall be in accordance with the regulations in place at the
time of the original zoning approval in August, 1987 which were as follows:
1. Parking Space Sizes
a. Standard head -in spaces: 9' x 18'
b. Compact spaces: 8' x 16'
c. Parallel spaces, 8' x 22'
2. No more than 50% of the required spaces shall be compact spaces.
C. Off- Street Loading
The minimum number of off- street loading spaces shall be four (4). However, should
additional floor area be constructed, 1 additional space shall be provided for each additional
100,000 square feet of floor area, or portion thereof.
D. Bufferyards
No bufferyard shall be required along a public street so long as the equivalent open space and
plantings normally provided within the required bufferyards are provided elsewhere within
the lot.
E. Landscaping
Due to Solana's unique landscape design, the landscape palette will be consistent with the
existing developed areas of Solana. Landscaping design will be submitted and approved at the
site plan phase of any future structural development.
F. Release from Section 43, "Corridor Overlay Zone" Requirements
Solana is a mixed -use campus development designed with contemporary planning and design
methods. Solana's designers utilized large meadows and groves of existing trees as natural
buffers. Large setbacks were utilized throughout the site's development. The innovative
design style of Solana does not mirror the traditional design style of residential areas of
Southiake, Texas , but the Solana design style does meet the purpose and intent of the
Corridor Overlay Zone requirements of the City of Southlake Zoning Ordinance No. 480,
Section 43, "Overlay Zones," as amended by Ordinance No. 480 -C, and as further amended by
Ordinance No. 480 -5, and which may be amended in the future.
The design style of Solana meets the intent of the Corridor Overlay Zone requirements by
providing buildings and plazas which encourage an employment destination complex of office
and ancillary retail and commercial activities. Solana reflects comprehensive planning and
elements of uniform urban design. Solana meets the purpose of the corridor Overlay Zone
requirements by providing consistent development of office, retail and commercial areas
along a major traffic corridor though the City of Southiake and standards which enhance the
visual image of the corridors while maintaining traffic safety.
Although existing and future development on the site shall not be subject to the Corridor
Overlay Zone requirements as defined in Section 43 of Ordinance No. 480, as amended.
Solana, as a participant in the development of the corridor Overlay Zone criteria, commits to
upholding the purpose and intent of these requirements. Solana will continue to be a
comprehensively planned mixed -use business center which complements the high quality
residential areas of the City. Solana's innovative style includes concepts of campus -style office
space surrounded by distinctive and liberal landscaping, quality construction methods and
materials, sensitive screening, etc. By use of these elements, Solana accomplishes the goals of
the Corridor Overlay Zone in its own distinctive style.
