The purpose of this e-mail conespondence Is to memorialize our conversation regarding the construction of sidewalks along Pearson and Johnson Roads. As we discussed, construction of sidewalks is of high Importance to many of the citizens of Southlake and the City Council. During the first reading of your zoning case, Coartillireti inairViraiii with the staff to see ifjointly we could work through the details of the sidewalk construction at this location. This meeting was held on Monday, December 9, 2013. Present at the meeting were you, your wife, Ken Baker, Lance Fletcher, Keith Martin and myself as I recall. As was discussed et the meeting, the 6 foot wide sidewalk along Pearson can be constructed, east of the east side drainage borrow ditch. It is our understanding that you are dedicating as part of you plat ten feet (10, of additional right-of way. This proposed 6 foot wide sidewalk should fit comfortably outside of the borrow ditch. We understand that the sidewalk will abut into a fence at your south property line. The purpose of the 6 foot wide sidewalk along Pearson Road is to meet the plans as lakl out In the 2030 Master Planning process. however, you will only be required to be financially responsible for 4 feet of the 6 foot wide sidewalk. The city will reimburse you for 'A of the construction cost of the 6 foot wide sidewalk (I.e., 2 feet width) along your western (Pearson Road) right of way /property line less the portion of the sidewalk that also serves as part of your driveway approach. This reimbursement will be based upon the actual cost of sidewalk construction (to city standards), not to exceed a cost a $5 per S.F. Upon completion of the sidewalk construction, please submit copies of cost documentation to our office for review and reimbursement. You also mentioned that you may wish to make some modifications to your proposed Pearson Road driveway that may vary from the Driveway Ordinance standards. For these plans, you will need to submit specific plans at a later date. These plans may require a variance to the Driveway Ordinance; however, Public Works staff is authorized to issue this variance if deemed appropriate. The same would be true of any issues related to driveways along Johnson Road. In addition, the 6 foot wide sidewalk along Johnson can be conetructed, for the most part within the proposed right of way. It is our understanding that you are dedicating as part of your plat elght feet (8') of additional right-of way. We understand that the sidewalk wig abut into a fence at your east property line. The purpose of the 6 foot wide sidewalk along Johnson Road is to meet the plans as laid out In the 2030 Master Planning process. However, as was the case on Pearson Road, you will only be required to be financially responsible for 4 feet of the 6 tot wide sidewalk. The city will reimburse you for 'r5 of the costwctlon cost of the 6 foot wide sidewalk (Le., 2 feet width) along your northern (Johnson Road) right of way /property line less the portion of the sidewalk that also serves as part of your driveway approach This reimbursement will be based upon the actual cost of sidewalk construction (to city standards), not to exceed a cost a $5 per S.F. The sidewalk along Johnson Road may need to vary in location along the right of way in order to get the sidewalk in without requiring the removal of trees. Keith Martin Indicated that he felt that the placement of the sidewalk https/inaln9coglaearYrmIV1W =21111 2 5d0d2e00& sdewpl &seercfrinta41Mt42ec51452e277rd 12 Page 12 12MW13 ClamIMele6us Mall - Re: rating on 1ZR regarding 525 Ragman within the drip Ilne of the bees will not fatally harm the trees. One option that we may have is that if you would like to meander the sidewalks out piths public right of way onto private property, we will work with you to develop a pedestdar easement in which to construct the sidewalk. This decision will be made as we get closer to the actual construction of the sidewalk. The placement of the sidewalk in this public easement should provide you with reduced liability of a sidewalk being located on private property. Furthermore, city staff will work with the City Attorney to provide a provision within the easement documents that will be recorded at the Tarrant County Records indicating that within two (2) yeas of notification by you or a future property owner that remo aI/death of the tree(s) that the meandering sidewalk was constructed on private property In order to meld occurs, the city will reconstruct that portion of the sidewalk to remove it from private property and subsequently abandon the subject pedestrian easement. Thank you for warldng to make sidewalks In our City a reality. if you feel that I have failed to capture any portton of our discussion In this document, please feel free to contact our office. Thank you for your cooperation and we look forward to you being a part of the Southlake community. Sincerely, Robert H. Price, P.E.
