Mahaffa Survey in Denton County, Texas, according to the plat filed in Book 2, Page 34, Deed Records, Denton County, Texas, and being within the City Limits of the City of Southlake, Texas by virtue of a Deed from A. T. Sellers dated August 19, 1958, under Clerk's Certificate No. 5146 and duly recorded on September 25, 1958, in Volume 440, Page 328 of the Deed Records of Denton County, Texas. This conveyance, however, is made and accepted subject to any and all validly existing encumbrances, conditions and restrictions, relating to the hereinabove described property as now reflected by the records of the County Clerk of Denton County, Texas. TO HA VB AND TO HOLD the above described premises, together with all and singular the rights and appurtenances thereto in anywise belonging unto the said Grantee, Grantee's successors and/or assigns forever; and Grantor does hereby bind Grantor, Grantor's heirs, executors, administrators, successors and/or assigns to WARRANT AND FOREVER DEFEND all and singular the said premises unto the said Grantee, Grantee's successors andior assigns, against every person whomsoever claiming or to claim the same or any part thereof by, through or under the Grantor, but not otherwise. Grantor hereby specifically disclaims any warranty, guaranty or representation, oral or written, past, present or future of, as to, or concerning (i) the nature and condition of the Property, including, without limitation the water, soil and geology, and the suitability thereof and of the Property for any and all activities and uses which Grantee may elect to conduct thereon, and the existence of a:lY environmental hazards or conditions thereon (including the presence of asbestos) or compliance with all applicable laws, rules or regulations; (ii) except for any warranties contained in this Deed delivered by Grantor at the closing of the Property, the nature and extent of any right-of way, lease, possession, lien, encumbrance, license, reservations condition or otherwise; and (iii) the compliance of the Property or its operation with any laws, ordinances or regulations of any ~ SPECIAL WARRANTY DEED-WILLIE E. Grantee acknowledges that it has by the acceptance of this Deed inspected the Property and, except for the specific representations, warranties and covenants contained herein, Grantee will rely solely on its own investigation of the Property and not on any information provided by Grantor. Grantee further acknowledges that the information provided with respect to the Property was obtained from a variety of sources engaged by Grantee and Grantor (i) has not made any independent investigation or verification of such information; and Grantor does not make any representations as to the accuracy or completeness of such information, except for the specific representations, warranties and covenants contained herein.
