RESOLUTION NO. 13 -052 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A MASS GATHERING EVENT FOR SOUTHLAKE GREEN FEST EVENT ON PROPERTY LOCATED AT 1400 FOUNTAIN PLACE AND 1400 E SOUTHLAKE BOULEVARD BEING LEGALLY DESCRIBED AS BLOCKS 7 AND 8, AND ADJACENT RIGHT -OF -WAY, SOUTHLAKE TOWN SQUARE, PHASE I, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A ", AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a mass gathering event for Southlake Green Fest Event has been requested by a person or corporation having a proprietary interest in the properties zoned as "DT" Downtown District; and, WHEREAS, in accordance with the requirements of Sections 45.1 (36) & 45.14 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a mass gathering event for Southlake Green Fest Event on property located at 1400 Fountain Place and 1400 E Southlake Boulevard being legally described as Blocks 7 And 8, and adjacent right -of -way, Southlake Town Square, Phase 1, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet 'A', Slide 4892, Plat Record, Tarrant County, Texas, more fully and completely described in Exhibit "A ", and as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special Page 1 conditions shall be applicable to the granting of this Specific Use Permit: 1) Approval subject to the staff report dated January 15, 2014 and as presented by city staff at the meeting. The permit shall be valid for five (5) years; expiration date 01/21/2019. SECTION 2. This resolution shall become effective on the date of approval by the City Council. Page 4 Green Fest Southlake Green Fest is Southlake's premier opportunity to learn about the many ways to be environmentally friendly, endow a sustainable future, and improve daily living by going green. Green Fest Southlake is free to the public and scheduled for: Southlake Town Square Rustin Park March 29, 2014 10:00 AM - 5:00 PM The event hosts approximately 40 exhibitors, business offering green/eco- friendly products and services. Exhibitors may begin set -up is at Sam that morning, and tear -down starting at 5pm. See the attached map. For the 2013, we had bounce houses for the first time, and the kids loved them. They took the space of a Title Sponsor on Fountain Place. If we have the opportunity for the bounces houses again, we will offer them, as they generate revenue for the non - profit, Bob Jones Nature Center. Like our previous years, there will also be entertainment, fabulous raffle /drawing prizes, a scavenger hunt for students Kindergarten through the 6th grade, and we will be giving away two (2) Apple iPads. We invite you to be a part of Southlake's campaign to spread the word about how we can all work together to save and protect our precious resources!
