ORDINANCE NO.
AN ORDINANCE ADOPTING THE UNIFORM PLUMBING CODE, 1985
EDITION, TO PROVIDE MINIMUM PLUMBING CONSTRUCTION STANDARDS
FOR THE CITY OF SOUTHLAKE, TEXAS; PROVIDING A SEVERABILITY
CLAUSE, PROVIDING A SAVINGS CLAUSE, REPEALING CONFLICTING
ORDINANCES, PROVIDING PENALITIES AND PROVIDING AN EFFECTIVE
DATE.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
I.
That it is deemed expedient and for the benefit of the health,
safety and welfare of the citizens of the City of Southlake, Texas,
that the Uniform Building Code, 1985 Edition, be adopted as the
Building Code of the City of Southlake, Texas as follows:
SECTION (1): ADOPTION OF UNIFORM PLUMBING CODE, 1985 EDITION
There is hereby adopted by the City Council of the City of
Southlake, Texas for the purpose of establishing rules and regultaions
for plumbing construction and installation, and for the purpose of
establishing plumbing code standards, including permits, that certain
plumbing code known as the Uniform Plumbing Code, 1985 Edition, and
being the whole thereof, save and accept any such portions as are
hereinafter deleted, modified or amended of which not less than two
(2) copies have been and are now filed in the office of the City
Secretary of the City of Southlake, Texas, and the same are hereby
adopted and incorporated as fully as if set out at length herein, and
from and after the date on which this ordinance shall take effect, the
provisions thereof shall be controlling in the construction and
installation of all plumbing facilities and fixtures therein contained
within the corporate limits of the City of Southlake, Texas, and all
amendments to the Uniform Building Code, save and accept those
specifically excluded by action of the governing body of the City of
Southlake, Texas.
SECTION (2): PERMITS, FEES AND INSPECTIONS
Permits, inspections and fees associated therewith, so far as
provided in the Uniform Administrative Code, 1985 Edition, as adoption
by the City of Southlake, shall apply to the Uniform Plumbing Code,
adopted by the City of Southlake by this ordinance.
SECTION (3): PUBLICATION
That the City Secretary of the City of Southlake shall certify to
the adoption of this ordinance and cause the same to be published.
SECTION (4): PENALTIES
That any person, firm or corporation who shall violate any of the
provisions of this ordinance and who is convicted of same, shall be
fined in any sum not be exceed TWO HUNDRED DOLLARS ($200.00) and that
each and every day that any violation of any provision of this
ordinance continues shall constitute and be deemed to be a separate
offense.
SECTION (5): REPEAL OF CONFLICTING ORDINANCES
All ordinances or parts of ordinances, or rules and regulations,
or parts thereof in conflict with the provisions of this ordinance are
hereby repealed.
SECTION (6): CIVIL REMEDIES
Notwithstanding any penalty provisions contained herein, or the
application and enforcement of any such penalty provision, nothing
shall prevent the enforced removal of prohibited conditions or the
enforced prevention of violations of the Code by injuctive or other
civil remedy.
SECTION (7): SAVINGS CLAUSE
If any provision section or portion of this ordinance shall be
held invalid or unconstitutional, the particular provision, section or
portion held invalid or unconstitutional shall not be deemed to effect
the validity of any other section, provisions or portion of said
ordinance.
SECTION (8): EFFECTIVE DATE
That this ordinance shall take effect immediately from and after
its passage and publication in accordance with the provisions of the
general laws of the State of Texas, and it is accordingly so
ordained.
PRESENTED AND PASSED on this the day of
1986
at a regular meeting of the City Council of the Cit of Southlake,
Texas, by a vote of rY ayes, nayes, and abstaining.
