AN ORDINANCE ADOPTING THE UNIFORM SWIMMING POOL, HOT TUB
AND SPA CODE,CODE, 1982 EDITION, TO PROVIDE MINIMUM
STANDARDS FOR CONSTRUCTION, MAINTENANCE AND OPERATION OF
SWIMMING POOLS AND ESTABLISHING FENCES INCLUDING SWIMMING
POOL FENCING REQUIREMENTS; PROVIDING A SEVERABILITY CLAUSE,
PROVIDING A SAVINGS CLAUSE, REPEALING CONFLICTING
ORDINANCES, PROVIDING PENALITIES AND PROVIDING AN EFFECTIVE
DATE.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
I.
That it is deemed expedient and for the benefit of the health,
safety and welfare of the citizens of the City of Southlake, Texas,
that the Uniform Swimming Pool, Spa, and Hot Tub Code, 1982 Edition,
be adopted as the Swimming Pool, Spa and Hot Tub Code of the City of
Southlake, Texas as follows:
SECTION (1): ADOPTION OF UNIFORM SWIMMING POOL, SPA, AND HOT TUB
CODE, 1982 EDITION
There is hereby adopted by the City Council of the City of
Southlake, Texas for the purpose of establishing rules and regulations
governing the installation of swimming pools, spa, and tubs and
requiring fencing standards, including swimming pool fencing
requirements, that certain swimming pool, spa, and hot tub code known
as the Uniform Swimming Pool, Spa, and Hot Tub Code, 1982 Edition, and
being the whole thereof, save and accept any such portions as are
hereinafter deleted, modified or amended of which not less than two
(2) copies have been and are now filed in the office of the City
Secretary of the City of Southlake, Texas, and the same are hereby
adopted and incorporated as fully as if set out at length herein, and
from and after the date on which this ordinance shall take effect, the
provisions thereof shall be controlling in the within the corporate
limits of the City of Southlake, Texas, and all amendments to the
Uniform Swimming Pool, Spa, and Hot Tub Code, save and accept those
specifically excluded by action of the governing body of the City of
Southlake, Texas.
SECTION (2): PERMITS, FEES AND INSPECTIONS
Permits, Inspections and Fees associated therewith, so far as
provided in the Uniform Administrative Code, 1985 Edition, as adopted
by the City of Southlake, shall apply to the Uniform Swimming Pool,
Spa and Hot Tub Code, 1982 Edition, adopted by the City of Southlake
by this ordinance.

SECTION (3): FENCES
Notwithstanding any ordinance or code to the contrary, there
shall be erected a temporary fence around any swimming pool
construction site and a permanent fence after completion of said
swimming pool, but prior to said swimming pool being filled with
water, which shall conform to the following specifications:
a) Each such fence shall be no less than six feet (61) in height
and any opening in such fence shall be no larger than a size to
prevent a sphere six inches (6") in diameter from passing through such
fence.
b) All gates in any such fence shall be installed so as to be
"self-closing" with a latch located on such gate in the upper one-
quarter (1/4) thereof. All such gates shall be no less than six feet
(6') in height and the latch installed on such gate shall be located
no less than four feet (4') from the ground.
SECTION (4): PUBLICATION
That the City Secretary of the City of Southlake shall certify to
the adoption of this ordinance and cause the same to be published.
SECTION (5): PENALTIES
That any person, firm or corporation who shall violate any of the
provisions of this ordinance and who is convicted of same, shall be
fined in any sum not be exceed TWO HUNDRED DOLLARS ($200.00) and that
each and every day that any violation of any provision of this
ordinance continues shall constitute and be deemed to be a separate
offense.
SECTION (6): REPEAL OF CONFLICTING ORDINANCES
All ordinances or parts of ordinances, or rules and regulations,
or parts thereof in conflict with the provisions of this ordinance are
hereby repealed.
SECTION (7): CIVIL REMEDIES
Notwithstanding any penalty provisions contained herein, or the
application and enforcement of any such penalty provision, nothing
shall prevent the enforced removal of prohibited conditions or the
enforced prevention of violations of the Code by injunctive or other
civil remedy.
SECTION (8): SAVINGS CLAUSE
If any provision section or portion of this ordinance shall be
held invalid or unconstitutional, the particular provision, section or
portion held invalid or unconstitutional shall not be deemed to effect
the validity of any other section, provisions or portion of said
ordinance.
