ORDINANCE NO. 443
AN ORDINANCE OF THE CITY OF SOUTHLAKE,
TEXAS, AMENDING ORDINANCE NO. 160-A, THE
CITY'S SUBDIVISION CONTROL ORDINANCE, BY
ADDING PROVISIONS RELATING TO REQUIREMENTS
FOR STREET LAYOUT FOR LOTS OF TWO ACRES OR
LESS AND RELATING TO LOT-WIDTH REQUIREMENTS
FOR PROPERTY ABUTTING LOTS OF ONE OR MORE
ACRES; PROVIDING A PENALTY NOT TO EXCEED THE
SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR
EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE
DEEMED COMMITTED UPON EACH DAY DURING OR ON
WHICH A VIOLATION OCCURS; ENACTING
PROVISIONS RELATED THERETO; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Southlake, Texas
(the "City") hereby finds and determines that the amendments
set forth herein to the City's subdivision control ordinance,
Ordinance No. 160-A, as previously amended, are necessary to
promote the health, safety, morals and general welfare of the
City and the safe, orderly and healthful development of the
City; and
WHEREAS, the City Council further finds that all legal
requirements relative to public notice and hearings have been
complied with and that the Planning and Zoning Commission has
recommended that the City Council consider and approve an
amendment to Ordinance No. 160-A, as set forth herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE, TEXAS:
Section 1. That all of the above premises are found to
be true and correct and are incorporated into the body of this
Ordinance as if copied in their entirety.
Section 2. That Ordinance No. 160-A of the City of
Southlake, Texas, as previously amended, being the City's
subdivision control ordinance, be amended by adding a new
section 9.3A containing the following requirements:
"9.3A Street Layout Requirements for Lots of Two Acres
or Less. All proposed residential developments containing lots
of two acres or less shall conform to the following street
layout design standards:

Curvilinear Design Requirements:
Subdivisions shall be designed and shall
provide for all minor and local streets in
a curvilinear manner, except when:
in the determination of the Planning
and Zoning Commission and the City
Council, the shape or topography of
the subdivision, existing zoning or
the pattern of the adjacent street
system would make the provision of
such curvilinear streets
impractical; or
the subdivision contains ten (10) or
less gross acres of land and was not
acquired or conveyed out of a larger
tract of land without benefit of
plat and recording,
The maximum centerline radius for such
streets shall be eight hundred feet (800~).
Ail cul-de-sacs and block lengths of eight
hundred feet (800') or less shall be
considered as meeting the intent of the
curvilinear street standards provided that
each end of the frontage street terminates
at the block's end.
The requirements contained in this section
for the provision of curvilinear streets
shall be presumptively complied with if
fifty percent (50%) of the lots fronting on
local streets within the subdivision have a
curved front lot line for more than fifty
percent (50%) of the lot frontage.
Proposed streets for a residential subdivision
shall be effectively related to the present and
future street system and development of the
surrounding area. Any proposed street shall
provide for appropriate continuation or completion
of any existing streets, whether constructed or
dedicated, which project to the limits of the
proposed subdivision. In the event that dead-end
streets either dedicated or constructed are not to
be extended, permanent turnaround facilities shall
be constructed by the developer of the

subdivision. Appropriate provisions shall be made
by the Planning and Zoning Commission and the City
Council for access to adjoining unsubdivided land.
Minor or local streets should be planned in
proposed residential subdivisions to serve only
local traffic.
d. Ail streets in a proposed residential subdivision
should be planned so that all resulting lots shall
be of sufficient size and shape as to conform with
applicable zoning regulations.
e. The streets of a proposed residential subdivision
shall conform to the general intent of the
approved Thoroughfare Plan. To insure adequate
access to each subdivision, there shall be at
least two planned points of ingress and egress,
except when cul-de-sacs are permitted.
Section 3. That Ordinance No. 160-A of the City of
Southlake, Texas, being the City's subdivision control
ordinance, be amended by adding a new section 9.15A containing
the following requirements.
"9.15A Lot Width Requirements for Property A]outtinq Lots
of One or More Acres. Any proposed development
containing lots of one acre or less shall have lot widths
of at least 125 feet if such proposed development abuts
an existing, zoned or platted, residential development
containing lots of one acre or more, or an area shown on
the approved City land use plan as being designated for
lots of one acre or more. Lot width is defined for
purposes herein as the length of a line (curved or
straight), drawn perpendicular to the lot depth line at
its point of intersection with the front set back or
building line, connecting the side lot lines.
The Planning and Zoning Commission and the City Council
shall have the authority to grant a variance to the
requirements contained in this section in the event that
such requirements would impose a design hardship or other
undesirable situation due to specific physical
circumstances of a development.
Section 4. If any section, article, paragraph,
s~nt~nce, clause, phrase or word in this Ordinance, or
application thereof to any person or circumstances is held
invalid or unconstitutional by a Court of competent
jurisdiction, such holding shall not affect the validity of the
remaining portions of this Ordinance; and the City Council

hereby declares it would have passed such remaining portions of
the Ordinance despite such invalidity, which reMaining portions
shall remain in full force and effect .
Section 5 . All ordinances or parts of ordinances
inconsistent or in conflict with the provisions of this
Ordinance are hereby expressly repealed to the extent of such
inconsistency or conflict .
Section 6 . Any person violating any of the provisions
of this Ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be subject to a fi a in a sum not
to exceed Two Thousand Dollars ($2,000 . 00) for each offense and
a separate offense shall be deemed committed upon each day
during or on which a violation occurs .
Section 7 . This Ordinance shall be in full force and
effect from and after its passage, but shall no be applicable
to a subdivision which is a part of and onforms to an
unexpired preliminary plat approved prior to the date of
adoption of this Ordinance.

requirement is a "minimum" requirement .

replace it with the enclosed revised ordinance.
