Item 4GCITY OF SOUTHLAI<,,E STAFF REPORT December 10, 2013 CASE NO: SV13-022 PROJECT: Sign Variance for Chipotle EXECUTIVE SUMMARY: Barrett Signs, Inc. on behalf of the owner, Chipotle, located at 3010 E. Southlake Boulevard, is requesting variances to the Sign Ordinance No. 704-F requirements. Chipotle currently has existing signs on the north and south faced that were installed in November 2000. One variance request is to allow an attached sign on the south elevation (facing FM 1709) that exceeds maximum allowed logo height and overall sign area. The other variance request is to allow an attached sign on the north elevation (facing Gateway Drive) that exceeds maximum allowed logo height on the north building fagade. This portion of the development is not subject to the Gateway Plaza Phase I or Phase II Conditional Sign Permits. REQUEST: The applicant is requesting a variance to the Sign Ordinance No. 704-F requirements to allow an attached sign on the south elevation (facing FM 1709) that exceeds maximum allowed logo height and overall sign area. The maximum allowed logo height is 22.9 inches; the applicant is proposing 30.5 inches. The proposed maximum allowed sign area for the south elevation is 28 square feet; 37.8 square feet. The applicant also proposes an attached sign on the north elevation of their building (facing Gateway Drive) that exceeds maximum allowed logo height. The maximum allowed logo height is 20 inches; the applicant is proposing 26.75 inches. OWNER: Chipotle PROPERTY SITUATION: The property is located at 3010 E. Southlake Boulevard. HISTORY: Chipotle currently has two (2) signs on the north and south fagade that were permitted on November 10, 2000. The south fagade sign has 38 inch channel letters and the north faced has 19 inch channel letters. Other Permitted Tenant Signs for this building (3020 and 3030 E. Southlake Boulevard) include: November 20, 2007 — City Council approved a variance request for Modia Home Theatre that allowed for maximum logo height for an attached sign on the south elevation facing Southlake Boulevard. The regulation allowed for 24'/2 inches; the proposed and approved logo height is 38 inches. June 19, 2012 — City Council approved a variance request for Modia Home Theatre that allowed an additional sign on the north elevation that exceeded maximum letter and logo height. The regulation allowed for 16 inch letters and 20 inch logo; the proposed and approved letter and logo heights were 20 '/4 inches and 39 inches respectively. February 5, 2013 — City Council approved a variance request for Men's Warehouse (located at 3030 E. Southlake Boulevard) that allowed variances to the sign ordinance requirements for an attached sign on the south elevation that exceeded the maximum letter height and the middle 75% of the single plane fagade; and an attached sign on the north elevation that exceeded maximum letter height. The approved maximum height for the letters was 22 inches for the south elevation and 21 inches for the north elevation. The literal enforcement of the sign regulations creates unnecessary hardship by causing the Chipotle letters and logo to become too small for proper visibility and building aesthetics. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. This situation is unique to Chipotle as several other tenants have larger signs installed than standard sign code allows. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. The approval of this variance will not injure the development of adjacent properties as several others tenants in this same development also have larger signs that what standard sign code allows, as they were approved by variance. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. This variance is in harmony with the spirit and purpose of the sign ordinance in that the proposed signage is balanced, and provides an "easy and pleasant communication between the people and their environment'. It does not cause "visual clutter that is potentially harmful to traffic and pedestrian safety, property values, business opportunities, and community appearance". It also meets all other aspects of the purpose and intent of the sign ordinace. The approval of this variance only gives Chipotle the ability to identify itself, promote its brand, market itself, and attract customers in a fair manner.
