13-036 RESOLUTION NO. 13 -036 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A MULTI -LEVEL PARKING GARAGE FOR NON- RESIDENTIAL PROPERTY LOCATED AT 141 GRAND AVENUE AND DESCRIBED AS LOT 4, BLOCK 5R, SOUTHLAKE TOWN SQUARE, AN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A ", AND AS DEPICTED ON THE APPROVED SITE EXHIBIT ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a multi -level parking garage for non - residential property has been requested by a person or corporation having a proprietary interest in the property zoned as "DT" Downtown District; and, WHEREAS, in accordance with the requirements of Section 45.3 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit for a multi -level parking garage for non - residential property located at 141 Grand Avenue and described as Lot 4, Block 5R, Southlake Town Square, an addition to the City of Southlake, Tarrant County, Texas, more fully and completely described in Exhibit "A ", and as depicted on the approved Site Exhibit attached hereto and incorporated Resolution No. 13 -036 Page 1 herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. SECTION 2. This resolution shall become effective on the date of approval by the City Council. PASSED AND APPROVED THIS 1 DAY OF October, 2013. Resolution No. 13 -036 Page 3 EXHIBIT "B" The Specific Use Permit was approved as presented. The Council motion for the associated Site Plan for Trader Joe's (ZA13 -083) included the following language regarding the parking garage: 1) The Landscaping plan will be as presented by the applicant, noting that the applicant will be required to have Nellie R. Stevens at various intervals to break up the monotony of the screening hedge adjacent to the parapet wall along Central for the parking; 2) The columns in the parking garage will be painted a complementary color; 3) Security cameras will be provided in the parking garage; 4) Approval is subject to all architectural renderings as presented by the applicant this evening. BLOCK 5R, LOT 4 - SITE PLAN • Cooper & Stebbins is filing this application for approval of a Site Plan in support of a new 2 -story building for Trader Joe's in Block 5R, Lot 4 of Southlake Town Square. • The application is consistent with the approved Town Square Development Plan for this Block. • The 2 -story approximately 13,800 sq. ft. building is proposed to be developed on a pad at the NW corner of FM 1709 and Central Ave. - Site grades allow for development of the retail store (approx. 10,800 sq. ft.) and new parking field one story above the existing parking lot, with direct access off of Central Ave. - The building entry will be at the NW corner of the building, facing north. - The bottom level (approx. 3,000 sq. ft.) would be at grade to the existing parking field, and would contain back -of -house functions for the retail store above. Adjacent loading dock, utilities and dumpster will be screened from FM 1709 and Central Ave. - Upper level parking will add 70 new parking spaces, 8 more than required by Code. 33 spaces will be lost on the lower level, which is offset by the existing parking surplus in Town Square. An updated Town Square parking tabulation is included with this application. • The sidewalk and streetscape along the western side of Central Ave. will be extended and completed from FM 1709 to Main St. • Landscaping will be consistent with street and parking lot landscaping for this Block, with a hedge row added along Central Ave. to help screen the elevated parking structure. Resolution No. 13 -036 Page 4 BLOCK 5R, LOT 4 — S.U.P. for Structured Parking • The approved Development Plan for Block 5R shows a centralized parking structure extending north to Main Street, above mid -block street level commercial space. • This mid -block building was previously approved and built as a single level retail building, without the need for structured parking. New buildings in Block 5R will require structured parking. • DT Downtown District Zoning allows for parking structures to be approved by S.U.P., such as the application made here. • The 2 -level parking structure proposed provides necessary parking to the new building, while preserving flexibility for the long -term development of other buildings and expanding structured parking within the Block consistent with the Development Plan. - Site grades allow for the development of 70 new parking spaces in the elevated level of the parking structure, with direct access to Central Avenue. - Truck and fire access is provided in the existing parking field below. - Parking and vehicular circulation is preserved underneath the parking structure. • DT Downtown District requires a parapet wall of not less than 46 ". The spandrel panel for the parking deck is 6'6" wide; the portion of the panel lying above the parking surface is currently 44 ".
