! 999 Nation al Electrical Code ORDINANCE NO. 814 AN ORDINANCE ~,kDOPTING NFPA 70, THE NATIONAL ELECTRICAL CODE 1999 EDITION; PRO¥IDING FOR THE ADOPTION OF LOCAL AMENDMENTS THEREIO; PRO~ IDING FOR RECORDING OF SUCH CODE AS A PUBLIC RECORD; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALI ORDIN~a2'iCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAYINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The City of Southlake, Texas is a home rule city acting under its char~er adopted by the electorate pursumqt to Article Xi, Section 5 of the Tcxas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, City Council of the City of Southlake deems it necessary to adopt this ordinance governing requirements for the installation and maintenance of electrical systems inctading requirements for materials, in order to protect the health, safety and welfare of the citizens of the City of Southlake. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OFTHE CITY OFSOUTHLAKE, TEXAS: SECTION 1 That Nq:PA 70, The National Electrical Code, 1999 Edition, published by The National Fire Protection, Inc., is hereby adopted as the Electrical Code of the City of Southlake. A tree and correct copy of this Code is attached to this ordinance as Exhibit "A." SECTION 2 l'bat the 1999 National Electrical Code, as adopted herein, is hereby amended as provided in Exhibit "B" incorporated herein and attached hereto for all purposes of this ordinance. The City of $outhlake may from time to time detemaine that additional local modifications to the 1999 National Electrical Code are necessary and appropriate to meet tine unique construction needs of thc Cit.x of South/ake. ~1o effectuate.~ these modifications, the City council shall enact individual ordinances amending this ordinance fully setting forth thc change to be made in the code. The amendments shall be consolidated as Exhibit "B" to this ordinance. SECTION 3 'lhe material contained in Exhibits "A" and "B" to this ordinance shall not be included in the tkmnal municipal codification of ordinances, but shall be maintained as a public record in the office of the City SecrctaO' ,,'ill bc available for public inspection and copying during regular business hours. SECTION 4 This ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, ~1 exas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinm~ces, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 5 Il is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of lhis ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid .judgmenl or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para~aphs and sections of this ordinance, since the same v, ould ha~e been enacted by the City council without the incorporation in this ordinance of any such uncoustitutional phrase, clause, sentence, paragraph or section. 2 SECTION 6 Any person, firm or corporution who violales, disobeys, omits, neglects or refuses to comply with or x~ ho resists the enforcemenl of any of the provisions of this ordinance shall be fined not more tha~l Two Thousand Dollars (S2.000.00) for each day that a violation is permitted to exist shall constitute a separate offense. SECTION 7 All rights and remedies of' the City of Southlake are expressly saved as to any and all x Jolations of the provisions of any ordinances affecting the installation and maintenance of electrical systems ,~hich have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance buy may be prosecuted until final disposition by the courts. SECTION 8 Thc Cit) Secretary of the City of Southlake is hereby authorized to publish this ordinance in book or pamphlet form for general distribution among thc public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof. SECTION 9 Thc Cil.x Secretai?, of the City of Soulhlake is hereby directed to publish in the official ne*~ spaper of the City of Southlake, the caption, penalty clause, publication clause and effective date of this ordinance one time within ten days after passage oflhis ordinzmce, as required by Section 3.13 of tl~e Cleaner of the City of Southlake.
