Item 9C13 CITY OF SOUTHLAI<,-E Department of Planning & Development Services STAFF REPORT January 14, 2014 CASE NO: SV14-001 PROJECT: Sign Variance for Silver Ridge Assisted Living Center EXECUTIVE SUMMARY: Silver Ridge Assisted Living Center, located at 2001 E. Kirkwood Boulevard, is requesting a variance to the Sign Ordinance No. 704-F requirements to allow the construction of an off -site monument sign on an unplatted property located at 2051 East Kirkwood Boulevard. REQUEST: Silver Ridge Assisted Living Center is requesting a variance to the sign ordinance requirements for a monument sign to be located off -site on an adjacent unplatted lot that does not have a building. The Silver Ridge Assisted Living Center development is located along the south side of E. Kirkwood Boulevard and is southwest of the unplatted tract. The development has access via a common access easement drive extending through the unplatted tract. The monument sign is proposed to be located along the west side of the common access easement drive. The sign ordinance states that no sign permit shall be issued unless a Certificate of Occupancy or building permit has been issued by the City. The applicant will need a variance approval to obtain the sign permit needed to construct the proposed monument sign. Additionally, a variance to allow the sign at approximately 9.7 feet from the right-of-way of E. Kirkwood Boulevard is requested. A minimum of ten (10) feet from the right -of way is required under the sign ordinance. The sign proposed meets all other sign ordinance criteria. Kirkwood Boulevard. The proposed monument sign will be located at 2051 E. Kirkwood Boulevard. HISTORY: September 4, 2012: City Council approved a Zoning Change & Site Plan for Silver Ridge Assisted Living Facility under Planning Case No. ZA12-064. That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. Drivers on Kirkwood will not be able to see the sign from the street if it is not placed near Kirkwood. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self Imposed. The building is around 150 yards away from the street, if we were to place the sign on the same property as the actual building itself it would become obsolete. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. An entity of David Keener's owns the surrounding land, and the placement of the sign will not interfere with what he plans on building on that lot. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. We have already changed the look of the sign to be in harmony with the sign ordinance a couple of months ago, the sign permit we received showed the location of the sign that is now in question. We understand why you have rules in place for offsite signs, but in this case this is the only way that we can get the sign close enough to the road to make the sign matter.
